The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 P.M. i The Invocation was given by Councilman Gibson. Director of Housing & Economic Developnent Hemer led the Flag Salute. Mr. Montenegro thanked the Council and explained the importance of the Selective Service Program. He introduced Phyllis Lanes representative for this area. There were no objections. 00- CONSEM1 CALENDAR APPROVED PUBLIC HEARING i Mayor White introduced the Public Hearing on Z-452, A request for a change of zone from R-l, Single Family Residential to R-l PD) / Single Family Residential Planned Development, on property located at 13716 Monterey Avenue Applicant: Ross Sanger)". City Planner Rangel explained the request by the applicant, Ross Sanger/ for approval of a zone change to construct 9 single family residences on Monterey Avenue. The proposed project has a density of 8.65 units per acre and will retain the single family character of the development. He outlined the different floor plans, design of the units and the carrnon recreational area. The Staff and Planning Ccnrnission on a 5-0 vote reconnends that the City Council approve 1) the Negative Declaration of Environmental Impact 2) Approve Z-452; and 3) approval of the Developnent Plan and Findings of Fact with the listed conditions. Mayor White declared the Public Hearing Open on Z-452 and invited those wishing to speak to come forward. There were none. Mayor White declared the Public Hearing closed. Mayor White introduced the Public Hearing on AZC-96, The intent of the City Council to consider an amendment to the Baldwin Park Zoning Code, Chapter 17.32, Sign Regulations, as said regulations relate to subdivision tract and construction signs, both on and off premises". City Planner Rangel stated that the intent of these sign regulations is to eliminate the proliferation of on and off-site subdivision signs. Off-site subdivision signs are intended to allow noderate sized temporary directional advertising signs. This will provide for special areas for temporary off-site signs in areas accessible and visible by prospective homebuyers. Mr. Rangel gave a slide presentation to demonstrate the new directional signs being reccnrnended. The Baldy View Chapter of the Building Industry Association BIA) would administer and coordinate the sign program. The sign Program Coordinator for BIA came forward and explained that the program has worked well in other communities by cleaning up the City and satisfying the builders. Councilman McNeill asked if this ordinance would keep people from placing signs on the medians. City Planner Rangel stated there would be certain streets okayed and only those would be legal. In response to Councilman McNeill's question regarding political signs. City Attorney Flandrick responded that this ordinance does not apply to political signs, but does have some limited authority in that area. He offered to give a separate report on that if that was wanted. Mayor White declared the Public Hearing Open on AZC-96 and invited those wishing to speak to come forward. There were none. A2C-96)". M/S/C: McNEILL/KING. There were no objections. It was moved and seconded to approve Resolution No. 85-43, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAIDWIN PARK TO AUTHORIZE THE ESTABLISHMENT OF A UNIFORM TEMPORARY OFF-SITE SUBDIVISION DIRECTIONAL TRACT SIGN PROGRAM". M/S/C: l^NEILL/KING. There were no objections. Mayor White introduced the Public Hearing on AZC-97, The intent of the City Council to consider amendments to the Baldwin Park Zoning Code as follows: A. Section 17.12: R-G Residential Garden Zone. Revisions and additions to the open space, building setback, yard area, interior room standards, and related provisions. B. Section 17.14: R-3 High Density Residential Zone. Revisions and additions to the open space, building setback, yard area, interior room standards, and related provisions. C. Section 17.46: Heights, Yards, Fences, Walls and Shrubs. The addition or clarification of permitted intrusions into required yards and building setbacks". City Planner Rangel explained that the City is currently regulating Multi-Family Development Zoning with Urgency Ordinance No. 877. This ordinance will expire on September 13, 1985. Staff reviewed several projects designed under Ordinance No. 877 and found several improvements which he outlined for the Council. The new standards being recommended are essentially the same except for a modified building setback formula and an increase in living room sizes. These development standards will further improve the design and quality of new multiple family units. Councilman King thanked the Staff for their diligence in clarifying these items, the Planning Ccmnission for looking into this matter, and for being able to serve on the Ad Hoc Cormiittee. He felt that the culmination of everyones efforts have resulted in a good step forward. Councilman Izell spoke of the recommendation of the Ad Hoc Committee to allow effeciency units to be built and the concern regarding these units. None have been built and he felt they could still be a desirable unit. He also expressed his concern about requiring forced air heating units in apartrients and doing away with three story condos. Council and Staff discussed the reason for forced air heating being reconrnended for uniform heating in apartments, the washer and dryers being placed for convenience and safety in facilities, and that the BHJ size of furnaces available on the market were possible larger than allowed for the square footage of a one bedroom apartment. Councilman King reccrroended graduating buildings down, so that light, air and view are not shut off. Council discussed the possibility of amending the ordinance, but Councilman Izell recommended approving the new code and changing later if there are problems'in some of the areas discussed. Councilman Izell requested to state for the record that, He would like to remind everyone that, as far as the effeciency unit goes, put this down, that Councilman Izell told you in 1985 that someday utility bills will be more than your house payment. And forced air heating units are not necessarily the best thing to put in small apartments, and side by side washers will mean most of your people will go to the laundrymt and that's not necessarily safe. And three story buildings with garages under it is the worst thing in any town". Council further discussed that the effeciency unit was recomnended by the Ad Hoc Ccmmittee and by a 3-2 vote was not approved by the Planning Ccmmission and Council will make the final judgment with the ordinance before them. Staff recommends approval. Council discussed the problems that might be caused for police access to the property and the property's best use in that area being R-l PD). It was moved and seconded to approve Resolution No. 85-44, A RESOLUTION OF THE CITY COUNCIL OF TOE CITY OF BALDWIN PARK ORDERING THE VACATION OF A STREET EASEMENT ADJACENT TO 3702 MERGED AVENUE 85-V-l)". M/S/C: GIBSON/IZELL. There were no objections. Mayor White introduced the Public Hearing On the City's Proposed Annual Budget for the Fiscal Year 1985-86 and the use of Federal Revenue Sharing funds to be received by the City". City Manager Webb explained that this is the annual public hearing for the City's Budget and the use of Revenue Sharing Funds. At the Budget Study Session on June 6th the Council asked Staff to report back to the Council with alternatives for achieving three basic Public Safety objectives The alternatives were covered in detail in the financial review which has been submitted to the City Council. Mayor White declared the Public Hearing Open and invited those wishing to speak to come forward. Joan Wright, 3915 Grace, requested clarification on what the reconrnendations are and if the 5% utility user's tax is part of this. City Manager Webb explained that the three objectives identified by Staff were 1) To compensate Public Safety Employees at the median of the labor market; 2) Add police officers to the force and add one additional, around the clock, patrol unit; 3) Save sixteen 16) police officer positions funded by General Revenue Sharing and threatened by the loss of G.R.S. The three alternatives for providing the resources to achieve these alternatives are 1) reduce the non Public Safety expenditures to fund other programs; 2) deficit spend from reserves; 3) Increase or ijnpose taxes. City Manager Webb explained the proposed expenditures for FY 1985-86 and alternative to be considered by Council to achieve the objectives. He outlined the requirements to allow for a special tax and a utility users tax. The special tax would require a referendum with a two-thirds voter approval, amount to about $95 per parcel, take longer to impose, and residents of the City would bear the greatest burden. The utility users tax can be imposed quickly and easily, is elastic, the burden between residential and business ccnrrunity is balanced, and the cost would depend on a variety of assumptions if utilities are $100-$120 per month the yearly cost would be $60-$65). George Lewetag, 4145 Filhurst, asked about the exemptions in the utility tax, and if welfare recipients will get away without paying this also. He would like this before the voters. Mayor White declared the Public Hearing closed. City Manager Webb stated that the Budget needs to be balanced and Revenue Sharing should be held over until the July 3rd City Council Meeting. Mayor White Introduced the Public Hearing on The intent of the City Council to provide for the annual levy and collection of assessments for certain landscaping and lighting in an existing maintenance district", City Manager Webb explained that this item was continued from the previous meeting and should be continued to the July 3rd meeting because it is an issue that effects the budget. 00- LQAN WRIGHT NICK VERGOT GEORGE LEWETAG PUBLIC HEARING CIOSED REVENUE SHARING HELD OVER PUBLIC HEARING LANDSCAPING AND LIGHTING INTRODUCED ITEM CONTINUED TO JULY 3, 1985 i REPORTS OF OFFICERS, CCMQSSICNS OR COMMITTEES City Manager Webb stated that this is a two-year agree'nent between the City and Chamber of Connerce. It provides for the same level of service and funding to the Chamber and Business Association of about $120,000. Due to the success of the AB1693 District the City's contribution will be reduced by $4,000 each year for the next two years. It was moved and seconded to 1) approve the proposed 1985-86 program budget for the Citywide Business Prcrotion Area and 2) authorize the execution of a t^o-year Agreement with the Chamber of Ccrnnerce regarding the Chambers operations and administration of the district. City Manager Webb explained that the City has supported the Mid-Valley Cconunity Mental Health Council for several years The City's contribution is for $13,800. This is the same level of support that has been provided for seme years. It was moved and seconded to approve a contract with the Mid-Valley Corrrnunity Mental Health Council for FA 1985-86. M/S/C: KING/Mc-NEILL. There were no objections. Assistant to the City Manager Juleff explained that RTD will be implementing bus fare changes July 1, 1985. Fare subsidy programs are being implemented by other cities, with Proposition A Funds, on monthly passes for senior citizens, handicapped and students. The City will purchase the stamps/passes for these persons from the RTD for $7 and resell them for $4. The stamps/ passes should be available around July 25th for the month of August. In response to Councilman McNeill's question Ms. Juleff stated that the estimated expenditures for this program is about $6,500. Roy Test, 15115 Kenoak, spoke concerning the day time noise at All Star Auto Parts and Engine Dynamics. Salvadore Madrigal, spoke regarding the house he has cwned for thirteen years. He bought it with the garage closed and now he must deconvert the garage. He asked that this law be changed. Mayor White declared Oral Connunications closed.
