The City Council of the City or Baldwin Park met in regular session in the Council Chambers at 7:00 P.M. The Invocation was given by Councilman Gibson. Director of Housing Economic Development Hemer led the Flag Salute. ROLL CALL PRESENT: COUNCILMEN GIBSON, IZELL KING, McNLILL AND MAYOR MUTE ALSO PRESENT: City Manager Wehb, City Attorney Flandrick, Acting Dir. of Admin. Scrv. N'eclans, Dir. of Comin. Scrv. Hcmer, Chief of Police Snowdcn, City Planner Rangel, Eire Chief McCann, City Librarian Morris, and City Clerk Gair 00- City Treasurer Montenegro's absence was automatically excused. 00- Mayor White read the Proclamation declaring February 21-28 as Red, White and Blue Week" and presented it to Lew Farkas of the Baldwin Park American Legion Post No. 241. Applicant: I-'ritz Ehlcrs". Mayor White declared the I^blic Hearing Open on Z-453 ti ZV-518. City Attorney Flandrick stated that the property under consideration is now in a moratorium area. When received by the Planning Commission the Moratorium was not in place. He recommended that the zone change be referred back to the Planning Commission and continued to the first City Council Meeting Ln April. Mayor White declared the Public Hearing on Z-453 and Zv-518 continued to April 3, 1985 and tlic zone change returned to the Planning Commission for reconsideration. Council requested that the Planning Staff give written notice, to those who have" shown an interest, when this will be on the Council Agenda. Mayor White introduced the I^blic Hearing on AZC-92, The intent of the City Council to consider an Amendment to tlie Zoning Code, Chapter 17.30 PI)) Planned Development Zone creating standards for R-l, Single Family Residential Planned Developments". Mayor White declared the Public Hearing Open on AZC-92 and Invited those wishing to speak to come forward. There were none. Mayor White declared the I^iblic Hearing closed. M/S/C: McNEILL/IZELL. There were no objections. 00- REPORTS 01-' OFFICERS, CO^USSIONS AND COMMITTEES ORDINANCE NO. 891 APPROVED Assistant to the City Manager Julcff explained the Film Permit Center that the Southern California Association of Governments SCAG) is requesting cities to participate in. The Center proposes to Facilitate the issuing of permits for a city, assist in developing film permit ordinances, promote the cities as filming locations and mediate problems. Cities can participate in the Center at no direct cost for the first year, March 1985-March 1986, Ms. Julcff also explained that the model MOU submitted by SCAG docs not represent a commitment of any City funds. Staff recommends approval of the Resolution and authoriza- tion to execute a Memorandum of Understanding. It was moved and seconded to approve Resolution No. 85-13, A RESOLUTION OF THE CITY COUNCIL 01-' THE CITY OF BALDWIN PARK APPROVING PARTICIPATION IN THE SOUTHERN CALIFORNIA PUBLIC- PR IVATE FII^I CENTER", and authorize the execution of a Memorandum of Understanding between the City and the Southern California Association of Governments regarding the project. City Manager Webb explained that applications for Federal Land and Water Conservation Fund assistance are currently due for consideration. This would give the City additional Federal funding for relocation and acquisition of property for future expansion of Morgan Park. General Fund and/or CDBG funds would be anticipated to be used to finance other costs if the grant is awarded. It was moved and seconded to approve Resolution No. 85-14, A RESOLUTION OF THE CITY COUNCIL OF THE CITY 01-' BALDWIN PARK APPROVING THE; APPLICATION FOR LAND AND WATER CONSERVA- TION FUNDS MORGAN PARK ACQUISITION PROPERTY". M/S/C: KING/McNEILL. There were no objections. It was moved and seconded to adjourn the regular meeting of the City Council at 7:25 p.m. M/S/C: KFNG/GIBSON'. There were no objections. SCAG FILM CFMHR- STAFF REPORT RESOLUTION N0.85-13 AND M.O.U APPROVED LAND AND WATER CONSERVATION FUND ASSISTANCE APPLICATION- STAFF REPORT RESOLUTION NO. 85-14 APPROVED CTTY COUNCIL ADJOIXNS AT 7:25 P.M. 00- The regular meeting of the City Council was called to order at 7:31 p.m. Roll Call remained the sane. 00- Dircctor of Community Services Smith explained the processing procedure that was developed to process the requests for exemptions from the moratorium which were submitted by owners/developers affected by the moratorium. He outlined the criteria developed for evaluating the in- dividual requests and stated that individual data and evaluation sheets have been included in the staff report. He further explained the economic concerns of the exemption applicants and also the possibility of sub- stantial financial burdens for the Agency if the acquisition of newly constructed developments become cccssarv. Those persons requesting to be exempt from the Redevelopment Survey Area Moratorium because of financial hardship due to cost incurred in the plan check process, the loans already obtained, the securities that arc now in jeopardy, agreements already signed and some projects being only a few days from final approval were: Michael Schwarts, representing I^udolph B. Gonzalez, regard- ing the project at 843 Frazier Street. David Lee, representing Chi-Yaun Hsu, regarding the project at 13921 Francisquito. Christopher Warren regarding the projects at 13902-13237 Carvey and 1366 Maine. John Cerard regarding the property at 12704 Bess Avenue and 3278 Syracuse. Asuncion Avila, regarding the project at 1418 Vincland Avenue, Vinccnte Ccdre regarding the property burned house) at 3117 Big Dalton Avenue. Pat Chew, for Shyh-Hau Leu, regarding the project at 1.4313 W. Carvey Avenue. Mayor White requested a motion to grant an exemption following each request given. No motion was made to grant an exemption to any request made. Councilman McNeill asked if the persons who paid for plan checks could have their money refunded. City Attorney I-'landrick responded that the plan check fee could be refunded or deferred. Mayor White commented that the moratorium applies for 45 days and Council regrets any hardship or inconvenience this has caused. The area needs to be planned right. Tf the City goes up the land value should increase and this will not then inconvenience severely. Councilman King also expressed his concern for looking at the long term effects of developments on the City and the Council trying to act wisely in their decisions. 00- UNFTNTSHhD BUSINESS It was moved and seconded to approve Ordinance No. 889 Second Reading), AMENDING TITLE 3 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO REVENUE AND FINANCE". He requested that Councilmembers attend this meeting so that they could relate what they feel about divisions in the County. Councilman Izcll stated that he was opposed to moving old houses onto property and would like a moratorium on this. Ailcen Pinheiro, 13009 Amar, spoke regarding the Civic Auditorium, and her desire to establish the Rural Heritage of the City.
