Pacific Avenue WEDNESDAY, JULY 16, 1980 AT 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 p.m, 00- An invocation was given by Rev. Ruben Martinez, Living Hope Baptist Church. Councilman McNeill led the flag salute. M/S/C: AGUILAR/McNEILL. There were no objections. 00- Mayor White explained the procedure to be used in hearing the two items of most concern on the agenda, zoning issues and salary issues. Salary issues would be taken, out of order, due to fewer speakers to be heard. Ground rules were given in regard to those speaking For or Against issues. 00- City Clerk Gair read a letter from the Baldwin Park Employees Association concerning their salary increases, negotiations and a desire for settlement. Donald French, Police Officer for Baldwin Park, President of Public Safety Association. Officer French explained the salaries accepted by the police department in the past and the benefits and increases in percentages offered by the city. Presented graphs comparing: Total Compensation, comparing eight to fourteen cities; Total annual compensation, showing Baldwin Park third from the bottom; Salary Survey, Baldwin Park at bottom, grossly under-Compensated and take home pay hurting badly. Showed chart on loss of police officers and totd of increase in pay as reasons for leaving. Need for a stable police department, for better service to community, Increase of homicides. Asked the Council to try to direct the City Staff to understand this problem and to reconvene with a more enlightened package. Mayor White asked for those that Mr. French represented to stand. He also asked for those supporting this position to stand approximately 60% of the audience stood). Speaking in favor of police pay raises were: Gloria Zook, 4817 N. La Rica Michael Brown, S op & Go Markets, Ramona & Foster Ramona Mendez, 4716 Bresee for Winchell's Donuts) Charlotte Auervach, 14324 E. Olive Jane Lucas, no address stated) All spoke in support of police department pay raises. Of their confidence in the police and the need for a competent and experienced police department. The fine assistance received in the past and the desire for this kind of service to continue. Each asked consideration to give what the police are asking for to keep the best. Mayor White declared oral communications closed. ORAL COMMUNICATIONS FOR LIMITED ISSUE SALARY NEGOTIATION DONALD FRENCH, PRES. PUBLIC SAFETY ASSQC. SPEAKING IN FAVOR OF POLICE PAY RAISES ORAL COMMUNICATIONS CLOSED Mayor White explained the Council's position and instructions to staff on pay raises and salary negotiations. He said that should the Anderson Report show the salaries to be grossly out of adjustment they will be renegotiated and fixed, as they can. He thanked the Association for their professional response and the work put into it. Mr. French thanked the Mayor for his response. 00- It was the time and place fixed for a Public Hearing on the formation of the West Ramona Landscaping and Lighting Maintenance District. Proper publications and postings had been accomplished. There were no written protests. Mr. Ke11y gave a brief resume of the Agenda Packet report. Mayor White declared the Public Hearing opened. Mayor White declared the public hearing closed. RESOLUTION NO. 80-55 INTENT OF THE CITY COUNCIL TO ORDER THE FORMATION OF THE WEST RAMONA LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 IT WAS MOVED AND SECONDED THAT RESOLUTION NO. 80-55 BE APPROVED. M/S/C: McNEILL/HOLMAN. There were no objections. 00- Mr. Kelly explained the amendments and the three areas to be considered in proposal to the modification of overall density of land use element, proposal to amend the designation of certain areas and amend land use element initiated by individual application. He asked that density issue be first and the Center St. rezoning, due to the large number of persons present regarding this project. Mr. Kelly explained the suggested modification to land use density in the reduction of lot sizes from 6,000 sq. ft. 60 ft. frontage) to 5,000 sq. ft. 50 ft. frontage) and the number of units to be allowed. Will allow efficient use of vacant parcels and changes density. Mr. Kelly asked that Council take each case and after the staff report have a Public Hearing. Then after Council discussion take a vote. It was a time and place fixed for a public hearing on the intent of the City Council to consider amendments to the Land Use Element of the General Plan of the City of Baldwin Park. NO. 80-55 ADOPTED AGP-49 AGP-49-1 SUGGESTED MODIFICATION TO LAND USE DENSITY PUBLIC HEARING AGP-49 PORTION OF PUBLIC HEARING OPENED AGP-49-1 Rick Gibson, 4215 Walnut. Does this allow 300 foot deep lot to be divided, creating a flag lot? Mr. Ketly said it allowed a lot to be divided only twice. Persons from the Community speaking were: Duane Shaffstati, 4250 Filhurst Ave. Pauleo Tennies, 4213 Walnut St. Rick Gibson, 4215 Walnut St. Bob Izett, 3812 Athot St. Bill Sloper, Puente Ave. General comments and questions were made concerning lack of opposition to AGP-49-1 effecting the Center St. rezoning and the difference in units per acre between R-G and R-l. What the Citys" recommendations are concerning apartments, HUD projects and street development. Also the possibility of lot splits and contractors'-interest in such properties. Comments favoring the 5,000 sq. ft. lots and advantages of tot-.splits were made. A portion of the Public Hearing on AGP-49-1 was closed by Mayor White. Explanation of R-2 designation change to R-G, same density, made to avoid confusion. Mr. Kelly explained that each item in AGP-49 would be considered and voted on and at the end a single Resolution would be adopted to cover them all. City Attorney Flandrick stated that Mr. Kelty's suggestion is that the Council act informally on each of these items so that the Councils* action, if they wish to approve it, on item one would be to direct the preparation of a Resolution amending the General Plan and permit the 5,000 sq. ft. minimum lot area. CITY ATTORNEY FLANDRICK GIVES MOTION PROCEDURES AGP-49-1 THE MOTION WAS MADE AND SECONDED TO AMEND THE GENERAL PLAN AND PERMIT THE 5,000 SQ. FT. MINIMUM LOT AREA. M/S/C: AGP-49-1 APPROVED HOLMAN/McNEILL. 00- City Attorney Flandrick explained that at the conclusion of all of Councils' actions on the General Plan Amendments a single Resolution will reflect all the informal actions. actions. CITY ATTORNEY FLANDRICK EXPLAINS SINGLE RESOLUTION Mr. Kelly stated that legal notices were published on June 26th and mailers were sent June 25th. He explained AGP-49 2E concerning EIR and the land use study concerning Center St. The R-3 rezoning done in January and the residents opposition and request for return to R-l. He explained the alternatives considered. AGP-49-2E CENTER STREET Mr. Kelly explained what the Planning Commission voted to do: 1) Roll the density up from original plan to mid-block of Center Street. 2) Reduce the original density to R-G. 3) Request Council to initiate assessment district proceedings for improvement of Monterey Ave. Mayor White asked for an explanation of the procedure to DISCUSSION be followed if the Council makes changes in the zoning that are different from the Planning Commission. Mr. Kelly explained that if the Council decides to modify a Commission recommendation, it must go back to the Commission for a report prior to final action by the Council. City Attorney Flandrick stated that if the Council takes a different position than the Commission that would require that it go back to them for a report, not for a new hear- ing, on the Councils' proposed changes. If a change were made to R-G totally then that would require, not only a report, but also hearings before the Commission and Council to rezone in accordance with Council decisions. Councilman McNeill pointed out the Commission recommendation of the entire area as R-G, and asked if a change was made in any one area would it have to go back to Commission. City Attorney Flandrick said any one, not all, goes back if there are changes. Councilman McNeitI questioned regarding building Town- houses or Condominiums in R-l zoning. Mr. Kelly commented that there could be a planned development project, but it must stay at R-l density. Motion was made that the zoning be called single family residential, low density. City Attorney Flandrick stated that the motion was correct and it will be transmitted to the Commission and the report comes back, and Council accepts the report to amend the General Plan accordingly, then there will be a proceeding involving reclassiflcation of this property to zone R"l, That will be a hearing before the Commission and Council, that action must be consistent with whatever the final action is. Mr. Kelly stated that alternative street plans will be looked at if Council so Instructs. THE MOTION WAS MADE THAT THE PLANNING COMMISSION STUDY BE CHANGED AS FOLLOWS: 1) THAT THE AREA BETWEEN SOUTH OF LOS ANGELES, TO PALM AVE. ON THE SOUTH t0 WALNUT ON THE EAST AND FILHURST ON THE WEST BE CONSIDERED FOR SINGLE FAMILY RESIDENTIAL. LOW DENSITY; 2) THAT THE AREA FROM LOS ANGELES ON THE NORTH TO BURSCH SCHOOL ON THE SOUTH TO MERGED ON THE EAST, WALNUT ON THE WEST BE CONSIDERED FOR R"G CLASSIFICATION. M/S/C; KING/McNEILL, ROLL CALL VOTE. There were no objections, 00- Mr. Kelly explained this am as Kenmore Ave.. Idaho and Merced and recommended living urea as R-6 as recommended by Planning Commission and Staff. Mayor White opened a portion of Public Hearing on ASP-49 2A. Also loss of privacy in two story development. Mr. Ketly explained the further study needed and Mr. Sloper could come Individually and Staff would work with him for a change. Mayor White explained spot zoning now is necessary in land development. A portion of the Public Hearing on AGP-49-2B was closed by Mayor White. IT WAS MOVED BY COUNCILMAN AGUILAR THAT THE STAFF RECOMMENDATION BE ACCEPTED. MOTION DIED FOR LACK OF A SECOND, A discussion was held by Council in regard to too many apartments already in the city and a need for looking at other ways of developing the area. COUNCILMAN KING MADE A MOTION TO RETURN THE RECOMMENDA- TION TO THE PLANNING COMMISSION TO FIND A BETTER WAY OF DEVELOPING THE AREA. MOTIO^ DIED FOR LACK OF A SECOND. City Attorney Flandrick explained the procedure on referring a recommendation the Commission for a report. THE MOTION MAS MOVED AND SECONDED THAT AGP-49-2B BE RETURNED TQ THE PLANNING COMMISSION AND RECOMMEND ZONING CHANGE TO R-G. M/S/C: HOLMAN/McNEILL. There were no objections. 00- Mr. Kelty explained AGP-49-2C as South of 1-10, East of Pacific Drive, West of Frazier Street, South of Walnut Creek Flood Control Channel. Reclassified from Neighborhood Commercial and R-3 to Single Family Residential and R-l. Higher Density could be considered Planning Commission recommends a portion as CM and remainder R-3. Staff recommendation is R-G. A discussion was held in regard to the feasibility of R-3 or R-G zoning and combining of land parcels, also the need for logical lines to drawn in developing this area. IT WAS MOVED AND SECONDED THE RECOMMENDATION OF THE PLANNING COMMISSION BE ACCEPTED ON AGP-49-2C. M/S/C: HOLMAN/KING. There were no objections. 00- Mr. Kelly explained AGP-49-2D as Northwest of Baldwin Park Blvd., East of Francisquito and Garvey and South of the 1-10 Freeway. Staff and Commission recommends this remain Single Family Residential. Mayor White opened a portion of the Public Hearing on AGP-49-2D. Speaking Against a zone change were: Ethan Gray, 13671 E. Garvey Ave. Roberta Galen, 3415 E. Sunset Hill, West Covina A portion of the Public Hearing on AGP-49-2D was closed A discussion was held in support of the zoning now in effect remaining and holding future CM zoning for later, with better plans available in October. A moratorium on this was suggested and City Attorney Flandrick stated this could be done by a four-fifths vote of the Council. IT WAS MOVED AND SECONDED THAT AGP-49-2D BE LEFT AS IT IS NOW IN THE GENERAL PLAN, AS CM, AND PLACE A MORATORIUM ON IT UNTIL THE CORRIDOR STUDY CAN BE DONE. M/S/C: HOLMAN/McNEILL. There were no objections. 00- Mr. Kelly explained AGP-49-3A as 13834 Ramona Blvd. City was reluctant to give this change. Applicant will continue matter later. Commission left as is until October. Mayor White opened a portion of the Public Hearing on AGP-49-3A. Speaking against was: Alfred Ramirez, 3727 Rhodes Lane A portion of the Public Hearing on AGP-49-3A was closed by Mayor White. Request for R-3 change by single applicant.
