Ihe City Council of the City of Baldwin Park net in regular session in the Council Chanters at 7:30 P.M. 00- An Invocation was given by Councilman Holjnan. Assistant Fire Chief McCann led the Flag Salute. INVOCATION FTAG SALUTE ROLL CALL ROLL CALL: Present: COUNCIINEN AGUILAR, MsNEILL, HOI^AN, KING AND MAYOR WHITE Also Present: Acting City Manager Halloway Deputy City Attorney Teresa Tracy, Dir. of Housing & Economic Developnent, La Claire, Chief of Police Sncwden, Director of Conn. Serv. Kelly, City Planner De Stefano, and City Clerk Gair It was moved and seconded to excuse City Treasurer Montenegro's CITY TREASURER absence. M/S/C: McNEILL/KING. There were no objections. Mayor White introduced future City Manager Ralph Webb and his wife Florence. He welconed them to the City and to the Council Meeting. 00- CITY CLERK GAIR PRESENTED THE CONSENT CALENDAR: 1. Approve Minutes of April 1, 1981. 2. Receive and File Treasurer's Report March 31, 1981. 3. Waive Further Reading and Adopt RESOLUTION NO. 81-30 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BAU3WIN PARK 4- Waive Further Reading and Adopt ORDINANCE NO. 818 AMENDING SECTICN 9400 1HROUGH SECTION 9903 OF THE BAIDWIN PARK ZONING CODE AND ADOPTION OF SAID CODE IN A REVISED FORMAT 5. Waive Further Reading and Adopt ORDINANCE NO. 822 DELETING AND AMENDING CERTAIN SEOTICNS CF ARTICLE II, CHAPTER 4 OF TOE BAUMLN PARK MUNICIPAL CODE REIATING TO COMMISSIONS 6. Deny Claim Against the City Juan Manuel Cisneros 7. Deny Claim Against the City Jose Manual Paez 8. Final Approval of Tract No. 37244 9. Ordinance No. 818 Item No. 4) will be amended to substitute a new exhibit A Baldwin Park Zoning Code.), as well as repeal and rescind Ordinance No. 820, Ordinance 818 will then be brought back to the City Council Meeting for a second reading and approval. He then requested authority for an addi tonal processing time, explain- ing that there were 20 projects unable to be ccupleted by the 16th. He asked for this authority to extend to a maximum final extension of Friday, May 29, 5:00 p.m. Ihis will give developers and applicants time to corrplete processing procedures under the old code. A motion was made to give Mr. Kelly the authority to extend the time period to a final maximum time of Friday, May 29th, 5:00 p.m. and to include any extra there might be beyond the 20th.'VS/C: McNEILL/HOIMAN. There were no objections. 00- REPORTS OF OFFICERS, OMCSSICNS OR CCMm'l'EES: Mr. Kelly informed the Council that Mr. Nufctall's attorney and the City Attorney have worked out an agreement for inprovement of the property under abatement proceedings located at; Nuttall's Green Arrow Trailer Park, 14359 East Garvey Avenue, Baldwin Park. Staff then requested an extension of time, to provide for the improvement, to August 15, 1981. Council discussed Staff reccnmendation and agreed to continue this matter to May 20, for Council consideration. M/S/C: HOI^AN/McNEILL. There were no objections. Lee Lucas explained the proposed expense for naintaining CETA-PSE employees for the continuation of the Graffiti removal program. He stated that there were three positions available for this project and requested Council approval of these positions. Acting City Manager Halloway informed the Council that the City's Budget would not be affected by this increase because of HCDA funding. It was moved and seconded to approve the three positions. COUNCIIMAN AGUILAR NOMINATED COUNCILMAN HOIMAN FOR MAYOR PRO TEMPORE. H/S: AGUILAH/WHITE The motion was not carried due to the following roll call vote: REORGANIZATION OF CITY COUNCIL COUNCIIMAN HOIMAN NOMINATED MAYOR PRO TEMPORE. PCTION NOT CARRIED AYES: NOES: ABSTAIN: AGUILAR, WHITE KING, Mc-NEILL HOIMAN COUNCILMAN KING MOVED TO NOMINATE COUNCIIMAN McNEILL AS MAYOR PRO TEMPORE. The motion died due to lack of a second. The notion died due to a lack of a second. Council discussed the position of Mayor Pro Tempore. It was moved and seconded to continue the present organization of the Council. M/S! McNEILL/KING. There were 00- Council discussed special coninittee assignments changes Resolution No. 81-31. It was moved and seconded to approve this Resolution. M/S/C: AGUTIAR/McNEILL. There were no objections. RESOLOTICN NO. 81-31 DESIGNATING TOE CITY'S REPRESENTATIVES AND ALTERNATES TO CERTAIN MUNICIPAL COMMITTEES AND ORGANIZATIONS 00- NEW BUSINESS: Council discussed a new contract for new City Manager Ralph Webb and moved to approve that contract. Mr. Webb's appointment as City Manager will begin on April 27, 1981. M/S/C: AGUIlAI^/McNEILL. There were no objections. Councilman Aguilar stated that he feels that a Fireworks Application that was submitted by the Mid-Valley Democratic Club is in violation of the City's Code because it is a political organization. Councilnon Aguilar felt that East Side Little League should be granted a FirewDrks Permit in lieu of the Mid-Valley Democratic Club because of the league's contributions to Youth and City betterment. Councilman McNeill, who is a meinber of the Mid-Valley Derocratic Club, stated that his organization is a charitable organization, benefiting the City Civically as well. Council discussed both organizations affiliations and purposes. A possible Urgency Ordinance to allow one more organization East Side Little League) to the City's list of 14 applicants, or to amend the City Code altogether was discussed also. No action was taken. Acting City Manager Halloway introduced Resolution No. 81-32 to the Council in support of Legislation removing the Restrictions and Prohibitions on the Use of Natural Gas in Utility Powerplants and recoiTrnended Council adoption. City Clerk Gair explained the present Fireworks Permit procedures in relation to the City's Municipal Code. 00- Mayor l\hite declared Oral Conrnunications open and invited those wishing to speak to come forward. Mr. Bill Adrian came forward and asked Council's moral support as he travels to Sacramento to represent the City of Baldwin Park's Senior Citizens in the passage of some bills before the Senate and Assembly. Mayor White and the Council extended best wishes in his efforts. Joe Leon, President of the East Side Little League stated that he agreed with Councilman Aguilar regarding the Mid-Valley Democratic Club's Fireworks permit. Councilman McNeill explained further the functions of Mid-Valley Democratic Club in the coninunity. Julia McNeill came forward and stated that she is a member of the Mid-Valley Democratic Club. She informed the Council of some of the achievements of the Club and its uiportance to the City of Baldwin Park. Adeline Trujillo, member of East Side Little League stated that she nas had difficulty in obtaining financial support from the citizens of Baldwin Park for the league. That is the reason the league is in need of a Fireworks Booth. Mayor White declared Oral Comnunications closed. SANITATION DISTRICT SERVICE CHARGE DISCUSSED The regular meeting of the City Council of the City of Baldwin Park was adjourned at 9:35 P.M.
