Final Approval Tract Map No. 41802 14. Waive Further Reading and Adopt RESOLUTION NO. 81-54 AMENDING THE REDEVELOPMENT SURVEY AREA FOR STUDY PURPOSES COUNCIL CONCURRED with all items of the Consent Calendar. M/S/C: HOLMAN/KING. There were no objections. CONSHhTT CALENDAR APPROVED 00- Mr. Kelly reported on the Manufactured Housing Production Act of 1980. This law permits the placement of manufactured housing on single family residential lots effective July I, 1981. Mr. Kelly circulated pictures of the modular housing to the Council. The staff recommended that Council approve the Environmental Analysis and Ordinance to amend the Zoning Code to permit manufactured Housing. AZC-81: ZONING CODE AMENDMENT RE: MANUFACTURED HOUSING PRODUCTION ACT OF 1981 It was the time and place fixed for a Public Hearing pertaining to the Manufactured Housing Production Act of 1980. PUBLIC HEARING OPEN John Dunay, 3192 Stuart asked concerning whether these were mobile or modular homes and if they are on permanent foundations. Mr. Kelly said that the modular homes must be stationed on a permanent foundation and be architecturally compatible with the surrounding homes. JOHN DUNAY Mayor White declared the Public Hearing closed. PUBLIC HEARING CLOSED COUNCIL DISCUSSION, ATTORNEY RECOMMENDATION Council discussed the siding and roofing of the modular homes. Mr. Flandrick stated that Urgency Ordinance No. 823 is in compliance with the State law and it is necessary that it be an urgency ordinance since the law becomes effective on July 1st. Mr. Flandrick suggested Council approve the introduction and 1st reading of Ordinance No. 824. It was moved and seconded to approve Ordinance No. 823 as an Urgency measure to amend the Baldwin Park Municipal Code relating to the R-l Single Family Residential Zone regulations Case No. AZC-81), for introduction and 1st reading. URGENCY ORDINANCE NO, 823 APPROVED It was moved and seconded to approve Ordinance No. 824 ORDINANCE NO. 824 Amending the Baldwin Park Municipal Code APPROVED FOR INTRODUCTION Relating to the R-l, Single Family Residential Zone Regulations ANT) 1st READING Case No. AZC-81)" for introduction and 1st reading. M/S/C: KING/HOLMAN. There were no objections. 00- Mr. Kelly explained that Resolution No. 81-5.S relates to West Ramona project only. He stated that in 1980 the Council approved the formation of a special maintenance district for the West Ramona Redevelopment project. Since a new development of 32 condominiums has been constructed, Staff recommends Council approval of Annexation No. 1. It was the time and place fixed for a Public Hearing regarding the West Ramona Landscape and Lighting Maintenance District. Mr. Villa, 3309 Grace, asked what area the annexation would cover. Council informed hhn that it would cover the condominiums constructed on West Ramona Right-of-Way. John Dunay, 3192 Stuart, asked if the cost of adoption and maintenance of the district would he shared equally by all citizens. Mr. Kelly stated that the District is only for the residents on West Ramona Right-of-Way. KELI STAFF REPORT, MR. It was moved and seconded to approve Resolution No. 81-55, Ordering Annexation No. 1 for the levy and collection of Assessment for Fiscay Year 1981-82 for Annexation No. I to the West Ramona Landscape and Lighting Maintenance District pursuant to the Landscaping and Lighting Act of 1972". M/S/C: McNLlLL/KlNG. There were no objections. 00- Mayor IVhite stated that the City already has a lighting and landscaping district established in conformance with the 1919 act. He explained the reason for the change to the 1972 act and the financial drain on the General Fund. Mayor White further explained the procedures for the public hearing. It was the time and place fixed for a Public Hearing regarding the Citywidc Landscaping and Lighting District. Mr. Kelly explained that the Staff has considered all available alternatives and found the 1972 act the easiest to use. There will be a 100°; charge for the lighting and 75°, charge for landscaping. Mr. Kelly stated that the new 1972 act is based on front footage and the total charge for an average 50 foot lot would be $38.25 annually, Mr. ConkILn, of Ken Mullen Consulting Engineers presented a brief summary on how the assessment formulas were derived. Mr. Plandrick stated that the 1972 act has been validated by the courts and is consistent with proposition 13, since funds collected do not represent a tax, but an assessment. Henry Cramcr, 3522 Stichman asked regarding the necessity for the change for a Citywide district. Robert Overholser of 3837 Maine spoke in opposition of the new assessment. He was concerned with people who cannot pay the assessment. Paul Slands 392L Harland asked if the assessment fee is tax deductible. Mayor White stated that he feels it is not. John Baden, 1352 Badillo asked what benefits the citizens will receive. He indicated that he has had trouble getting City trees trimmed. Mayor White informed him that Mr. Kelly will answer his questions if he would leave his name and telephone number. Ray Annett, 13680 Benwood would like to know what type of landscaping is being put in. He discussed some of the problems he has had in root removal and sidewalk repair. John Dunay, 3912 Stewart stated he is in favor of the 1972 act, and would like to know what landscaping would be involved. Mr. Kelly stated that it would involve maintenance of all City owned parks and medians, and installation and maintenance of existing trees. Frank Valles, 13419 Los Angeles Street asked if the assessment will be billed on a one year basis yes), and if the $38.25 will be charged in addition to what he already pays for street lights no). WEAVER FRANK VALLES Ray Annett, 13680 Benwood asked will take care of the parkways. that the City will maintain the in the parkway only. if the district Mayor White answered replacement of trees RAY ANNETT Chcryl Ortiz, 4863 Azusa Canyon Road, asked if Council is aware of heavy traffic and the landscaping problem by the dam on Azusa Canyon Road. Mayor White stated that the City has spoken with Pete Schabarum regarding the problem and they arc trying to obtain funds for maintenance of the area. 1-ton French,a Baldwin Park Police Officer, asked if Tenants are liable for unpaid assessment fees for tlie new district. Mayor White stated that only the property owners are to pay the fees. Paul Tennies, 4213 Walnut stated that he is in opposition to the district. He would like to see the money used to hire additional police officers or to clean up glciss and debris in the City. CliHord Ash 14132 Ohio Street, also Lett that the City should initiate H clean up program to rid the City of glass and debris. Betty Collar, 3248 Manning Street asked questions about the assessment charges and formulas used. Bobbi Izell 3812 Athol, asked the Council to give the total figures for fees received under the 1919 act. Sylvia Soronan 1304b Olive asked why a local election has not been held pertaining to the approval of the assessment and why the commercial and industrial assessment fees are not showing on the chart. Mr. tanner 4917 Marion asked about the effect of the assessment on Marion Street. City Clerk CaLr read several letters of protest received from tin- residents in the City. Mayor White declared the Public Hearing closed. A five minute recess was called to review the questions received during the public hearing. 1'he City Council meeting reconvened. Mr. Kelly answered the following questions received at the public hearing: 1. The 1919 Act is an assessment charge based on assessed value, the 1972 Act is an assessment charge based on front footage. 2. 1'he existing 1919 Act generates the total sum of $450,000. 3. Under the 1972 Act, a typical 50 foot wide commercial/ industrial lot will be charged $57.05 annually. 4. The City Council decides if the assessment district will be submitted as a ballot measure at the next local election. 5. A divided lot is one portion of the total number of lots. Mr. Kelly read Resolution No. 81-56 to the Council stating that the Council could adopt the Resolution as written with certain exceptions. The Resolution should be corrected to indicate that a new Zone 4 is created to differentiate between the Citywidc and West Ramona projects. The Engineers Report should be amended to read 75^ for landscaping. It was moved and seconded to approve Resolution No. 81-56 Ordering the Formation of the Citywidc Landscaping and Lighting Maintenance District and Levy". M/S/C: AGUILAR/McNEILL. Roll Call vote: AYES: COUNCILMEN Aguilar, McNcill, King and Mayor White NOES: COUNCILMEN Holman ABSENT: COUNCILMEN None COUNCIL DISCUSSION RESOLUTION NO. 81-56 COUNCIL APPROVAL AND ROLL CALL VOTE 00- Mr. Halloway requested Council consider approval of the 1981-82 City Budget and Federal Revenue Sharing Funds. One written letter has been received requesting use of the Revenue Sharing Funds for a museum. It was the time and place fixed for a public hearing. Councilman Aguilar asked for modification of the budget to obtain more police cars and officers for traffic enforcement. Mr. Webb stated that the City has applied for a grant in Sacramento to fund the cars and officers. If the City budgets for these items at this time, it could jeopardize the City's chances to receive the grant. Councilman Holman requested clarification on the salary areas of the budget. Mr. Webb stated that it is the objective of the City to remain fully staffed during the year and that the City does not expect to have a salary surplus at the end of the fiscal year. Council further discussed allocating Revenue Sharing Funds for historical society purposes. Councilman Holman suggested putting $50,000 into a sinking fund to the Society for a museum and $50,000 into a sinking fund for a civic auditorium. Councilman McNcill also made this suggestion and the entire Council then directed Staff to research this proposal and alternatives and return to the Council meeting in two weeks on a funding recommendation for the auditorium and museum. Mayor White declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 81-57 to approve and adopt the 1981-82 Budget. M/S/C: AGUILAR/ KING. There were no objections. Staff recommended Council continue with the present Older American Transit System. It was moved and seconded to accept Staff recommendation and not fund Mid-Valley for transportation at this tune.
