The City Council and Planning Ccimiission of the City of Baldwin Park met in adjourned joint session in Room 307 of City Hall at 7:00 P.M. Smith, Dir. of Housing & Economic Dev- Homer, City Planner Rangel, Building Superintendent Dawson, and City Clerk Gair 00- City Manager Webb explained that the purpose of this joint meeting is for discussion of specific items that are of concern to Council and Comnission regarding Code Enforce- ment and enforcement of Conditional Use Permits C.U.P.). Mayor White was present at 7:15 p.m. City Manager Webb stated that the Staff report before the Council and Ccimission contain some specific recom- mendations as to improvements that may be considered in the code enforcement program and the enforcement of C.U.P.'s. Revocation of C.U.P. is to be discussed to determine how high a priority the Council and Ccmnission consider that this should have. Contractor's storage yards are a problem for Staff in enforcing permits and direction is needed in this area from the Council and Commission. The issue of the Spanish/Mediterranean Design Theme needs to be considered. Staff needs to better under- stand if that is the design theme that the Council and Ccimission would like to continue. At present Staff can only encourage this design theme outside of the downtown area, they do not have the authority to require this design. Building Superintendent Dawson explained the needs in the ccnTTunity that caused the code enforcement program to be developed. He outlined the way in which the program is funded, the areas and type of enforcement done and the sequence of enforcanent usually practiced. Code Enforcement Officers receive special counseling and training due to the difficulty of their job. Further explained were the significant ongoing problems that exist for code enforcenent. Mr. Dawson requested policy direction regarding the possibility of adopting ordinances requiring chain link fencing of vacant lots, allow the granting of citation powers to Code Enforcement Officers so that district attorney costs could be decreased and abatement speeded up) and an ordinance requiring inspection and issuance of a certificate of occupancy on residential sales. Also requested was an ordinance requiring periodic in- spection of rental dwellings for the upgrading of this type of dwelling. Discussion was held regarding businesses that had out- grown their locations. The problems with relocating these businesses is due to cost. Questions were asked regarding stacks of merchandise being allowed to be higher than fences on some business but not allowed in other businesses. Also discussed was vehicles on lawns needing to be cited so they will be removed, outside storage problems and C.U.P. violations. City Planner Rangel explained the lack of a revocation process in the City since about 1979. Council and Ccmmission discussed the lack of follow up on permits being revoked and unsightly conditions being allowed to continue to exist for such long periods of time. The long process required for revocation was explained by Mr. Rangel. Discussion was held regarding the need to improve the procedures of the City to speed up the processes and enforce the requirements better. Mayor White suggested, that each item be discussed that had been reccmnended to the Council and Ccnmission for consideration. Items for discussion were: D. Council adoption of an ordinance giving Code Enforcement Officers the pcwer of citation would save a great deal of processing time and money spent for District Attorney action. Councilmorbers and Conmissioners expressed their concern about Code Enforcement having this authority without receiving better training and being able to consider priorities and make good judgments in the code enforcement program. Code Enforcement Officer's need to deal effectively with people was also pointed out. Also suggested was the need to budget for enough Code Enforce- ment Officers to handle the workload. A. Direct preparation of an ordinance requiring chain link fencing of all vacant lots in case of repeated violations as a nuisance abatement requirement. The Council and Connission discussed chain link fencing around vacant lots and suggested that posting of vacant lots and public nuisance filings against the owners were more effective than being fenced. B. Authorize use of the City Attorney to obtain orders for removal of inaccessible abandoned autos and entry for inspections denied by cwners. Discussion regarding item B concerned the possibility of civil action against those responsible for blight in the City and the cost savings by the City Attorney handling cases. C. Direct preparation of an ordinance requiring a certificate of occupancy" upon the resale of all residential property. Garage conversion and deconversion was discussed and the effect this has on persons who unknowingly purchase a hcme with this situation existing. Also discussed was legal non-conforming use, conversion by use and conversion by structure change. Consideration of an ordinance requiring periodic inspection of rental dwellings to assist in the upgrading of these types of dwelling units. The Council and Ccmnission discussed their concern regarding this type of inspection. They felt the cost for internal inspections might be too high, that the frequency and standards for the inspection needed to be determined, the City keeping up with the work- load should be looked into, the possibility of re- quiring driveways at rentals should be considered and how to deal with absentee landlords. Mayor White stated that the consensus of the Council and Ccrnnission is that they agree with Items B,C and D. Item E they agree with philosophically, but more research and information is needed. Item A is waived. It was also agreed that if persons are not in conform- ance with their C.U.P.'s revocation should be persued. Also recormended was use of temporary permits. City Planner Rangel explained the problems that are caused by the contractor's storage yards in the City. They don't pay for themselves, they take up valuable land and more seem to be coning to the City. It was recamended that these yards be allcwed on an interim basis and that a time limit be set, there be a footage limit and a special zone be set up for this use. Also discussed was warehouses that exist when an office is in existence with the storing of goods and the need for alleging higher than six foot block wall fencing. City Planner Rangel explained that their is a design manual for the City that speaks of the Spanish/ Mediterranean Design Theme, but there is no record of the Council or Ccinnission specifically adopting this theme. Staff requested direction on the use of this design theme throughout the City. It was reconnended that the Spanish/mediterranean Design Theme be continued in the Central Business District and in other areas the projects be considered on their cwn merits. Ccrmissioner Shaffstall spoke regarding the removal of trees in 1968 on Filhurst, Harlan and Hombrook by the City. Trees were premised to be replaced and have not been replaced and yet persons are now being charged to put in new trees. It was explained that the charge for new trees will be refunded. City Staff will also research the original commitment to replace the trees torn out. It was moved and seconded to adjourn the adjourned joint meeting of the City Council and Planning Carmission at 9:40 p.m. M/S/C: GIBSCN/KING.
