SEPTEMBER 7. 1983 The City Council of the City of Baldwin Park met in adjourned regular session in the Council Chambers at 6:00 p.m. ROLL CALL: PRESENT: ALSO PRESENT: COUNCILMEN IZELL, AGUILAR, ROLL CALL KING, McNEILL AND MAYOR WHITE City Manager Webb, City Attorney Ftandrick, Acting Dir. of Comm. Serv. Smith, Dir. of Housing & Economic Dev. Hemer, Police Chief Snowden, Fire Chief McCann, City Librarian Morris, City Treasurer Montenegro, and Deputy City Clerk Peltegrin 00- Mayor White called the meeting to order and asked City Manager Webb to report on Cable T.V. City Manager Webb introduced Mr. Carl Pilnick, President of Telecommunications Management Corporation. He said that Mr. Pilnick and his company have been retained to assist the City in the franchising processes for Cable T.V. Mr. Pilnick explained the necessary steps and procedures for selecting a Cable TV Company for the City. He spoke about the need for the passage of a regulatory Ordinance, bid packages, proposales, bond securities, and the importance of enforcement provisions in the agreement. Mr. Pilnick also gave examples of different uses for Cable TV and said that the franchise agreement would have a 15year term. Cable service could start as soon as 1985. In response to Council questions, Mr. Pilnick said that the state laws favor the cable TV companies and it would be difficult for the City not to renew a company franchise agreement after the 15 year term. He also responded that he wi11 provide the City with a written report which wi11 discuss pros and cons of the issue, include a draft ordinance, request for proposal package and franchise agreement. This information will inform Council what protection the City will have. Mr. Pilnick said there wi11 be a minimum requirement included in the request for proposals requiring the company to have a studio facility usually a mobile van) plus a business office located in the City of Baldwin Park. He also explained cable connections, On-TV and over the air frequencies, and the different companies that other cities are using for Cable TV service. Mayor White then asked if anyone in the audience would like to speak on the Cable TV subject. Leo Lowe, 3302 Patritti was concerned about the assurance that after 15 years the agreement would have a cut off should the City not want to renew the contract. Mr. Pilnick said the city would have no obligation to renew, but it would be difficult to get the company out. Council will make the franchise agreement as binding as possible to make sure these concerns are met.
