The City Council of the City of Baldwin Park met in Adjourned Regular Session in Room 307 of the City Hall ROLL CALL: PRESENT: COUNCILMEN IZELL, KING AND MAYOR PRO TEM McNEILL ALSO PRESENT: Dir. of Admin. Serv. Halloway, City Attorney Flandrick, Dir. of Housing & Economic Dev. Hemer, City Planner DeStefano, Planning Commissioners Rumney, Shaffstall and Richard, and City Clerk Gair Councilman King asked that the minutes of the Adjourned Regular Meeting of the November 16, 1983 include the wording that It was the consensus of opinion to accept the survey average rounded off to an even number". It was moved and seconded to approve the minutes of the Adjourned Regular Meeting of November 16, 1983 with the above correction. M/S/C: RICHARD/IZELL. There were no objections. 00- The City Council and Planning Commission discussed a recommenda- tion shown in the November 16th minutes which indicates that Conditional Use Permits would come before the Planning Commission and a11 Zoning Variances and Minor Variances would go to the Zoning Administrator for review. Councilman King felt that Conditional Use Permits and Zoning Variances should go before the Planning Comnission and only Minor Variances should come before the Zoning Administrator. Mayor White was present at 6:20 p.m. City Planner DeStefano recommended that the Zoning Administrator receive a11 Zoning Variances and Minor Variances since his time schedule is more flexible for review of these items. He suggested that the Zoning Administrator refer difficult variances to the Planning Commission for review. The Planning Commission and City Council discussed creating written guidelines to differentiate between Zoning Variances and Minor Variances. The present $75.00 appeal fee, charged to applicants wishing to appeal Zoning Variance rulings, was also discussed. Councilman McNeill felt applicants shouldn't have to pay this fee. It was suggested that the deciding authority might be able to waive this fee and that the applicant could get his money back if he withdrew his appeal. Also discussed was a reduction in the $75.00 to $50.00. City Attorney Flandrick stated that there is a problem in determining how a fee is waived. Mayor White recommended the following points: 1. That Conditional Use Permits should come before the Planning Commission and a Consent Calendar should be devised for those that do not need time spent on. On Zoning Variances, articulate between those that are minor zoning variances and send all others before the Planning Commission. 3. Maintain a $50 appeal fee. The Council and Planning Commission also discussed the delay that developers would experience from persons wishing to appeal their construction projects if the process were m too easy. made Following discussion, it was the majority opinion of Council and the Planning Commission to keep the appeal fee and change it to a $50 fee. 00- The City Council and Planning Commission discussed private and common recreational open space size. City Planner DeStefano explained that Baldwin Park's Code now provides for 100 feet for private open space and 100 feet for common open space. He discussed the possibility for adding a provision to the code to state that private open space should be Clear to the Sky" to eliminate the possbitity of a balcony beina built over another balcony. After the City Council and Planning Commission discussed the open space problems of a recent development in the City, City Planner DeStefano gave a summary of two recommendations which were accepted by the Planning Commission and Council: 1. Have a City Council and Planning Commission Development Review on projects. 2. Put a clause into the code to say that private open space shall be Clear to the Sky". 00- The City Council and Planning Commission discussed Residential Building Setbacks of yard areas. City Planner DeStefano explained the reasons for recommending a 25 foot setback requirement. Mr. DeStefano suggested that a single story be 20 feet and a multiple story be 25 feet. Fhe Planning Commission and Council discussed this and concurred with this suggestion. $50.00 APPEAL FEE RECOMMENDED DISCUSSION OPEN SPACE FOOTAGE PRIVATE AND OPEN SPACE RECOMMENDATION RESIDENTIAL BUILDING SETBACK YARD AREAS DISCUSSED NE^ FOOTAGE REQUIRMENT RECOMMENDED BY CITY PLANNER City Council the Planning and refer it and the Planning Commission concurred to let Commission discuss density bonus provisions back to Council for discussion. 00- Fottowing discussion, it was moved and seconded to adjourn the Adjourned Regular Meeting at 7:00 p.m. M/S/C: McNEILL/ KING.
