The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 P.M. The Invocation was given by Councilman Izett. Police Chief Snowden led the Flag Salute. ROLL CALL: PRESENT: COUNCILMEN KING, AGUILAR, IZELL, McNEILL AND MAYOR WHITE ALSO PRESENT: City Manager Webb, Acting City Attorney Pierik, Dir. of Adm. Serv. Halloway, Dir. of Comm. Serv. Kelly, Police Chief Snowden, Fire Chief McCann, City Librarian Morris, and City Clerk Gair It was moved and seconded to excuse City Treasurer Montenegro's absence. M/S/C: KING/IZELL. Waive Further Reading and Adopt RESOLUTION NO. 83-56 AMENDING RESOLUTION NO. 79-110 SETTING FEES AND CHARGES FOR ISSUANCE, PROCESSING AND FILING OF VARIOUS CITY SERVICES, PERMITS AND LICENSES Councilman Aguitar asked that Consent Calendar Item No. 5 be held and Councilman McNei11 asked that Consent Calendar Item No. 9 be held for questions. It was moved and seconded to approve Consent Calendar Items No. 1 through 4, 6, 7, 8 and 10 through 13. M/S/C: KING/McNEILL. There were no objections. 00- Councilman Aguitar was concerned about Consent Calendar Item No. 5, Exhibit A and Council's previous agreement not to have a Senior Code Enforcement Officer. City Manager Webb explained that this title is included within the classification but is not authorized in the budget. In response to Councilman's Aguitar question regarding the Administrative Assistant position City Manager Webb explained that in the event that the position were vacated and not refilled the family of classifications would still show the Administrative Assistant position. It was moved and seconded to approve Consent Calendar Item No. 5. M/S/C: IZELL/AGUILAR. There were no objections. 00- Councitman Aguilar asked about Item No. 9 and whether maintenance of the civic center and other City buildings could be maintained by the City's staff. City Manager Webb explained that these are annual maintenance agree- ments for repair on certain equipment and that the maintenance of the civic center is addressed in Consent Calendar Item No. 10. It was moved and seconded to approve Consent Calendar Item No. 9. M/S/C: KING/McNEILL. There were no objections. 00- Councitman McNeill asked why the Consent Calendar Item No. 10 Maintenance Contract doesn't include the maintenance of the Community Center. Director of Community Services Kelty explained that the Boy's Club contract requires them to maintain the facility and the landscaping. Councilman McNeitt said the building is not kept up as it should be and suggested that Council include the Community Center building in with the maintenance of the Civic Center Buildings. NEW BUSINESS Councilman King commented on the Mayor's Leadership Institute and the Mayor's and City Manager's intent to attend. He asked if this was a necessary trip and asked the City Manager to re-evaluate his attendance, in light of the budget. City Manager Webb said he wouldn't have made plans to attend if he didn't think this meeting was valuable. He gave an estimate of the cost for him to attend. Councilman King stated that it was the Mayor's perogative to attend. Councilman King made a motion to direct the City Manager not to attend this Institute. M/S/C: KING/AGUILAR. ROLL CALL VOTE: AYES: COUNCILMEN KING, AGUILAR, McNEILL__________ NOES: COUNCILMEN IZELL, MAYOR WHITE ABSENT: COUNCILMEN NONE COUNCIL DISCUSSION MAYOR'S LEADERSHIP INSTITUTE MEETING MOTION TO DIRECT CITY MANAGER NOT TO ATTEND ROLL CALL VOTE Mayor white explained that this is a joint meeting for Mayors and City Managers and that he did not feel it would be of value for him to attend without City Manager Webb. He asked the City Manager to cancel his reservations also. In answer to Council McNeill's question. Mayor White explained the purpose of the Institute and said that this institute is designed for Mayors and City Managers together. Council discussed the information material received and not received regarding this institute. They also dis- cussed the benefit of other meetings such as the League of California Cities meeting and the difference between the league meeting and the Institute meeting. Councilman Izetl moved that the City Council not go to New Orleans this fail in order to save this cost to the city. MAYOR REQUESTS RESERVATIONS CANCELLED MOTION MADE THAT COUNCIL NOT ATTEND NEW ORLEANS CONFERENCE Councilman McNeill gave reasons why he would be attending the League of California Cities meeting in New Orleans and San Francisco. He said he intends to attend both meetings. Councilman King said he agrees that Councilman McNeill should attend the League meetings since he is the City's delegate. Councilman Izell said he felt that if Council was going to restrict certain travel. Council should go to meetings in California only. Mayor White said that the meetings are good, but cost money. If the Council is going to be austere they should be consistent. Director of Community Services Ketty explained that the Owner will have to post the property in accordance with the Vehicle Code lanquage and call the police depart- ment if someone trespasses. He explained the City's tow- away procedures and the tow-away procedures if the owner removes the vehicles himself. He said the owners were contacted recently and cars have been removed. Tne property needs to be property posted. Councilman McNeilt referred to the previous car lot problem on the Alpha Beta property. Mr. Kelly explained that Alpha Beta had towed these vehicles away. Following Council discussion of the City's rights in regard to enforcement on private property, the Acting City Attorney said the City could abate this as a nuisance and seek legal enforcement. The City could file against the owner as well as remove the cars. In response to Mayor white's question, Mr. Kelly said he would look into an ordinance that would deal with this problem. Acting City Attorney Pierik said he would tike to prepare Council options and present them at the next Counci1 meeting. 11 r/.^. c l /. n Mr. Kelly said there is no provision for having For Sale' sign on a car on private property. But if a person runs a business, it is a zoning violation. Chief Snowden stated he feels that he and Mr. Kelty will be able to work with the owner to post signs. 00- It was moved and seconded to adjourn the regular meeting of the City Council to a closed session at 7:50 p.m. M/S/C: McNEILL/AGUILAR. There were no objections. The regular meeting of the City Council reconvened at 8:15 p.m. Roll Call remained the same. Mayor White said that the Council discussed pending litigation, gave instructions to its Staff and Attorneys and took no formal action. 00- Mayor White declared Oral Communications open and invited those wishing to come forward. Aileen Pinheiro, 13009 Amar Road spoke about her wish to obtain possible community donations for renovation of the Civic Auditorium. Helen Montgomery spoke about zoning regulations regarding her property and building permits for sewer installation. She felt she was over charged for some trees. She would like the building processes clarified. Mrs. Montgomery also suggested that the City's redevelopment plans in- clude a public toilet at the Alpha Beta Shopping Center. Mayor White explained public toilet facility laws as they pertain to private property. Mayor White declared Oral Communications closed.
