The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 P.M. The Invocation was given by Councilman Gibson. INVOCATION Councilman Izell led the Flag Salute. Council referred this to the Planning Ccrrnission for review. The moratorium/study area was adopted by Council and this property is in the study area. The Planning Ccrnnission voted 3 to 2 to reconmend approval of the zone change. A decision must be made by May 25, 1985 or the project could automatically be approved because of the six month time period having passed since the original applications were filed. Mr. Rangel further explained the concern of Staff regarding the property not being compatible with the neighborhood, no way of controlling noise with a block wall, the irregular shape of the lot and code enforcement problems associated with the property. Staff is reccmnending denial of the zone change and the zone variance. In response to Councilman King's question Mr. Rangel responded that the original reccnnendation was for approval, but now Staff is reccmnending denial. He explained that this was because they did not know then that this would be in the project areas or that the property straddles Flood Control property. One of the real problems is that the ownership of the property is fragmented. Mayor White declared the Public Hearing Open on Z-453 & ZV-518 and invited those wishing to speak to cane forward. Roy Test, 15115 Kenoak, spoke regarding the zone change and building on this property and the noise needing to be contained better when this is improved, Mayor White declared the Public Hearing closed. Council discussed the work being done outside the building that is in violation to the Municipal Code. Council agreed that approval of the project would open the doors to further degradation in the City and there was a need to solve problems now. There were no objections. 00- STAFF REPORT DISCUSSION PUBLIC HEARING OP™ ROY TEST PUBLIC HEARING CLOSED DISCUSSION RESOLUTION NO. 85-28 APPROVED FOR DENIAL) RESOLUTION NO. 85-29 APPROVED FOR DENIAL) REPORTS CF OFFICERS, COMMISSIONS OR COVMITTEES City Manager Webb explained the initial study that was approved by the City Council for consultant services in regard to the Redevelopment Survey Area. He outlined the purpose of this study and reccnmended acceptance of the Phase I study, authorize the execution of a contract for Phase II not to exceed $89,250 and authorize applica- tion for use of Proposition A Funds in the amount of $18,000, Bryce Russell, consultant, stated that the consultant firms had worked about two months on this preliminary analysis. They have concluded that there is adequate evidence that the character of blight does exist. He explained the inadequate access to the freeway and the poor appearance of the businesses on the freeway corridor. He also explained that there are good potential sites within the area for approximately 400,000 square feet of retail businesses, 100,000 square feet of office space and substantial industrial usage. Substantial tax increment and sales tax revenue is possible from the area being redeveloped. In response to Councilman King's question Mr. Russell stated that the opportunity for improvement certainly exists in the area and that they would not exclude any area, but would look at rehabilitating and land use changes. He explained that there is a lot of square feet of vacant office space, but there is a specific market available for office space. It was iroved and seconded to accept the Phase I study and authorize the execution of a contract with Rod Gunn & Associates, Donald Frischer & Associates and Natelson, Levander & Whitney for the Phase II study as described in the Phase I Report, in an amount not to exceed $89,250.00; and authorize application to the Los Angeles County Transportation Ccnnission for approval to spend $18,000 of Proposition A funds as part of the contract noted above. M/S/C: KING/GIBSCN. There were no objections. Chief of Police Snowden explained that it was necessary to amend the Municipal Code to regulate the consumption of intoxicating beverages in public. He told of the ordinances that are presently in effect in neighboring cities and the successful enforconent and prosecution that has been achieved. It is felt that this ordinance will acconplish the City * s objective to restrict consumption of intoxicating beverages in public. Staff recoTnends approval. It was moved and seconded to approve Ordinance No. 899, AN ORDINANCE CF THE CITY COUNCIL OF THE CITY OF BAU3WIN PARK AMENDING THE MUNICIPAL CODE RELATING TO THE CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC". M/S/Ct KING/IZELL. There were no objections. NEW BUSINESS Council discussed the request for a covered patio from the Senior Citizens Center. It was recannended that Building Maintenance look into this to see exactly what it is that is being requested. 00- Mayor White declared Oral Ccmnunications Open and invited those wishing to speak to come forward. Ernie Tanner, resident of Marion Street, thanked Council for the ijnprovernent in Police protection on Marion Street for a few days. He told of the many problems on that street and the people are scared. Roy Test, 15115 Kenoak, asked that there be an hour set for construction work to begin in the mornings.
