The City Council of the City of Baldwin Park met in regular session in the Council Chanbers at 7:30 P.M. 00- An Invocation was given by Councilman Holman. Councilman King led the Flag Salute. ROLL CALL: Present: COUNCII^IEN AGUIIAR, McNEILL, HOIMAN, KING AND MAYOR WHITE Also Present: City Manager Webb, Dir. of Adm. Serv. Hallcway, City Attorney Flandrick, Chief of Police Snowden, Dir. of Cam- Serv. Kelly City Planner De Stefano Dir. of Human Serv. Lucas and City Clerk Gair It was moved and seconded to excuse City Treasurer Montenegro's absence. M/S/C: McNEILU/KING. There were no objections. 00- City Clerk Gair presented the Consent Calendar: 1. Approve Minutes of May 20, 1981. 2. Waive Further Reading and Adopt RESOLUTION NO. 81-44 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 3. Deny Claim Against the City Donny White, Pamela Laudis and Asimina Laudis 4. He stated that a preliminary Ordinance had been prepared, but new information has been received that required further study that the Public Hearing be carried over to June 17, 1981. Council concurred with the Staff's Recommendation and tabled the Public Hearing until June 17, 1981. 00- Mr. Kelly presented a Staff report regarding a Public Hearing and requested Council approval of Resolution No. 81-47 ordering the levy and collection of assessments for Fiscal Year 1981-82 within the West Ramona Landscape and Lighting Maintenance District pursuant to the Landscape and Lighting act of 1972. He reported no written protests have been received regarding the proposed levy and requested Council approval of this Resolution. It was the time and place fixed for a Public Hearing on the order and levy for collection of assessments for Fiscal Year 1981-82 within the West Ranona Landscape and Lighting Maintenance District. AZC-81: INSTALLATION OF CERTAIN MOBILE HCMES DISCUSSED PUBLIC HEARING OVER TO JUNE 17, 1981 MATTER COTTINUED CN JUNE 17, 1981 RESOLUTION NO. 81-47 STAFF REPORT PRESENTE PUBLIC HEARING: LEVY COLLECTION OF ASSESSMENTS WEST RAMCNA LANDSCAPE AND LIFTING MAINTENANC DISTRICT No one came forward. Mayor Wiite declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 81-47 as stated above. M/S/C: KING/AGUILAR. There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS OR COMMITTEES: It was the time and place fixed for a Public- Hearing on the Appeal Order of Abatement Case No. 80-N-181. \ PUBLIC HEARING CLOSE. RESOLUTION NO. 81-47 APPROVED PUBLIC HEARING: APPEAL OF ABATEMENT 14359 E. Garvey Ave. NUTTALL'S GREEN ARROW TRAILER PARK Mr. Kelly explained the history of violations and order of abatement procedures directed to owner, Mr. Nuttall on February 26, 1981. He stated that Mr. Nuttall and his Attorney Mr. Karlsen are present to give testamony regarding correction of the violations. Mr. Kelly then presented photographs of the violations on the property which still have not been corrected to date. Staff recommends Council declare the property a Public Nuisance, giving the applicant 15 days to obtain all required permits and 15 days to initiate all required work, and a final 15 days to accomplish and complete all work. Mr. Karlsen, Attorney for Mr. Nuttall. addressed the council on the violations which still exist and the status of the work already performed. Mr. Karlsen requested that the Council not declare the property a public nuisance at this time, but to qive Mr. Nuttall an opportunity to meet requirements agreed upon. He also requested that Council not require a cash bond due to the financial expenses involved in the correction of the abatement. Mrs. Eloise Wentzell, Manager of the trailer park, spoke in defense of the trailer park and explained how the repair work is handled. Mayor White declared the Public Hearing temporarily- closed for Council discussion. MRS. ELOISE WENTZELL TRAILER PARK MANAGER PUBLIC HEARING TEMPORARILY CLOSED COUNCIL DISCUSSION Mr. Flandrick listed the options Council would have regarding the abatement of this property. Council discussed these options. Mayor White declared the Public Hearing reopened to hear further testamony from Mr. Karlsen. PUBLIC HEARING REOPENED MR. KARLSEN Mr. Karlsen stated that the reasons why they have had problems contacting the electrical contractor. Council discussed the agreement between Mr. Nuttall and Mr. Dawson of the Building Department regarding submittal of weekly, written progress reports to the City. Mr. Karlsen stated that Mr. Nuttall rmde oral reports MR. KARI£EN to Mr. Dawson on the progress of the work, and that Mr. Nuttall did not agree to ccrpletion of any part- ticular stages of work only to complete the work within 24 weeks. Mr. Kelly stated that City policy is to declare the violations on the property, then give the owner sufficient time to make corrections. If the corrections are not made, the property is declared a public nuisance. If the Council does not declare the property a public nuisance, at this time and the work is not done, then Staff will have to reopen the entire case and will lose time. When an applicant wants time to do the vrork, the City policy has been to still declare the property a public nusiance, give the applicant time to correct the violations and close the case. He also informed the Council that if they continue the Public Hearing on this case, that Section 7607 of the Baldwin Park Municipal Code states that the applicant would have 30 additional days in which to correct the violations. Therefore, Staff request that the City Council declare the property a public nuisance tonight. MR- KELLY REPORTS CITY POLICY It was roved and seconded to approve Resolution NO. 81-48 A Resolution of the City Council of the City of Baldwin Park declaring certain real property as a public nuisance and ordering the same abated." Mr. Nuttall is given 15 days to cbtatn all required permits, 15 days to initiate required work, and 15 days to corplete all the rec-ruired work. No bond will be ordered at this time. The one million dollars from the grant will be used for Signal interconnect and signal upgrade systems; Traffic signs upgrade; realignment of Maine & Ramona; and new signals at three intersections. It was moved and seconded to authorize the Mayor to execute program supplement to implement the program. M/S/C: KING/HOIMAN. There were no objections. 00- Mr. Kelly read the Staff report requesting Council to authorize the execution of an agreement with the Office of Traffic Safety and a Traffic Safety Grant. Mr. Kelly explained that the grant would be used to purchase an electronic data processing system. MR. KELLY REPORTS H.E.S. GRANT PROGRAM SAFETY GRAOT PROGRAM APPROVED BY COUNCIL TRAFFIC SAFETY GRANT DISCUSSED It was moved and seconded execute an agreement with Office of Traffic Safety. There were no objections. NEW BUSINESS: to authorize the Mayor to the State of California M/S/C: AGUIIAR/^NEILL. TRAFFIC SAFE7TY AGREEMENT APPROVED Mr. Kelly explained Resolution No. 81-49, A RESOUHTON OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK SUPPORT- ING SB 215 FORAN) AS MODIFIED BY THE l£AGUE OF CALIFORNIA CITIES." This Senate Bill will aid the City in funding to maintain the City*s streets. The League of California Cities will be modifying the Senate Bill to strengthen the City's position to receive maximum funds providing the bill is passed. It was moved and seconded to approve Resolution No. 81-49 as stated above. M/S/C: AGUILAR/KING. There were no objections. RESOLUTION NO. 81-49 SUPPORTING SB 215 DISCUSSED AND APPROVED licensing seconded support KING/McNEILL. 00- Councilman King asked the Council's support of of San Onofre Units 2 and 3, It was moved and to support and approve Resolution No. 81-50 to Licensing of San Onofre Units 2 and 3. 1VS/C: There were no objections. 00- APPROVAL OF RESOLLTTICN NO. 81-50 SUPPORTING SAN ONCFRE UNITS 2 AND 3 Mayor White declared Oral Communications opened and invited those wishing to speak to come forward. Mr. Doug Shaw, 4459 Santa Anita, El Monte spoke on behalf of the Mid-Valley Manpower Consortium. He requested Council approve an allocation to assist the Para Transit Program in next year's operation, July 1st throuth June 30th which would enable Baldwin Park's citizens bus transit within the Los Angeles County area. Mr. Shaw also asked Council to contribute $9,000 for this project as well as initiate a Joint Powers Agreement with Mid-Valley Manpower Consortium. Council discussed Mr. Shaw's requests. Mr. Webb indicated that he has discussed these requests with Mr. Shaw.
