The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Izell. Councilman McNeill led the Flag Salute. CONSENT CALENDAR 00- REPORTS OF OFFICERS, COMMISSIONS OR COMMITTEES Assistant to the City Manager Juleff explained the CATV previous cable television ordinance that is being STAFF repealed and the need for a new ordinance because of REPORT the technological developments in the cable communi- JULEFF cations field. She further explained the Federal Cable Communications Policy Act and the effect it will have upon the ordinance. She stated that the ordinance before the Council was prepared by the City Attorney and the City's cable television consultant Carl Pilnick and reviewed by United Cable representatives. The ordinance should be incorporated into the Municipal Code so that the City will be current within the cable communications field and in compliance with applicable federal legislation. Staff recommends adoption of the ordinance. Mayor White introduced Bill Cullen, President of United Cable Television and asked him to speak. Mr. Cullen stated that United Cable is very enthusiastic BILL about building the cable system in Baldwin Park. They CULLEN are hopeful that they can begin this early next year. Three concerns that United has with the ordinance that is before the Council have to do with 1) the requirement of maintaining the system as a state of the art system at all times; 2) the FCC specifications that has been adopted; and 3) the utility tax being assessed on cable television. In response to Mayor White's question City Attorney Flandrick stated that the concerns expressed by Mr. Cullen can be handled in negotiations. It was moved and seconded to approve Ordinance No. ORDINANCE 912, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY NO. 912 OF BALDWIN PARK, CALIFORNIA, AMENDING THE BALDWIN APPROVED PARK MUNICIPAL CODE RELATING TO FRANCHISES FOR CABLE TELEVISION SYSTEMS". M/S/C: IZELL/GIBSON. There were no objections. Director of Housing and Economic Development Hemer explained that the renovation of the Red Barn Building may be possible by submitting a grant application to the Office of Historic Preservation, California Department of Parks and Recreation. Matching funds would be required from the City if the application is approved. RENOVATION OF RED BARN STAFF REPORT HEMER If the application receives a favorable review, a staff report will be prepared for Council review and approval for the matching funds estimated to be required for FY 86-87. Staff recommends approval of the submission of the grant application. It was moved and seconded to approve Resolution No. 85-97, A RESOLUTION OF THE CITY OF BALDWIN PARK APPROVING THE APPLICATION AND THE PROJECT AGREEMENT FOR HISTORIC PRESERVATION GRANT FUNDS FOR THE RENOVATION OF THE RED BARN BUILDING PROJECT FROM THE CALIFORNIA PARK AND RECREATIONAL FACILITIES ACT OF 1984". M/S/C: IZELL/GIBSON. There were no objections. RESOLUTION NO. 85-97 APPROVED Director of Housing and Economic Development Hemer SALES & stated that the adoption of the proposed Ordinance USE TAX will establish a substitute 1% sales tax in the STAFF Puente-Merced Project in lieu of the City 1% sales REPORT tax. All sales tax revenues received by the Agency HEMER and not needed for project financing will be trans- ferred to the City. It was moved and seconded to approve Ordinance No. ORDINANCE 913, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY NO. 913 OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL APPROVED CODE WITH REFERENCE TO THE SALES AND USE TAX ORDINANCE TO PROVIDE CREDIT FOR PAYMENT OF SALES AND USE TAXES PAID TO THE BALDWIN PARK REDEVELOPMENT AGENCY". M/S/C: IZELL/GIBSON. There were no objections. UNFINISHED BUSINESS Councilman McNeill gave an update on the work of the WASTE-TO- Baldwin Park Citizens Against Waste-To-Energy Committee. ENERGY A special meeting will be held on October 30th in the COMMITTEE Baldwin Park High School gymnasium at 7:00 p.m. Special invitations have been sent and the committee expects representatives from many areas to be present. 00- PROCLAMATIONS Councilman Gibson read the proclamation on Sudden Infant Death Syndrome SIDS) and explained this disease and its impact in Los Angeles County. Hank Ramey, 14903 Alvine Lane, spoke regarding Ordinance No. 913, and if it affected the redevelop- ment area or the whole city. Dorothy Morris, City Librarian, announced that this would be the last city Council meeting she will attend. She is leaving Baldwin Park due to a promotion. She thanked the Council for all the help she has received. Manuel Almeida, State Department of Employment, explained the Job Fair" for veterans that will be held on November 6th and invited the City to participate. Mayor White declared Oral Communications closed.
