Pacific Avenue, Wednesday, DECEMBER 17, 1980 at 7:30 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:30 P.M. 00- An Invocation was given by Councilman IIolman. City Manager Sexton led the Flag Salute. INVOCATION FLAG SALUTE ROLL CALL: Present: COUNCILMEN AGUILAR, McNEILL, HOLMAN, KING AND MAYOR WHITE Also Present: CITY MANAGER SEXTON, CITY ATTORNEY FLANDRICK, DIRECTOR OF ADM. KELLY, CITY PIANNER, DE STEFANO, CHIEF OF POLICE SNOWDEN, CITY TREASURER MONTENEGRO, AM) CITY CLL'RK GAIR Council met in a Joint Executive Session with CRA to discuss pending litigation and personnel matters. 00- City Clerk Gair presented the Consent Calendar: 1. Approve minutes of November 26th and December 3rd, 1980 2. Receive and File Treasurer's Report of November 30, 1980. 3. Waive Further Reading and Adopt RESOLUTION NO. 80-106: ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 4. Deny Claim against the City Tim Tabler And Janna Bo lieu 5. There were no objections. 00- Mr. Kclly reported on the Rivergrade Commercenter Assessment District which was initiated in the fall of 1980 for the construction of roads and utilities. Since negotiations with owners and developers have been successful, Staff recommended termination of this Assessment District and sugf.ost Council instruct City Attorney Flandrick to draft 1'ie proper termination Resolution. Ramona Boulevard. AGP-50 No. 2 Has been withdrawn by Staff and recommended no action at this time. AGP-50 No. 3 To amend the land use designation from Commercial Manufacturing to General Manufacturing on property generally located east of Baldwin Park Blvd., south of the San Bcrnardino I-10) Freeway, west of Francisquito Avenue and north of the Walnut Creek Wash excluding property located at the northwest corner of Vineland Avenue and Francisquito Avenue. Mayor White declared the Public Hearing open on AGP-50 1^3. Hal Burton, 3800 Bradford), regarding his eight units on Maine Avenue, questioned the feasibility of the kind of development planned. He does not want to see this area changed to industrial due to concern for noise and traffic. Mr. Arlisan, San Bernardino Road in Covina), owns 1320 and 1330 Maine Avenue properties. He asked for an amendment or variance for Maine because of children and families residing there. Mayor White explained the General Plan and its intent. He assured those present that environmental impact reports and studies will be reviewed for the entire area involved so that control of the area will be maintained. Mr. Kelly stated that the plan is for future land use, not existing land use, and no changes would occur until the present land use is no longer of value and must conform to new General Plan and Zoning. Council discussion was held. Mayor White declared the Public Hearing closed. Councilman King stated that the Zoning is legal non- conforming now and felt the Council is placing no hardships on those involved. It was moved and seconded to approve Resolution No. 80-107, A Resolution of the City Council of the City of Baldwin Park Amending the Land Use Element Map of the General Plan, and Certifying the Negative Declaration Case No.AGP-50)". M/S/C: KING/McNEILL. There were no objections. Mr. Bluth spoke to MR. BLUTH the Housing Department regarding a loan but he did not contact Mr. Kclly to discuss the results. Council discussed this appeal. Councilmcn King and Aguilar requested that the possibility of time-limit waivers and a flexibility to the Code be considered and researched. Mr. Flandrick read Section 7006 of the Baldwin Park Municipal Code to the Council stating that the above suggestion would concern amending the Code itself. Council then discussed this in detail. It was moved and seconded to deny the sidewalk waiver in order to conform to the present Municipal Code laws, and remain consistant. M/S/C: HOLMAN/WHITR. CITY OF BALDWIN PARK ADDING APPROVED SECTION 3902 TO 11 IE BALDWIN PARK MUNICIPAL CODE RELATING TO A PROHIBITION AGAINST THE PLACEMEN OF BARBED WIRE FENCING It was moved and seconded to approve Ordinance No. 816 as stated above. ROLL CALL VOTE: AYES: COUNCILMEN Aguilar, Holman, King, McNeill, Mayor White NOES: COUNCILMEN None ABSENT: COUNCILMEN None 00- NEW BUSINESS: Council discussed the approval of the Barbed Wire Urgency Ordinances and concurred to instruct Staff to check into the possibility of approving a similar Ordinance to cover the Commercial and Business areas as well. Mayor White indicated that plans arc underway, in cooperation with the School District, to honor the team's victory in a special way. Councilman Holman recommended Council approval to grant the City Employees December 26th off as a City Holiday. Council concurred. M/S/C: HOLMAN/AGUIIAR. There were no objections. Councilman McNeill stated that Council has received a letter from Pete Schabarum requesting our City to pass an Ordinance against outdoor signs which are detrimental to our community, and requested Council approval to this request. Council discussed the Ordinance and directed Staff to review the prospect and report back at a later date. 00- Mayor White declared Oral Communications open, and introduced Mr. Lawrence of the Gas Company: Mr. Lawrence gave a presentation to Council of the cost of natural gas distribution to all of the citizens, rate increases, and the impact on residential and commercial customers. He indicated that the Gas Company has developed many energy saving programs. Council discussed this with Mr. Lawrence, in particular the affect on Senior Citizens, and thanked him for his presentation. Mayor IVhite addressed a motorcycle park issue which was before the Council. He stated that the City is not a part of the approval of this park. An application is being considered by the County Parks and Recreation for a state grant to build such a park. At the present time, the City has expressed discouragement of approval of this application but may take no action to the County's approval or denial of it. Jack Ray, 12706 E. Farnell, spoke against the Morotcycle Park and asked for Council support of this opposition. City Manager Sexton stated that he spoke with Lee Lucas about this park and also read the newspaper release. The County voted to authorize pursuing the grant money and construction is approximately 3 years away. Staff will listen to all proposals and look at plans before any decision on this. Council held further discussion on this and pointed out the City's disapproval of this plan in the past. Mr. Martin presented Council a petition signed by 250 residents who do not wish to be annexed into the City of Baldwin Park. He stated that he will present the petition to the Board of Supervisors on December 18, 1980. Councilman King cited the advantages of the residents becoming part of our City as they already utilize the Baldwin Park schools, parks, and facilities. Council discussed this matter. Mayor White stated that Baldwin Park has followed all recommended State procedures for the annexation and recommended that the petitioners present the argument to the Board of Supervisors.
