HomeMy WebLinkAbout1986 04 02 CC MIN1986 04 02 CC MIN;¢f4ÂnREGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CITY HALL, 14403 EAST PACIFIC AVENUE, WEDNESDAY, APRIL 2, 1986 AT 7:00 P.M. The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. Councilman McNeill led the Flag salute. INVOCATION FLAG SALUTE ROLL CALL PRESENT: COUNCILMEN GIBSON, IZELL, KING, MCNEILL AND MAYOR WHITE ALSO PRESENT: City Manager Webb, City Attorney Flandrick, Dir. of Admin. Serv. Yelton, Dir. of Comm. Serv. Smith, Dir. of Housing & Economic Development Hemer, Chief of Police Snowden, City Librarian Kersley, and City Clerk Gair 00- City Treasurer Montenegro's absence was excused. ROLL CALL ABSENCE EXCUSED 00- Mayor White read a proclamation declaring April 6-18 as National Library Week" and presented it to City Librarian Kersley. She thanked the Council and stated that the proclamation would be on display in the library. Mayor White read a proclamation in honor of the General Federation of Womans' Clubs and declared April 20-26 as GFWC Week". Julia McNeill, Presi- dent of the Baldwin Park Woman's Club accepted the proclamation and introduced Woman's Club members Jordan, Glass, Rothmailer, Agabasian, Harper, Test, Izell, White, Richards and Kersley. 00- City Clerk Gair presented the Consent Calendar: 1. Approve Minutes of February 5, 1986 and March 19, 1986 2. Deny Claim Against the City Sophia Lin 5. Waive Further Reading and Adopt RESOLUTION NO. 86-14 APPROVING THE PROCEDURE FOR THE ENGAGEMENT OF CONSULTANTS FOR FEDERAL AID REIMBURSEMENT PROJECTS 6. Approve City/County Agreement for the Exchange of City Fau Funds for County Gas Tax Funds for the Delta Redevelopment Project It was moved and seconded to approve the Consent Calendar as presented. M/S/C: KING/GIBSON. There were no objections. 00- UNFINISHED BUSINESS CONSENT CALENDAR APPROVED Mayor White explained that at the adjourned meeting of the City Council on March 31, 1986 City Attorney Flandrick had given his legal opinion to the Council regarding the validity of a purported initiative peti- tion that was examined for signature verification by the Los Angeles County Registrar-Recorder. It was the opinion of the City Attorney that the petition was invalid as a purported initiative measure, and may be disregarded by the City Council. Mayor White further explained that the City Council had agreed to seek a second opinion regarding the validity of the petition from the Legislative Counsel in Sacramento if that was agreeable with the proponets of the petition. Mr. Herschel Keyser, spokesman for the proponets, had stated that he would return tonight with an opinion from his attorney as to this being acceptable or not. Mr. Keyser read a prepared statement to the Council regarding the unfairness of the Utility Tax and the need for it to be repealed. He stated that he had contacted his attorney and he would agree to letting the Legislative Counsel give an opinion regarding the validity of the petition. He said they he will accept the opinion of the Legislative Counsel only if it is in writing. It was moved and seconded to submit the question of the validity of the purported initiative petition to the Legislative Counsel and to request that it be expeditiously examined. M/S/C: IZELL/GIBSON. There were no objections. 00- Mayor White declared Oral Communications open and invited those wishing to speak to come forward. There were none. Mayor White declared Oral Communications closed. 00- It was moved and seconded to adjourn the regular meeting at 7:17. M/S/C/: KING/MCNEILL. There were no objections.
