The City Council of the City of Baldwin Park met in Regular Session in the Council Chambers at 7:00 P.M. An Invocation was given by former Councilman Btair Hotman. INVOCATION Councilman King led the Flag Salute. Hemer, City Librarian Morris, City Treasurer Montenegro, and City Clerk Gair 00- City Clerk Gair presented the Consent Calendar: CONSENT CALENDAR 1. Approve Minutes of February 16, 1983, February 26, 1983 and March 2, 1983 2. Receive and File Treasurer's Report January 31, 1983 3. Police Chief Snowden explained that Council is being asked to approve a second year Community Crime Resistance Program. The primary goat of the CCRP is to reduce crime through in- creased community participation with the Police Department. He further explained the number of citizens and business persons involved in the program and the percentage of re- duction in crime. The funding for this will be an 80% 20% match instead of the 90% 0% match the first year. It was moved and seconded to approve the Consent Calendar. M/S/C: KING/IZELL. There were no objections. 00- IT WAS THE TIME AND PLACE FOR A PUBLIC HEARING ON AZC-87, The intent of the City Council to consider an amendment to the Zoning Code of the City of Baldwin Park, adding Section 9450 et a1, entitled Game Arcade and Game Machine Regulations", which includes development standards for game arcades and game machines. Director of Community Services Kelty explained that the City presently operates under the guidelines adopted in February 1982. The City Code distinguishes a game arcade as having more than three game machines. City Council declared a moratorium on game placement on December, 1982 and asked Staff to review possible areas for modification. The proposed regulations are before Council tonight and were reviewed by the Planning Com- mission on February 23, 1983. The draft ordinance was reviewed by the Police Department and School District. Both Agencies feel that the previous areas of concern would be controlled by the Ordinance. DISCUSSION ITEM NO. 9 CONSENT CALENDAR APPROVED PUBLIC HEARING AZC-87, GAME ARCADE AND MACHINE REGULATIONS STAFF REPORT KELLY City Council is required to adopt an tonight to go into effect before the torium, April 1, 1983. He also asked if there was anything to preclude lewd games. City Attorney Flandrick explained Section G and the series of regulations the City has pertaining to adult businesses and he suggested that games would apply, because the City can control this as an adult business. Councilman McNeitt asked if the County Law is compatible to our City can this come back to Council. City Attorney Flandrick responded that if anyone comes up with some- thing that is validated it can be brought back to our City for Council suggestions. Council also asked the reasons for there being no control on distance in regard to day care centers, hospitals, medical facilities and places of worship. City Attorney Flandrick explained that there must be some factual reason in order to make the prohibition valid and most of these facilities are confined persons or Sunday only. If there is an impact there could be a public hearing on this. Council further discussed the wording in 9454 regarding attendants and changed this to read adult attendant". Also discussed was the difficulty in enforcing the re- turn of money lost in game machines. Bud Horn, 14151 Ramona, owner of Park Bowl commended Staff for a well thought out Ordinance. He asked consideration of the following recommendations of additions and deletions: A. Location. Be for alt machines as well as an arcade. No machines period within 500 feet of a school. Council agreed to rewording A to read, Neither a Game Machine or a Game Arcade D. Interior Visibility. Regarding glass frontage. Mr. Horn inquired about ob- taining a variance. Director of Community Services Kelly explained that the bowling alley could come in to amend their case and con- sider as a singular request to deviate from the stand- ards. Those with 3 or less machines do not present a problem. F. Bicycle Racks. Inquired if the number of bicycle racks being required could reduce. After discussion Council agreed to changing the language in the section to read, Each Game Machine and each Game Arcade operator shall provide bicycle racks in an amount determined by the granting authority of Conditional Use Permits". 9454. one adult per ten game machines. Mr. Horn felt this was restrictive due to the cost of almost $20 per hour this could requi re. Council discussed with Staff the reason for this number of adults to machines. City Attorney Flandrick recommended that management review this on an Ad Hoc basis and this be increased or decreased when reasonably required for the operation. Mr. Horn commented further on the benefits of background check and approval by the Police Department. He inquired about outside noise limits. Staff commented on outside noise and difficulty of regulat- ing this. Council also commented on what constitutes noise level violations and also on looking into the City having a noise level meter. Mayor White declared the Putbic Hearing closed. The City Council of the City of Baldwin Park met in Adjourned Regular Session in the Council Chambers at 2:00 P.M. ROLL CALL: PRESENT: COUNCILMEN AGUILAR, IZELL, McNEILL AND MAYOR WHITE ALSO PRESENT: DENNIS HALLOWAY ACTING CITY MANAGER, JIM DE STEFANO CITY PLANNER, BILL KELLY DIRECTOR OF COMM. SERVICES ABSENT: COUNCILMAN KING 00- The Adjourned Meeting of the City Council toured residential, commercial and industrial development projects in the Cities of Baldwin Park, Duarte, Monrovia and Irwindate.
