The City Council of the City of Baldwin Park met in regular session in the Council Chairbers at 7:00 P.M. The Invocation was given by Councilman Izell. Mr. Albert Sanders led the Flag Salute. ROLL CALL: PRESENT: COUNCILMEN AGUILAR, IZELL, KING, McNLILL AND MAYOR WHITE ALSO PRESENT: City Manager Webb, City Attorney Flandrick, Dir. of Adm. Services Halloway, Dir. of Comm. Serv. Smith, Dir. of Housing Economic Dev. Hemer, Chief of Police Snowden, Fire Chief McCann, City Librarian Morris, and City Clerk Gair City Treasurer Montenegro's absence was automatically excused. 00- City Clerk Gair presented the Consent Calendar: 1. Approve Minutes of March 7, 1984 2. Receive and File Treasurer*s Report February 29, 1984 3. Waive Further Reading and Adopt RESOLUTION NO. 84-24 ALLOWING CLAIMS AND DEMANDS AGAINST THE CITY OF BALDWIN PARK 4. Deny Claim Against the City Alfred Sandoval 5. Approve Contract Grading and Landscape Plans for Elderly Public Housing Project 6. Approve Request for Proposals Disposition of City-owned Property 7. Waive Further Reading and Adopt RESOLUTION NO. 84-25 MODIFYING T1IE PROCESS FOR GENERAL PLAN AMENDMENTS Councilman King asked that Consent Calendar Items No. 6 7 be held for discussion. It was moved and seconded to approve Consent Calendar Items No. 1-5 as presented. M/S/C: McNEILL/IZELL. There were no objections. 00- Councilman King asked regarding 4733 Center Street and the current zoning standards and whether construction of condominiums or apartment rentals should be allowed in this zone. Council discussed with Staff and City Attorney Flandrick the options regarding this property and the possibility of holding this item. It was moved and seconded to authorize Staff to dispose of the Center Street property and to not authorize Staff disposal of Francisquito property in reference to Consent Calendar Item No. 6. M/S/C: McNEILL/KING. There were no objections. It was moved and seconded to approve Consent Calendar Item No. 7 as presented. M/S/C: IZELL/KING. There were no objections. 00- Mayor White stated that IT WAS THE TIME AND PLACE FIXED FOR A PUBLIC HEARING ON AZC-90, A Request to consider an amendment to the Zoning Code of the City of Baldwin Park which would permit churches in the C-2, General Commcrical Zone with a Conditional Use Permit. Director of Community Services Smith explained the present zoning of the area and the church's need for a Conditional Use Permit. He explained some of the adverse effects that may arise if this request is approved such as: a significant impact on the City's economic base, parking problems, on off-site traffic congestion and noise from various church-related activities. He said that the Planning Commission has reviewed the proposed amendment and recommends Council deny the request. Mayor White declared the Public Hearing opened and invited those wishing to speak to come forward. Pastor Edward Maestas, 14102 E. Sandstone, Baldwin Park, spoke concerning his church's request for the zone change. He referred to several points from the Staff Report concerning this request and provided information to each point to refute the statements. He told of the church's rehabilitation of drug addicts and gang members and the positive effects of this on the community. He stated that a petition in favor of this request has been delivered to the Planning Department. He spoke concerning the City's approval of condominiums being built in the commercial areas and not churches. He felt that the City's revenues should be increased by patronizing surrounding businesses by church members and a church book store that is planned. Also speaking in favor of the request due to the Church's Rehabilitation Program and community work were: Rebecca Gomez, 4947 Fortin Street, Baldwin Park, Joaquin Sanchez, 4813 N. Fortin Street, Baldwin Park, Peter Loza, 11835 Colima Rd., Whittier, Eugucn Maestas, 2087 Goodall, Duarte, Peter Loza Jr., 11835 Colima Rd., Whittier, and Sal Ortiz, Jr. 1947 Cumberland, West Covina Mayor White declared the Public Hearing closed. Council discussed other suitable sites for the church and the possibility of relocating the church in a high density zone. Director of Housing Economic Development Hcmcr stated he would be happy to work with the church to find a suitable location. Council also discussed with Pastor Maestas the cost to renovate the building proposed, the City's tax base, and Council's concern for changing the zoning code which would possibly allow other churches in a commercial zone. Councilman McNeill explained that the change in zone would be detrimental since it would set a precedence for other churches to be allowed in a commercial zone. ROLL CALL VOTE: MARCH 21, 1984 PAGE TmRE RESOLUTION NO. 84-26 DENYING IU:QUEST APPROVED AYES: NOES: ABSENT: COUNCILMEN McNcill, King, Izell and Mayor White COUNCILMETT Aguilar COUNCILMEN None ROLL CALL VOTE 00- Mayor White stated that IT WAS THE TIME AND PLACE FIXED FOR A PUBLIC HEARING ON 84-V-2, The intent of the City Council to vacate a street easement relating to 4848 North Lante Street. Director of Community Services Smith gave a Staff report explaning that this property was originally dedicated to the County and this vacation of street easement would enable the owner to gain use of the property again. Staff recommends Council adopt the Resolution ordering the vacation of this street easement. Council discussed the City^ street vacation procedures, possible City maintenance of the land due to this vacation, and current zoning of the property. Mayor White declared the Public Hearing on 84-V-2 open and invited those wishing to speak to come forward. There were none. Mayor White declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 84-27, ORDERING THE VACATION OF THAT STREET EASBIENT RELATING TO 4848 N. Lante Street 84-V-2)". M/S/C: KING/IZELL. There were no objections. 00- WRITTEN COMMUNICATIONS City Clerk Gair stated that a letter has been received from Mr. Ernest Tanner. Mayor White asked Mr. Tanner to speak on this issue during Oral Communications. 00- REPORTS OF OFFICERS, COMMISSIONS OR_ COMMITTEES Councilman King reported on the Ad Hoc Committee meeting which was held recently. Major topics of discussion were included in the Staff Report to Council, He stated that the Committee discussed a possible moratorium and decided not to get involved with it at this time. Council discussed Ad Hoc Committee research of the Zoning Code, and their study priorities. Also discussed was the importance of the moratorium issue and Councilman King*s request for the addition of two more members to the Committee. Mayor White suggested that the Committee make a recommendation for the addition of the members to Council for their consideration. Council discussed the pros and cons of this addition and who should decide on making additional appointments. Councilman King stated that he would bring this before the Ad Hoc Committee on the next agenda for discussion and the Committee will make a recommendation to Council. 00- PUBLIC HEARING 84-V-2 STAFF REPORT SMITH COUNCIL DISCUSSION PUBLIC HEARING OPENED 84-V-2 PUBLIC HEARING CLOSED RESOLUTION NO. 84-27 APPROVED LETTER FROM MR. The program is funded by Community Development Block Grant Funds. He explained the proposals received for rehabilitation of eight alleys in the City and said that J.E.G. Construction was the lowest bidder. Staff recommends that agreements be approved for execution and that Council authorize any minor fund of reprogramming, i.e., $15,000 reprogrammtng of 9th year funds and authorize Staff to proceed with documentation for that activity. It was moved and seconded to approve all Staff recommendations as stated above. M/S/C: IZELL/KING. There were no objections. 00- Council also discussed the cost of $38,000 for special inspections on various projects in the City as opposed to using City Staff for this purpose. 00- UNFINISHED BUSINESS City Clerk Gair reminded Council members that their annual filing is due April 1st. 00- NBV BUSINESS Mr. Hemer spoke regarding Consent Calendar Item No. 5 and that Staff had hoped to save money by combining the soil testing for the incubator building with this project. It has been determined that a separate soil test is needed which will cost $1,000. Staff requests Council authorize soil testing services for the Senior Citizen Housing site which will come out of Block Grant money. It was moved and seconded to approve the Staff request. M/S/C: IZELL/KING. There were no objections. 00- Mayor White declared Oral Communications opened and invited those wishing to speak to come forward. Ed Clancy, Veteran Representative for Senator Montoya, spoke on a ceremony he would like to set up for the Veterans. He asked if he could reserve the park on November llth for this activity. Mayor White and Director of Human Services Lucas stated it would be no problem and asked him to make proper application to use the park. Ernest Tanner spoke concerning his written communication to Council. Ho asked that Council write him a letter in answer to his communication. He also spoke concerning the need for more policemen, and the slow response time of police. Mayor White stated that his letter would be answered by the City. Leora Richard, 3366 Millbury, Regional Director for the library gave an update on the library in Baldwin Park. She spoke on the benefits of the library to citizens and several new library programs that are available. She also explained a new security book detection system the library will be using, Leroy Zook, 4817 La Rica, spoke concerning the City's sign Ordinance, candidates placement of election signs in the City, and his desire for adherence to an ordinance by all candidates. Council discussed enforcement of this law and who Mr. Zook could contact regarding this issue. Jean Clancy also spoke concerning the signs being placed in unlawful areas on City property. Mayor White suggested that any further comments be directed to candidates at the upcoming forum.
