The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. Mrs. Carter, resident of the City, led the Flag Salute. M/S/C: KING/ MCNEILL. There were no objections. 00- ITEM NO. 7 APROVED CIP NO. 238 TO RE ADVERTISE PUBLIC HEARING Mayor pro tern Izell introduced the Public Hearing on 85-V-8, The intent of the City Council to vacate a portion of Palm Avenue adjacent to 14201 14249 Palm Avenue". Acting Director of Community Services Rangel explained that the Council at their December 4, 1985 meeting scheduled January 6, 1986 for the public hearing of this matter. Staff has been advised by the City Attorney that the Resolution ordering the proposed street vacation should not be adopted at this time. The Redevelopment Agency has not as yet taken possession of all properties adjacent to the proposed street vacation and until acquisition has been completed public street access must be maintained. It is recommended that the Public Hearing be opened and testimony taken and after the conclusion of the public hearing. Council postpone the adoption of the Resolution. The Resolution will be returned for Council action as a consent calendar item. Mayor pro tern Izell declared the Public Hearing open on 85-V-8 and invited those wishing to speak to come forward. Mary Wiseman, 14259 E. Palm, spoke concerning the noise problem by her home caused by construction. The work begins at 6 a.m. and continues into the night weekdays, holidays and weekends. She asked for information on what could be done about this. At the request of Councilman King the City Attorney explained that if this noise is obtrusive the police can make the workers stop. Council further explained that the City does have a noise ordinance and that calls should continue to be made to the police so that this can be enforced. Walt Hannah/ West Covina, spoke concerning the notification for the public hearing being posted and not mailed to property owners. Council and Staff responded that notice of a public hearing is made in an adjudicated newspaper and notice to property owners can be made by posting or by mailings. Mayor pro tern Izell declared the Public Hearing closed. It was moved and seconded to postpone adoption of the Resolution vacating a portion of Palm Avenue 85-V-8) until the Redevelopment Agency takes title to all the adjacent properties. City Engineer Rait explained that the proposed ordinance revises the latest changes to the Subdivision Map Act and recodifies the City's exist- ing subdivision regulations. The substantive changes to the subdivision regulations deal with who the hearing and appeal bodies are and the future right of a subdivider to develop after approval of a tentative map. City Engineer Rait outlined the function of the Advisory Agency and how proposed divisions of properties will be processed prior to Planning Commission and City Council review. She also ex- plained the new 1986 State Law that will allow developers to complete residential projects even though zoning changes on development standards are revised. Councilman King asked what the time period would be for the Council to appeal a matter to itself. City Engineer Rait stated that twenty days would be the length of time. Mayor pro tern Izell declared the Public Hearing open on ASO-1 and invited those wishing to speak to come forward. There were none. Mayor pro tern Izell declared the Public Hearing closed. It was moved and seconded to approve Urgency Ordinance No. 919, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL CODE RELATING TO SUBDIVISION REGULATIONS". M/S/C: GIBSON/KING. There were no objections. It was moved and seconded to approve Ordinance No. 920, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL CODE RELATING TO SUBDIVISION REGULATIONS". M/S/C: MCNEILL/ KING. There were no objections. REPORTS OF OFFICERS, COMMISSIONS AND COMMITTES Acting Director of Community Services Rangel explained that the architectual design of a shelter building for Walnut Creek Nature Park and site review have been completed. The labor will be performed by the California Conservation Corps workers and funding is provided by grant monies from the State Recreation and Parks Roberti-Z'Berg program. It was moved and seconded to approve the concept design for the proposed Walnut Creek Nature Park Shelter Building. M/S/C: MCNEILL/GIBSON. There were no objections. Councilman McNeill requested that this item be held until the January 15th Council Meeting so that the City Attorney can review the agreement before Council votes. Councilman McNeill said that it was an honor to be installed in this position with the league because it is a pleasure to serve the City. He hopes we can all celebrate next year if he is elected as President Mayor pro tern Izell stated that he would like to have fees for permits waived for the Historical Society since they are paying the cost for expanding the old Chamber of Commerce building. Councilman McNeill asked for information on what all has to be done in regard to permits, Henry Littlejohn, President of the Historical Society and first appointed Mayor of Baldwin Park explained the addition they will be building onto the old building and some of the work that is being donated. He said that the Historical Society is continuing to raise money for this project and will pay for every- thing. They hope to have a nice representation in this old building. He requested that there be an agreement between the City and Historical Society so that they know they will have this for a number of years. City Manager Webb stated that a sub-lease agreement draft has been prepared regarding this. COUNCILMAN MCNEILL HISTORICAL SOCIETY PERMIT FEES HENRY LITTLEJOHN It was moved and seconded to permit and building fees for Historical Society. M/S/C: approve the waiving of the Baldwin Park MCNEILL/GIBSON. There were no objections. Councilman King said that he had the opportunity to speak with Supervisor Schabarum at the recent league meeting regarding the billboard on the freeway. He conveyed his personal opinion to the supervisor that the lack of dialogue with him had caused the City not to be aware of his feelings about billboards. Schabarum suggested that there be a meeting with Councilmembers and Staff. Councilman King requested that Staff arrange a time for such a meeting with the supervisor. Mayor pro tern Izell announced that Councilman Gibson had volunteered" to be the RTD Policy Committee Representative for Area D". Council concurred on this representation. 00- Mayor pro tern Izell declared Oral Communications Open and invited those wishing to speak to come forward. Roy Test, 15115 Kenoak, spoke regarding the change in zoning from Open Space to Industrial and the possibility of the owner beginning to build on the property. After it was explained to Mr. Test that the zoning variance is being held and won't be acted upon because the plans may not be in compliance, Mr. Test requested to be notified about this property's development. He also requested that sidewalks be built on Los Angeles Street between Maine Avenue and Baldwin Park Boulevard due to the hazard that is created for people because they have to walk in the street. Iray J. Auzenne, 4238 Benham, spoke concerning the IRAY J. difficulty he had in obtaining a building permit AUZENNE from the City. He stated that this process should not take so many trips to City Hall to complete. William Cutter, 3717 Ott Place, requested sidwalks WILLIAM on Los Angeles Street. CUTTER Mrs. Charles Schnabel, 14217 Los Angeles Street, MRS. spoke regarding the lack of sidewalks on Los Angeles CHARLES Street, the car accidents at the corner of Los SCHNABEL Angeles Street and Baldwin Park Boulevard and the problems she has with access to her own home by others due to the 300' of red curb in front of her house. She requested that this amount of red curb be reduced. Council requested that this be looked into and returned to Council with a report that includes a diagram. Mayor pro tern Izell declared Oral Communications closed. CLOSED Councilmembers commented regarding appointing or electing COUNCIL the City Clerk and that this issue was on the ballot COMMENTS eight years ago and the people voted to keep the position elected. Councilmembers expressed their feelings that they preferred the clerk to be a resident of the City, be elected, and also felt that staff members are being trained, who are residents of City also, so that they are capable of continuing the clerk's work. Council also commented on the sidewalk problems within the City and that some of these problems exist in the older sections of town because of narrow streets and the requirement for sidewalks as houses were built was not required. Council also requested that signs setting in the middle of sidewalks be looked into at two addresses and the parking problems at Shakey's be checked into. 00- It was moved and seconded to adjourn the adjourned MEETING regular meeting of the City Council at 8;31 p.m. ADJOURNED M/S/C: MCNEILL/GIBSON.
