The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman McNeill. Councilman King led the Flag Salute. It was moved and seconded to approve Items No. 1, 3-7 and 9-10. M/S/C: KING/MCNEILL. There were no objections. Councilman McNeill congratulated the Council on being the first City, in the San Gabriel Valley to go on record as voting for the sanctions against apartheid and believing in the rights of humanity. He also requested that a general statement of the Council be that the City would divest itself of any financial dealings with any banks it deals with if they are doing business with South Africa. Councilman King asked that the signatures of all the Council be included on this resolution to show their participation, It was moved and seconded to approve Resolution No. 85-61, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK OPPOSING APARTHEID IN SOUTH AFRICA". There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS OR COMMITTEES Director of Administrative Services Halloway explained that two outstanding requests that were not considered at budget time have been submitted by the library and the We Tip organization. Councilman King recommended funding the We Tip organization because the library has more funds avail- able to it and because the work of We Tip does help to augment the police department. Council- man McNeill recommended that this be given more study WE TIP to see if it is possible for the City to have some ITEM control in the organization and to hold this item HELD-OVER over to the next Council meeting. Council also discussed funding two library projects and agreed that the county has a larger budget to draw from for this funding. It was suggested that some civic organizations might be able to assist in helping with the library projects. Director of Community Services Smith explained the PARKING problem that exists in the City relating to street RESTRIC- sweeping. The continuous parking of vehicles in TIONS AS streets makes it impossible to effectively sweep RELATED steets. He outlined several alternative approaches to TO STREET provide a solution to the present problem: A) Special SWEEPING Sweeps; B) Limited Target Area Posting Program; and STAFF C) Full City-wide Posting Programs. REPORT Staff recommended that a limited target area posting program be initiated and that the FY 1985-86 Budget be amended to add $2/500 to Cost Center 5022 Traffic Control) for the purchase of signing materials to implement this program. Councilman McNeill stated that he did not agree with the entire City being done at one time. He suggested that the street sweeping program be phased in by dividing the City into four sections and add problem cul-de-sac streets as necessary. He felt that proper notification by mail or posting would help people to cooperate and a regular schedule should be mantained. COUNCIL DISCUSSION Couincil discussed the possiblity of night sweeping by having a 4 a.m. to 6 a.m. no parking on all City streets. The problems relating to this such as; too many cars in families to allow them to move them from the street, the noise of sweeping disturbing people at night and there being less cars on the street in the day time which makes street sweeping easier at that time. Council further discussed the problems in the City with regard to abandoned vehicles, cars parked on lawns and the prolonged and ineffective procedure in trying to rid the City of these problems. Council requested that our ordinances be reviewed to see if there is a better way to control these ITEM kinds of problems. This item was returned to HELD-OVER staff for further review. Director of Community Services Smith explained that NOISE the existing noise ordinance has been reviewed with ORDINANCE the City Attorney. A recent court decision has STAFF validated noise ordinances of the type we have and REPORT is enforceable. To control or regulate construction related noise the most easily enforceable method is to regulate the hours of construction activity. The ordinance recommended for adoption would prohibit construction between 7 p.m. and 7 a.m. In response to Councilman King's question City Attorney Flandrick stated that, with respect to our present ordinance any unreasonable noise is if an officer is called to the scene and can hear the noise within 50 feet and it is offensive to him it is unreasonable. There were no objections. 00 UNFINISHED BUSINESS ORDINANCE NO. 904 APPROVED City Manager Webb stated that there was two issues that the Council had asked Staff to examine. The forced air unit space requirements and whether there were units of small enough capacity to handle the heating require- ments of efficiency units. Also, the space requirements for washers and dryers. The Planning Commission had voted to require more than the recommended nine square feet. Council discussed the replacement of the units for stacked washers and dryers, allowing builders to furnish stacked units, renters probably owning side by side units rather than stacked, and that central air be used in every case relating to force air units. It was moved and seconded to Amend Ordinance No. 902, AMENDING THE BALDWIN PARK ZONING CODE RELATING TO R-G AND R-3 ZONE REGULATIONS AZC-97)" as introduced, stricking the nine 9) square feet requirement on Exhibit B and inserting eighteen 18) square feet in its place. M/S/C: MCNEILL/KING. There were no objections. City Attorney Flandrick explained that this ordinance will be on the agenda at the next regular meeting, because an ordinance can not be adopted within five days of amendment. Councilman King stated that the ordinance being brought before Council has been done so at Council's request. He introduced Ordinance No. 905, An Ordinance of the City of Baldwin Park Amending Sections 17.56,100 and Sections 17.56.110 of the Balwdin Park Municipal Code Relating To Procedural Zoning Matters". City Attorney Flandrick explained that this Ordinance would have the effect, if adopted as an urgency measure, of inserting into the code a provision that would allow the City Couincil to appeal to itself any decision of the Planning Commission with reference to zoning variances or conditional use permits. It was moved and seconded to approve Ordinance No. 905. AN ORDINANCE OF THE CITY OF BALWDIN PARK AMENDING SECTIONS 17.56.100 AND SECTIONS 17.56.110 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO PROCEDURAL MATTERS". Urgency) M/S/C: I2ELL/MCNEILL. M/S/C: KING/MCNEILL. There were no objections. City Attorney Flandrick explained that there would be no public hearing required at this time. This matter can be set for a public hearing at the next regular meeting and will be a conventional appeal. 00- APPEAL PLANNING COMMISSION ACTION ZV-526 APPROVED APPEAL EXPLAINED NEW BUSINESS In response to Councilman Izell's question/ Director of Community Services Smith stated that code enforce- ment officers work staggered shifts in the summer* Councilman McNeill requested that Counciliaembers show their opposition and support with letters to the assembly and senate members regarding information given in the League of Cities Bulletin. He also re- quested that Irwindale be informed of the Council's desire that the proper safety measures be taken in developing the waste burning plant in their city. City Manager Webb explained that the concerns of the City have been discussed with Pacific Waste Management. He told of the contract problems P.W.M. has experienced and are still not resolved. Staff members are attend- ing the hearings and will keep Council informed. 00- Mayor White declared Oral Communications Open and invited those wishing to speak to come forward.
