The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. Councilman King led the Flag Salute. INVOCATION FLAG SALUTE ROLL CALL PRESENT: ALSO PRESENT: COUNCILMEN GIBSON, IZELL, ROLL CALL KING, MCNEILL AND MAYOR WHITE City Manager Webb, City Attorney Flandrick, Dir. of Admin. Serv. Yelton, Dir. of Comm. Serv. Smith, Dir. of Housing & Economic Development Hemer, Chief of Police Snowden, Fire Chief McCann, City Treasurer Montenegro, and City Clerk Gair 00- Mayor White introduced the new Director of Administrative Services/ Mike Yelton, and welcomed him to the City. city Manager Webb gave a summary of Mr. Yelton*s background and experience and stated that he would be with the City beginning January 27th. City Clerk Gair introduced the new reporter from the Tribune, Mark Adams, who will be covering the news in Baldwin Park. 00- INTRO- DUCTION MARK ADAMS City Clerk Gair presented the Consent Calendar: CONSENT CALENDAR 1. 2. 3. Approve Budget Amendment Insurance Coverage City Property It was moved and seconded to approve Consent Calendar Items No. 2-7 as presented. M/S/C: MCNEILL/KING. There were no objections. City Attorney Flandrick explained that the word tract" had been deleted from Ordinance No. 920 as previously included. Councilman McNeill and King amended their motions to include the correction to Ordinance No. 920 00- CONSENT CALENDAR ITEMS NO. 2-7 APPROVED CITY ATTORNEY RE: ORDINANCE NO. 920 MOTION AMENDED REPORTS OF OFFICERS, COMMISSIONS OR COMMITTEES Director of Community Services Smith explained that Webster's Refuse Disposal is requesting two types of adjustments in rates for residential trash pickups. One adjustment, provided for in the agreement with the City, is for a cost of living increase. The second adjustment is a special rate adjustment due to the increase in dumping fees for Websters. The cost of living would increase their fee 4.4% according to the Consumer Price Index CPI). Making the CPI Adjustment 17 multiple units) and 27 single family). The special adjustment for dump fees would increase fees 16 for 1985 and 07 for 1986. Director of Community Services Smith outlined the extra services that are received from Websters that are not included in most other cities' service contract. Staff recommended approval of the rate adjustments for Webster's Refuse Disposal. Councilman Gibson recommended that the Council action tonight allow the CPI Adjustment to go into effect and asks Websters to reapproach Council when dump fees are known. This would allow the contract to proceed without the special rate adjustment and would deny the request of Webster's regarding the dump fees. Councilman McNeill requested that there be an assurance requested from Webster's that they will not use the Waste-to-Energy plants to dump their trash. City Attorney Flandrick stated that this was a fair request and not unreasonable. Council has the right of approval regarding this. In response to Council's questions City Attorney Flandrick said that the effect of Council denying the special rate adjustment is that this is a refusal without prejudice, for filing at a later date, which in effect can come back to be negotiated. RATE DENIED COST OF LIVING INCREASE IN EFFECT Director of Housing & Economic Development Hemer explained that City Attorney Flandrick has reviewed the document that was presented at the January 6th Council Meeting and Council approval is required. City Attorney Flandrick stated that he has reviewed in depth the agreement and he has no problem with any of its provisions. Mr. Hemer's staff report correctly states the summaries and analysis of the agreement. Council will have the opportunity to review each additional contract that will be coming before them. This agreement is the form of agreement the Federal Government insists upon in UDAG matters. He has reviewed it in those areas where we do have an opportunity to make changes in terms of the amounts and time and they have been worked out as Mr. Hemer has indicated in his memorandum. There were no objections. 00- UNIFINISHED BUSINESS UDAG AGREEMENT PUENTE- MERCED AGREEMENT APPROVED In response to Councilman McNeill's question City Manager Webb stated that the City was notified that there was going to be a hearing on West Covina's moratorium concerning the old Stan Marr property, we were not notified to be present. Since things were going smoothly the City did not think it was necessary to attend. The West Covina Chamber of Commerce has requested a two week delay in their Council making a decision on the moratorium in that area. Mayor White explained that tonight's Council meeting will be adjourned to a joint meeting with West Covina's City Council. Director of Community Services Smith outlined the work that has progressed since the adoption of the moratorium area. He explained that an extension to the moratorium will be necessary, but it is contemplated that the moratorium could be lifted well before the one year statutory limitation. This will be brought before Council February 3rd for extension of the moratorium. It was moved and seconded to receive and file the Status Report on the Sierra Vista Redevelopment Project Area Moratorium. M/S/C: GIBSON/IZELL. Mayor White stated that the City doesn't anticipate problems. This is why the two Councils are meeting next week. Mayor White declared Oral Communications Closed. It was moved and seconded to adjourn the regular meeting of the City Council at 7:35 p.m. to an adjourned joint meeting with the West Covina City Council on Wednesday, January 22nd at 6:30 p.m. at Howard Johnson's Restaurant, 14622 Dalewood Avenue, Baldwin Park.
