The City Council of the City of Baldwin Park met in regular session of the City Council at 7:00 P.M. The Invocation was given by Councilman Gibson. Councilman McNeill led the Flag Salute. ROLL CALL: PRESENT: COUNCIIME^ GIBSON, IZELL, McNEILL AND MAYOR WHITE ALSO PRESENT: City Manager Webb, Acting City Attorney Alien, Dir. of Admin. Serv. Halloway, Dir. of Ccrm. Serv. Smith, Dir. of Housing & Economic Dev. HCTCT, Chief of Police Snowden, City Planner Rangel, Acting Fire Chief Burkart City Librarian Morris, and City Clerk Gair 00- The absences of Councilman King and City Treasurer Montenegro were automatically excused. 00- Police Officer John Mills was given the Oath of Office by City Clerk Gair. Council congratulated Officer Mills and welccned him to the City. Mayor White read the Proclamation declaring April as Fair Housing Month". Mayor White read the Proclamation declaring April 15-20 as National Library Week". He presented the Proclamation to City Librarian Morris. Ms. Morris introduced the Friends of Library who were present and invited everyone to the Open House at the library April 15th from 1-3 p.m. 00- City Clerk Gair presented the Consent Calendar: 1. There were no objections. 00- PUBLIC HEARING CONSENT CALENDAR APPROVED Mayor White introduced the Public Hearing on Z-453 & ZV-518, A request for a change of zone from 06 Open Space) to I Industrial) on property located at 4150 Puente Avenue, and an appeal of various conditions of approval for a zone variance from Section 17.34.050.B of the Baldwin Park Municipal Code allowing parking in a required side yard area adjacent to the street. Applicant: Fritz Ehlers Continued from February 20, 1985)". City Planner Rangel explained that this property had been referred back to the Planning CcrTmission on February 20th. According to state law if no action is taken on this within six months from the date of accepting the application it will be considered approved. Automatic approval will occur on May 25, 1985. Mayor White declared the Public Hearing Open on Z-453 & ZV-518 and invited those wishing to speak to come forward. Lee R. Test 15115 Kenoak, spoke in favor of the project so that noise would be decreased. Mayor White declared the Public Hearing closed. It was moved and seconded to direct the Planning CcnTaission to recommend denial or approval of Z-453 and direct Staff to place both Z-453 and ZV-518 on the May 1, 1985 Council Agenda. M/S/C: IZELL/GIBSON. There were no objections. Mayor White introduced the Public Hearing on AZC-93, The intent of the City Council to consider an amendment to the Zoning Code of the City of Baldwin Park, amending definitions of a Hotel, Section 17.04.355, and a Mstel, Section 17.04.475". City Planner Rangel stated that the city has experienced a reduction in revenue from the transient occupancy tax received from hotel/motel room rentals. Rooms being rented for periods longer than thirty days is a possible cause of this reduction. He explained the health and safety problems in this small of unit being used for long term housing. Staff is recOTmending a thirty day maximum limit be placed on hotel/motel rooms and a full day as a minimum rental time. Mayor White declared the Public Hearing Open and invited those wishing to speak to come forward. There were none. Mayor White declared the Public Hearing closed. In response to Council questions City Attorney Alien explained that it was possible to prohibit the room from being rented more than once in a day and a new transient occupancy tax would start each time screone moves in after the thirty day maxijnum. It was moved and seconded to approve Ordinance No. 894, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZCNING CODE AMENDMENT CLARIFYING TTffi DEFINITION CF A HOTEL AND MOTEL. APPLICANT: CITY OF BAUMTN PARK; CASE NO: AZC-93". M/S/Ct M=NEILL/IZELL. There were no objections. Mayor White introduced the Public Hearing on AZC-94, The intent of the City Council to consider an amendment to the Zoning Code of the City of Baldwin Park, amending Chapter 17.36, Service Stations". City Planner Rangel explained that the City is experienc- ing some problems in allowing additional uses convenience stores and other uses) in conjunction with service stations. He outlined the results of the evaluation made regarding seven mixed use service station sites and the maximum stand- ards used by nine other cities. Staff is reccnrending that a minimum site size of 20,000 square feet be adopted for service stations with a mixed use, with additional require- ments as outlined in the Staff report. Mayor White declared the Public Hearing Open on AZC-94 and invited those wishing to speak to come forward. There were none. Mayor White declared the Public Hearing closed. ORDINANCE NO. 894 APPROVED PUBLIC HEARING INTRODUCED ON AZC-94 STAFF REPORT RANGEL PUBLIC HEARING OPE^ AZC-94 PUBLIC HEARING CLOSED It was msved and seconded to approve Ordinance No. 895, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAIDWIN PARK APPROVING A ZONING CODE AMENDMENT TO CHAPTER 17.36 AUTOMOTIVE SERVICE STATION REGULATIONS. APPLICANT: CITY CF BAIWIN PARK; CASE NO. AZC-94". IVS/C: GIBSON/ McNEILL. There were no objections. Mayor White introduced the Public Hearing on AZC-95, The intent of the City Council to consider an amendment to the Zoning Code of the City of Baldwin Park, expanding the permitted uses in the C-l, Neighborhood Coimercial Zone, Chapter 17.18, and I, Industrial Zone, Chapter 17.26". City Planner Rangel explained the requested amendment to the zoning code to allow medical offices in the C-l and I zones. MDSt existing medical offices are located south of Ramona Boulevard, on teine Avenue and Pacific Avenue, None are currently located in the Industrial zone. He explained the traffic that is generated by medical offices and the parking space requirements. The increase in traffic in neighborhood ccnrnercial properties would not significantly diminish the quality of life on these select streets. Medical Offices in the Industrial zone will provide a convenient location to centers of employ- ment. Staff feels that this expanded use will aid in the tenant mix for small neighborhood centers and will provide convenient medical services. There were no objections. 00- PUBLIC HEARING CLOSED ORDINANCE NO. 896 APPROVED REPORTS OF OFFICERS, COMMISSIONS OR COMMITTEES Discussion of the City Council Reorganization designating Representatives and Alternates to ccrnnittees and organiza- tions was held over until the next Council Meeting so that all members might be present. Director of Community Services Snith explained the presenta- tion that was made to the Irwindale Planning Commission regard- ing the concerns which Baldwin Park has about the Cal Mat Development. A letter of commitment was requested of Cal Mat and should have been received prior to the April 4, 1985 Planning Commission Meeting in Irwindale. Since a letter has not been received its contents can not be presented and there is no basis for discussion. Mayor White recommended that this item be put off until a Council Meeting in May since the Irwtndale Planning Commission has rescheduled a meeting for April 18, 1985. Council concurred. Director of Community Services Shiith explained the procedure for processing requests for exemption from the moratorium. This is the fourth set of requests that has been received. The two requests before Council tonight are from Shell Oil Co., 1299 E. Garvey/Bess, and C.D.I. Associates, 3134 Vineland. It was moved and seconded to approve Resolution No. 85-22, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO. 85-20 DESICCATING A REDEVELOP- MEOT SURVEY AREA FOR STUDY PURPOSES. He invited everyone to attend the first service scheduled for the new church building on October 26, 1985. Steven R. Jeppson, 858 So. California Avenue, West Covina, owner of the apartments at 12912 Dalewood Avenue, spoke regarding the condition of the Dalewood Apartments, damage done by windstorm to roof, the money already spent in repairs, working closely with the City to continue to im- prove the apartments and the problems he is having with tenants withholding rent. Mayor White explained the need for Mr. Jeppson to clean up the apartments and that action will have to be taken by the City if he does not do so. He and the City Attorney also explained that the City can not get involved in the tenant/ landlord problems. Robert Hickley, resident of South Pasadena, spoke concerning what he felt might be conspiracy and extortion. Mayor White stated that if there was a crime committed it should be turned over to the proper authorities. Teresa Fuchetfce, Dalewood Apartments, spoke regarding being discharged as managers, the living conditions in the apart- ments, not being able to get another job and not advising people to hold back their rent. Loretta Jeppson, owner of Dalewood Apartments, stated that she had brought records and receipts for all the work done at the apartments. She also told of tenants refusing entry or admittance to apartments for inspection, Laura Gonzales, Dalewood Apartments, spoke regarding what minor improvements were made and how bad the living conditions are. Norman Cheers, 4232 Park Place, asked about improvements being made to his street. Council and Staff discussed whether this street was private or dedicated and said this would be looked into. Eddie last name not available) Dalewood Apartments, spoke concerning poor paint job and holding back his rent because of this. Mr. Renwick, resident of City, spoke regarding the vandalism, drinking, the need for more police protection in the Dalewood area and possibly installing razor wire to control the situation. Mayor White explained that this type of wire has been outlawed in the City. Margaret Perez, Dalewood apartments, spoke regarding the cockroach infestation and the cracks in the ceiling made by the rcofers. Mr. Renwick, requested an urgency law to stop drinking in public. Acting City Attorney Alien explained the recent California Supreme Court decision that made city ordinances not valid relating to consumption of alcohol.
