The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. Chief of Police Snowden led the Flag Salute, INVOCATION FLAG SALUTE ROLL CALL PRESENT: COUNCILMEN GIBSON, IZELL, KING, MCNEILL AND MAYOR WHITE ALSO PRESENT: City Manager Webb, City Attorney Flandrick, Acting Dir. of Admin. Serv. Estrella, Dir. of Comm. Serv. Smith, Dir. of Housing & Economic Dev. Hemer, Chief of Police Snowden, Fire Chief McCann, Police Captain Hoskins, City Planner Rangel, City Treasurer Montenegro, and Deputy City Clerk Cardenas 00- City Clerk Gair's absence was excused. ROLL CALL ABSENCE EXCUSED 00- Mayor White introduced the President of San Gabriel Valley Latino Peace Officers Association, Gilbert Trujillo and Investigator Andy Masino of the District Attorney, Bureau of Investigation. Gilbert Trujillo explained that the association holds fund raisers throughout the San Gabriel Valley community and that all proceeds are forwarded back to the community in the form of supporting young men and women seeking a career in law enforcement and also helps families of officers who are critically injured in the line of duty. PRESENTA- TION Mr. Trujillo also explained that Chief of Police Snowden and the Baldwin Park Police Department has extended their support to the association throughout the past years. To show their gratitude a Certificate of Appreciation" was presented to Chief of Police Snowden with special thanks to Larry Lear. Also presented was a check in the amount of $100.00 payable to the Baldwin Park Police Department to carry on with their activities, Mayor White thanked Mr. Trujillo and the Association. 00- Deputy City Clerk Cardenas presented the Consent Calendar; 1. There were no objections. 00- Mayor White introduced the Public Hearing on AZC-100, Continued from November 6, 1985), A City initiated request to consider an amendment to Chapter 17.48 of the Zoning Code of the City of Baldwin Park adding development standards for satellite dishes and solar panels". City Planner Rangel explained the development standards for satellite dishes and solar panels. A slide presentation was given showing illustrations of solar panels installed on several homes and the position and angles in which the solar panels must face. Mayor White declared the Public Hearing open on AZC-100 and invited those wishing to speak to come forward. There were none. Mayor White declared the public hearing closed. It was moved and seconded to approve Ordinance No. 916, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONING CODE AMENDMENT TO CHAPTER 17.48 APPLICANT: CITY OF BALDWIN PARK; CASE NO.: AZC-100). M/S/C: IZELL/KING. There were no objections. 00- CONSENT CALENDAR APPROVED PUBLIC HEARING AZC-100 INTRO- DUCED STAFF REPORT RANGEL PUBLIC HEARING OPEN PUBLIC HEARING CLOSED ORDINANCE NO. 916 APPROVED REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Captain Hoskins explained the licensing provisions regulating fortunetelling. He further explained the opportunity for fraud and trickery to be involved in fortunetelling activities and that reasonable provisions are necessary to regulate such activities to help prevent unwary persons from being victims of fraud and losing large sums of money. He recommended the following procedures to be taken: 1) Business License tax; 2) Applicant submits to background investigation conducted by the police department to include photograph and fingerprinting; 3) photograph of applicant on license and post on business premises. It was moved and seconded to approve Ordinance No. 917, AN ORDINANCE OF THE CITY COUNCIL AMENDING THE BALDWIN PARK MUNICIPAL CODE TO PROVIDE CERTAIN REGULATIONS APPLICABLE TO FORTUNETELLING". Director of Housing & Economic Development Hemer explained that at the direction of Council there is a need for the formation of an Advisory Committee composed of seven 7) members to the Sierra Vista Project Area. He read the suggested names of individuals listed in the Staff Report and recommended Council to consider those individuals. Director of Housing & Economic Development Hemer explained that in order to finance its obligation for the West Ramona Boulevard, Central Business District, and San Gabriel River Redevelopment Projects issuance of certain tax allocation notes and bonds are required and that the consent of the City Council is required prior to the actual issuance of such notes. Director of Housing & Economic Development Hemer requested Council to adopt individual resolutions for the issuance of notes and bonds. It was moved and seconded to approve Resolution No. 85-112, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE ISSUANCE BY THE BALDWIN PARK REDEVELOPMENT AGENCY WEST RAMONA BOULEVARD REDEVELOPMENT PROJECT 1985 TAX ALLOCATION BOND". M/S/C: KING/GIBSON. There were no objections. It was moved and seconded to approve Resolution No. 85-113, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE ISSUANCE BY THE BALDWIN PARK REDEVELOPMENT AGENCY CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT 1985 TAX ALLOCATION NOTES". It was moved and seconded to approve Resolution No. 85-114, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE ISSUANCE BY THE BALDWIN PARK REDEVELOPMENT AGENCY SAN GABRIEL RIVER REDEVELOP- MENT PROJECT 1985 TAX ALLOCATION REFUNDING NOTES". M/S/C: KING/MCNEILL. There were no objections. Director of Housing & Economic Development Hemer explained that on October 15, 1985, the bid opening for construction of properties at 14311 & 14317 Morgan Street, located on the Elderly Housing Project site, was held and bids were rejected. Thereafter, the Housing Authority was able to get an extension on the project and is now preparing to have the project rebid. He further explained that the city proposes to demolish the structures with funds previously allocated to the project to reduce the total development/ construction costs. And due to noncompetitive negotiations used to reach the awardable figure it is recommended that Council award the demolition contract. AREA COMMITTEE MEMBERS APPROVED ISSUANCE OF NOTES AND BONDS BY THE REDEVELOP- MENT AGENCY RESOLUTION NO. 85-112 APPROVED RESOLUTION NO. 85-113 APPROVED RESOLUTION NO. 85-114 APPROVED DEMOLITION WORK FOR ELDERLY HOUSING PROJECT It was moved and seconded to award the demolition contract to Excavating, Inc. for $3600 and authorize the City Manager to execute all appropiate and necessary documents, M/S/C: GIBSON/IZELL. There were no objections. 00- UNFINISHED BUSINESS Councilman King referred to a letter received from Dorothy Martin, 3128 Patritti, about her carport that was built over thirty years ago. Mrs. Martin asked why she is required to remove five feet from her carport when other residents on Patritti/ which have similiar carports, have not been asked to do so. Council further discussed this type of situation that exists throughout the City. It was suggested that Code Enforcement obtain more tangible evidence regard- ing carports before some citizens are notified and their cases are submitted to the District Attorney. Aerial photos of the city was also mentioned as a possibility for identifying some code violations. NEW BUSINESS Councilman McNeill thanked the citizens. Council and also all who helped in fighting pollution in the San Gabriel Valley and explained how the people of the community worked and tried their best to fight pollution. The people took the time to gather signatures and presented the signatures to the California Energy Commission C.E.C,). Councilman McNeill also wanted to let C.E.C. know that the people in the San Gabriel Valley are not satisfied with the procedures taken to locate an area for the Waste-to-Energy Plant in this valley. Councilman King stated that he visited the Waste- To-Energy Plant. Councilman McNeill stated that December llth he will be in Seattle, Washington attending the National League of Cities conference and will be voting on an important Resolution that will affect all cities in the United States, He asked to have Council's input and suggestions before going to the meeting. Councilmen McNeill referred to a resolution presented to the Council in support of a comprehensive test ban treaty. He felt that it is in the best interest of the City and that there is a representative here to speak on behalf of this issue. Reverend Bill Ruth, 1383 Calais, representative of the East San Gabriel Valley Nuclear Freeze Committee, spoke regarding the right to ban testing of all nuclear weapons and asked Council to adopt a resolution asking President Reagan to seek a test ban treaty. Mrs. Garrison, resident of Baldwin Park, read the proposed resolution that the East San Gabriel Valley Nuclear Weapons Freeze is asking Council to adopt. Council discussed the resolution presented and felt there was no need to adopt the proposed resolution. That world affairs are best left to the Soviet General Secretary and the President of the United States to discuss. Councilman Gibson explained that he could not support the passage of this resolution to ban nuclear testing because of his many years involved in the United States Air Force. Hank Ramey, 14903 Alvine, spoke of the testing of the nuclear weapons. He also stated that he and the recall committee are now in the process of gathering signatures for the recall of the Utility Tax. Mayor White declared Oral Communications closed. ORAL COMMUNICA- TIONS OPEN RESIDENT HANK RAMEY ORAL COMMUNICA- TIONS CLOSED 00- It was moved and seconded to include in the minutes that Mayor White introduced the new Battalion Chief, Lyie Burkhart. Council congratulated Lyie Burkhart in his new position and thanked him for serving as the City of Baldwin Park's Fire Chief. M/S/C: MCNEILL/GIBSON. There were no objections. Lyie Burkhart thanked the Council for their support and stated he served seven wonderful years in Baldwin Park.
