The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. ROLL CALL PRESENT: COUNCILMEN GIBSON, IZELL, KING, MCNEILL AND MAYOR WHITE ALSO PRESENT: City Manager Webb, City Attorney Flandrick, Dir. of Admin. Serv. Yelton, and City Clerk Gair 00- Mayor White explained that the purpose of the adjourned meeting is to allow any person wishing to express their point of view regarding the Utility Tax to have that opportunity. He stated the rules that would be followed during the meet- ing and asked that there be no outbursts from the audience as someone is speaking. He explained the shortage of funding that the City had anticipated and the need to increase police salaries and police personnel. The Utility Tax was initiated to cover these costs. Public hear- ings were held and properly noticed in the news- paper so that public input could be received. Mayor White also explained the petitions that had been circulated in the City. The initiative peti- tion was the only petition to have the necessary number of verified signatures. The City Attorney has given a legal opinion that the petition does not qualify for submission to the electorate. Mayor White outlined the alternatives that Council can consider such as 1) submitting the petition to the State Legislative Counsel; 2) holding an election that could be declared invalid; or 3) allow proponets to go to court. Myor White requested that those wishing to speak to this issue come forward and if anyone represents a large number of people that one person speak for for that group. Those speaking in opposition to the Utility Tax because it was unfair, it violated the intent of proposition 13, it should have been a flat tax, it should not be paid into the General Fund, the people were not allowed to vote on it, the public hearings were not advertised enough and 5% being too high were: Hank Ramey, 14903 Alvine Lane. Priscilla Popick/ 13946 Sandstone Street Maureen Popick/ 13946 Sandstone Street. Mrs. Schnabel, 14127 Los Angeles. SPEAKING IN FAVOR OF UTILITY TAX LEORA RICHARD PRISCILLA POPICK MAUREEN POPICK MRS. SCHANBEL 00- Chief of Police Snowden gave a slide presentation contrasting the manpower of other police depart- ments with the Baldwin Park Police Department and the crime rates and officers per 1/000 population. He also explained the difficulties in recruiting officers to the City because of the greater work load with lesser pay. It was also explained that other cities can afford to pay a higher salary to their officers because of a higher tax base. Baldwin Park is trying to increase its tax base through the redevelopment projects that are underway or projected. 00- Councilmembers thanked the people for coining and expressing their views and offering suggestions regarding the Utility Tax. They commented that they would liked to have had this kind of interest and input when the hearings were held before the tax was adopted. They explained the consideration that was given by each of the Council prior to adopting the Utility Tax and the need for more police officers and comparable pay for the police. Councilmembers expressed the concern that they have for the safety and welfare of the community and their desire to end the Utility Tax as soon as it is economically feasible. They also commented on the flat rate that was suggested/ the addition of a sunset clause and sending the opinion of the City Attorney to the Legislative Counsel for a second opinion on the validity of the initiative petition. 00- Mayor White stated that since there seems to be a serious disagreement with the opinion of the City Attorney that the initiative petition is invalid. He then asked Mr. Herschel Keyser if he and the group he represents would be agreeable to sending the initiative petition and the opinion of the City Attorney to the State Legislative Counsel in Sacramento for a second opinion as to the validity of the petition. Mr. Keyser stated that he would like to contact his attorney before agreeing to the second opinion. He stated that he would be able to come to the Council meeting on April 2nd and let the Council know what his answer is.
