The City Council of the City of Baldwin Park met in adjourned regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. Councilman McNeill led the Flag Salute. Smith, Director of Housing & Economic Development Hemer, City Planner Rangle, and City Clerk Gair 00- City Treasurer Montenegro's Absence was excused. 00- PUBLIC HEARING ABSENCE EXCUSED Mayor White stated that this is an adjourned hearing from April 16, 1986 and that the issues considered at that meeting and continued to this meeting include: Certification of the draft environmental impact report for the Sierra Vista Redevelopment Plan and related general plan amendments, zone changes and amendments to the zoning code. The following items relate specifically to sub- areas 2 and 3 of the Sierra Vista Redevelopment Pro- ject: Amendments to the General Plan AGP-72, Zone Changes, Z-457, Amendments to the Zoning Code AZC-102, He explained that the hearing was continued to allow responses to late comments relative to the environ- mental impact report EIR). The consultant has responded to these comments. City Planner Rangel stated that the final EIR includes changes made in response to comments by several res- ponsible agencies. Although many changes have been made to the document, the primary thrust of the changes has been made to expand and clarify the scope of the project to include the full 853 acres. Key additions to the document include an expanded analysis of projected population and housing impacts. It should be noted that the draft EIR assumes a worse case scenario, i.e. full development at maximum poten- tial and that all new employees resulting from the proposed development will live in the City and send their children to local schools. Although projected population in- creases are significant, they fall within existing growth projections for the City and within the estimated capacity for additional housing units in the General Plan. Staff and the Planning Commission recommend that the Council 1) Approve the resolution certifying the environmental impact report; 2) Adopt an ordinance approving zone change case Z-457; 3) Adopt an ordi- nance approving amendments to the Zoning Code AZC-102 and 4) Defer action on a resolution approving General Plan amendment AGP-72 until June 4, 1986 or until all the general plan amendments can be approved. In response to Mayor White's question City Clerk Gair stated that there were no written communications relating to subareas 2 and 3. Mayor White explained that the Council has been involved in a lot of redevelopment action and no one has been removed from their home without an agreement. A redevelopment project area is being recommended that is not fixed. Council can make adjustments. He further explained that it is important to mention that this plan will take place over a thirty-year period. Mayor White stated that the continued Public Hearing was open and invited those wishing to speak to come forward. Alice Eiko, 13057 Bess Avenue, stated that she was alarmed at the ten acre requirement for new develop- ments. She has owned quite a bit of property since the 1940's and has paid taxes and kept the property up. She spoke concerning the difficulty in getting a loan to develop the property and trying to sell it. She suggested that the redevelopment be done in areas and not so much at one time. Joseph Battaglia/ 101 N. Orange, West Covina/ stated that he was not sure that the properties he is concerned about is being discussed and he will come back if they are not. The first property is at 12744 Bess Avenue adjacent to Sierra Vista High School. If this is rezoned to any of the proposed zones the size of the parcel would need to be larger than what he owns in order to develop it. This would require assem- bling other properties to be able to develop and this would create a hardship. He would also not like to see land lying fallow for 1-30 years. Mr. Battaglia also spoke regarding property on Amar, that is presently in escrow, that is scheduled to remain R3. He requested that if the Council and the CRA have no intention of rezoning this that the moratorium be removed from those four parcels on Amar as soon as possible. He was not concerned with this going to the CRA area, because it did not preclude developing it to its highest use. Council is going forward as fast as they can and they realize the incon- venience that the moratorium has caused some. It is true that certain standards will be required for develop- ment and developers may have to assemble properties and the CRA may help assemble properties. The Council would like to work with Mr, Battaglia because they know his work. Hank Ramey, 14903 Alvine Lane, spoke regarding the residents of the redevelopment area needing to unite, because he felt there was no real effort to stop this plan/ no one is listening and it may be too late unless someone stands up. He also stated that he was against the General Plan amendment in all areas pro- posed and spoke about rumors regarding a recall of some of the Council. Joe Perez/ 14730 Clark, stated that he will put all his efforts into saving his home, because he can't start over again. He has worked too hard to have his house. Mayor White stated that the Council will do every- thing they can do to make sure Mr. Perez is happy with the results. Clemente Tarin, 13146 Shaver, stated that his street is not included in the project, but by the time every- thing is done he will be sandwiched between nothing but commercial. He said that no one will want to buy or lend money for houses in his area. There are old houses in this area that are owned by older people that cannot afford to buy another house because they are retired or are planning to retire soon. He also felt that commercial buildings are going to set empty just like they are in the City of Industry. Ralph Baca, 14740 Clark, said he does not want his property rezoned and asked that it be left as it is, because the streets are too narrow for what the City wants it for. Mayor White declared the Public Hearing closed. Councilman Izell stated that he would like to cor- rect some misinformation regarding 10 acres being needed to be assembled before someone can develop property. The requirement is 2 or 4 acres depend- ing on the zoning. Councilman Gibson stated that there also seems to be a mistaken impression that the Council is going to: 1) rezone everything; 2) kick everyone out of their houses; and 3) build condos, commercial and industrial all over the residential property. He explained that this was not the way this project is designed. There has been mis-matched areas all over the City that has caused commercial businesses not to be here to serve the interest of the community. He suggested that people look at the over-all rede- velopment plan which will give guidelines for thirty years or more and will rebuild the City and give the very best to everyone. This is not the way the plan is designed and he felt badly that people think that. Councilman Gibson also stated that many areas in the City are being built up and there are more and more people. These people will need services, need commercial things in areas. He encouraged the people to come to the numerous hearings on this plan and understand that this is not an overnight plan, but something for the betterment of everyone. Councilman McNeill said that he would like everyone to understand that the Council is here tonight to accept the Environmental Impact Report EIR). He asked that those who have questions regarding this project to contact the staff members and state their concerns in detail. Each person has different rea- sons for not liking or understanding the plan and it may be that theses differences can be worked out. He stated that no one on the Council is going to try to push anything down the throats of any of the citizens because Council wants the cooperation of everyone. He also pointed out that a City must keep progressing in order for it to attract people to move into it and that the Council is not doing anything that will decrease property values. Councilman King explained that this is the first step of the EIR and does not mean anything that significant He encouraged Mr. Battaglia to discuss his properties with staff because he felt that there was a good pos- sibility that he will be able to proceed in one of the areas. He also suggested that people come in look at the maps of the redevelopment areas and the area that they are in or own land so that they can see what concerns them. In response to Councilmans King request Director of Housing and Economic Development Hemer stated that the effect of the redevelopment on the periphial areas in the project would range from 1) City acquisition of property, which concerns people the most; to 2) the offering of loan programs for public improvements, improved utilities without acquisition of property and a broad range of possible activities. He further explained that there have been areas identified as representing 20% of the total project area for immediate" activity. Immediate" in redevelopment terms means 3-5 years and long term project means 5,10,15 to 30 years. Those activities could be provisions low-interest loans or single family home rehabilitation or quite a broad range of activities are possible. Director of Housing Hemer also stated that he would be happy to answer questions, because he would prefer to answer citizens questions than to have needless rumors fly around the community. Councilman King further stated that there is nothing in concrete at this time regarding the project and he wants everyone to be fully aware of their rights concerning these areas. He also explained that the Council wants to eliminate the concerns of the people and to listen to everyone. City Planner Rangle responded to Councilamn King that tonight's action would not effect the school district. It is just to certify the EIR document and the associ- ted zone changes. Mayor White stated to Mrs. Eiko that he found it inter- ting that her land had been sitting for forty years and he hoped that her chances will be improved for either improving or selling her land through the action that Council takes. He also explained that when an area is included in a redevelopment project that does not mean that the City is going to do anything to a house at all. All it means is that tax increment funds can be used to acquire property, to improve pro- perty and to do those kind of things. If it is a blighted area, and the City wants to allow a big business to be built the City, as part of the deal, can require that developer to improve the blighted area for a couple of blocks away with sidewalks as a public ser- vice. He stated that it is the Council's plan to improve this City/ because they cannot be satisfied with what we have had for the last twenty years. The serious problems we have had will only get worse. He said that the redevelopment plan is an ambitious plan. It is for thirty years and it is intended to make everyone's property more valuable. He explained that to date no one has been forced from their homes due to redevelopment. A substantial move of homes that was made for one lady and a problem with a junk yard are the only situations that have arisen in the City's redevelopment projects thus far in helping people to want what is wanted for the City. He recommended that Council indicate at this time that they intend to amend the General Plan consistant with the zoning admendments, but that final action will not be taken until June after the Council has had other hearings. 00- DEFERRED ACTION ON GENERAL PLAN EXPLAINED BY CITY ATTORNEY REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Director of Community Services Smith explained the increase in motel development that cities are ex- periencing in Southern California. He outlined some of the problems that the City is experiencing when some of the motels are used as long term hous- ing and the loss of occupancy tax when this occurs. The definition of hotels and motels within the City zoning regulations are very similar and staff is recommending that this moratorium be applicable to hotels as well as motels. In response to Councilman Gibson*s question City Attorney Flandrick responded that this moratorium will be in effect for 45 days and if Council intends to extend it a public hearing would be re- quired. He also stated that this should not have any effect on the Puente-Merced project. It was moved and seconded to approve Ordinance NO. No. 928, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING A MORATORIUM ON THE CONSTRUCTION AND USE OF BUILDINGS FOR MOTEL OR HOTEL PURPOSES. URGENCY MEASURE)".
