The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 P.M. The Invocation was given by Councilman Izell. Frank Fitzgerald led the Flag Salute. PUBLIC HEARING INVOCATION FlAG SALUTE ROLL CALL ABSENCE EXCUSED CONSENT CALENDAR ITEMS NO. 2-4 APPROVED Mayor White introduced the Public Hearing on The intent of the City Council to consider an extension to Urgency Ordinance No. 890, adopted February 6, 1985, which imposed a moratorium on certain portions of property within the City's Redevelopment Survey Area". Mayor White declared the Public Hearing Open on the consideration of an extension to Urgency Ordinance No. 890 and invited those wishing to speak to come forward. I.M. Kenoffel, 1948 Deermont, Glendale, regarding property at 12806 E.Dale-wood sold for apartment development. Rudolph 3. Gonzales, 2655 N. Doreen, El Monte, regarding property on Garvey Avenue and possible bankruptcy. Vincent Cedre regarding 3117 Big Dalton property and burned house to be rebuilt with insurance settlement. Mayor White declared the Public Hearing closed. Councilman Izell stated that he does have property within the survey area, but since only four Councitmembers are present he will vote on the extension of the moratorium. City Attorney Flandrick responded that the issue before Council is a temporary, short term measure that there is no problem with Councilman Izell voting. Director of Ccninunity Services Smith explained that five new exonption requests are contained in the staff report. The requests have been carefully reviewed and based on the criteria set to qualify for an exemption. Staff did not feel any requests met the criteria required. In response to Councilman McNeill's questions Director of Housing and Economic Development Hemer said that the first report from the consultant for the moratorium survey area is due the first week or ten days of April. It may be two to four months before any definitive recormendations can be made by the consultants. Council expressed their regrets that hardships are being placed on individuals, and explained the need to develop the freeway corridor and other areas in a manner that it can be kept for many years. They also spoke of the problems already in existence in the area and requested that the process be speeded up on order to perhaps grant seme exemptions as quickly as Council can. Director of Housing and Economic Development stated that it was difficult to corrmit to a time frame in advance of the study. Staff can ccmnit to informing Council of any reccirinendations for exclusion of geographical areas as they arose. Staff would not wait any length of time to transmit this information. If areas vrould be reccnnend- ed for exclusion the moratorium boundaries could be inmediately changed as deemed appropriate. He said that the consultants would look at the two special instances requested inmediately. It was moved and seconded to approve Resolution No. 85-20, A RESOLUTION CF THE CITY COUNCIL OF THE CITY CP BAITWIN PARK IMPOSING A MORATORIUM ON CERTAIN PROTIONS CF PROPERTY WITOIN THE CITY URGENCY MEASURE)". There were no objections. 00- RESQLUTION NO. 85-20 REPORTS CF OFFICERS, CCM^ISSICNS OR CCMUTTEES Rod Le Mond of McGladrey, Hendrickson & Pullen presented the annual audit for the City, Redevelopment Agency and Housing. Ihe audit has been completed for the 83-84 year and have issued their opinion on the City's financial statements as of 1/31/85. The opinion rendered is an unqualified opinion which in essence states that the financial statements properly present the assests, liabilities and fund surplus of these entities a clean opinion) From a performance standpoint the City's General Fund showed an increase for 83-84 of $122,000, the year end surplus as of June of 84 increased over the prior year end first time this has happened in the last few years). Redevelopment Agency experienced an increase in surplus of approximately $127,000. Mr. Le Mond offered to answer any questions from Council. Mayor White requested that anyone who did not get to make an exemption request during the Public Hearing to come forward at this time. Those requesting exemptions from the moratorium survey area were: David Meyer, 414 E. 4th Street, Santa Ana, represented Charles Nichols regarding property at 1255 Maine Avenue. Councilman King requested this property be looked into also, since it is on the outer fringes of the survey area and possibly helped conclude it quickly. Tijn Baker regarding property at 12910 Bess Street. Director of Housing and Economic Developement Hemer explained the proposed sale of City/Agency owned property at 4719 Center Street. The land has been appraised at $95,600 and the adjacent owner, Mr, Nottingham, has agreed to this price subject to final approval of the proposed eighteen unit planned development. The payment schedule negotiated consists of a $30,000 payment at close of escrow for the land and $4,000 at close of sale of each house until the $5,000 balance is totally paid. Staff reccmnends approval. There were no objections. 00- ORAL CCmUNICATTCNS SALE OF PROPERTY APPROVED Mayor White declared the Oral Ccmnunications Open and invited those wishing to speak to ccane forward. Susan M. Cauldwell, 4051 Badillo Circle, spoke regarding the problem with the lack of law enforcement in the area of the apartments and condos on Badillo/Puente. Also the loitering, drinking, drinking in parked vehicles, cars parked on curbs, double parked cars, harrasement of condo residents, and the accumulation of trash because street sweeper has no access because of cars. She requested that no parking signs be posted on a few streets. Council discussed the problems in that area with cars and the street sweeping, the need for space to allow ample parking and the study being conducted regarding sign posting.
