Councilmen King expressed his concern regarding the fees that are being charged for the services of typists and word processor, and engineering tech- nicians when compared to the hourly fees paid to City personnel. He requested that this item be held over so that a better understanding and evalua- tion might be possible. Staff stated that there would not be a problem with a two week delay on this item. 00- CONSENT CALENDAR ITEMS NO. 1-8 & 10 APPROVED ITEM NO. 9 HELD OVER PUBLIC HEARINGS Mayor White introduced the Public Hearing on Z-461 & ZV-542, A request for zone change from CM, Commer- cial Manufacturing to CM 0), Commercial Manufacturing Outdoor Advertising Overlay and an appeal of the Planning Commission's decision to deny a zone variance/ on property located at 12911 E. Garvey; Applicant: Regency Outdoor Advertising Inc."; and Z-463 & ZV-548, A request for zone change from 01, Office Industrial to 01 0), Office Industrial Outdoor Advertising Overlay and an appeal of the Planning Commission's decision to deny a zone variance, on property located at 12911 E. Garvey; Applicant: Regency Outdoor Advertising Inc.". Both items were continued from October 1, 1986. City Planner Rangle explained that this application was for a zone change and zone variance to allow an outdoor advertising structure at 12911 E. Garvey Avenue and that the Outdoor Advertising Overlay Zone was created to give the City control over the size, height and placement of outdoor advertising structures. He also explained the location of the overlay zone in the City. The State has issued a permit to the applicant for an outdoor advertising structure on the property in accordance with Title 4 of the California Administrative Code. The permit was issued because the site in ques- tion is not a landscaped segment of the freeway, however the issuance of the permit does not preempt the City from enforcing its General Plan or Zoning Code. Billboards in this area could detract from the visual appearance of the freeway and development could be deterred. He outlined the requests of the applicant for a zone change and zone variance and recommended that the Council adopt the findings of fact and deny the applications. Mayor White declared the Public Hearing open on Z-461 and ZV-542 and invited those wishing to speak to come forward. David K. Hayward, 8820 Sunset Blvd., Los Angeles, representing Regency Outdoor Advertising, thanked Council for postponing this hearing until tonight. He stated that he would like to point out that the number of signs that could conceivably go within the City of Baldwin Park / along the free- way, is different than what has been projected in the staff report because of freeway landscaping, state laws, and the state laws pertaining to dis- tance between signs on the freeways, etc. So that the freeway tabs or tags would not be granted by the state, so, therefore, the number of signs could not go in there as mentioned in the staff report. He requested that it be verbally entered into the record that, Regency Outdoor Advertising feels that they are entitled to the same rights and consider- ations that were granted to one of the competitors, Foster & Kleiser, in locating two signs within the City. An administrative act and a contract entered into with the Redevelopment Agency and Regency would be willing to remove any signs that might interfere with the development of the redevelopment area, should such an action be necessary at the appropriate time". He also requested that the record reflect, the entering into the proceedings here this evening the communication addressed to the Chairman and the members of the Planning Commission, dated July 25th, signed and submitted by the firm of Nath, Marsh, Jones and Doran, representing Regency Outdoor Adver- tising. I wish to be assured that the written commu- nication from the law firm is a matter of record, has been read by the Council and that they are fully aware of all the facts put forth as perceived by the attorney". City Attorney Flandrick stated that there was no problem with this and asked if Mr. Hayward was referring to the memorandum dated July 25, 1986. Mr. Hayward responded that that was correct. City Attorney Flandrick further stated that this memo- randum) is in the City's file and it should be noted that the City Council is obviously aware of the circumstances that are related to the Foster & Kleiser matter, should also be aware that, that license agreement has expired and steps are now being taken to remove the offending sign. Linda Millard, 13056 Amar Road, requested that the bill- board be denied, because the residents in the area do not want it. PUBLIC HEARING Z-461 & ZV-542 OPEN DAVID K. In response to Councilman King's question City Planner Rangle stated that the basis for a permit being issued for this site was that it was not designated as land- scaped and that Cal Trans has no plans to designate it as such or to delete any areas. Councilman King expressed his concern that there needs be a certain amount of landscaping in that area that would coincide with the development there. He requested that a strong message be sent to Cal Trans with respect to the development that is expected in that area and in cleaning up that corridor. It was moved and seconded to approve Resolution No. 86-102, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING A REQUEST FOR ZONE VARIANCES APPLICANT: REGENCY OUTSOOR ADVERTISING INC.? LOCATION: 12737 E. GARVEY AVENUE; CASE NO. ZV-458)". 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Director of Community Services Smith stated that in regard to the William Saltzman case no permits or inspections have been requested for plumbing or electrical work. Staff recommends that the units with remaining violations be red-tagged. This will result in those units having to be vacated until permits are obtained. It was moved and seconded to direct Staff to red-tag" the five units with remaining interior violations at 14327, 14329, 12331, 14335 and 14335 1/2 East Garvey Avenue. M/S/C: IZELL/GIBSON. There were no objections. City Attorney Flandrick recommended that this item be placed on the next Council Agenda. These facilities need to be ready for the 1987 summer swimming season for Parks and Recreation. He further explained that it was necessary that the architect be familiar with the design of the pool facilities and the requirements of the State Office of Archi- tecture and Construction since this building is located on school property. The firm of Kistner, Wright and Wright Architects meets these require- ments and is highly recommended by the school dis- trict. It was moved and seconded to approve an agreement with the firm of Kistner, Wright and Wright for the the Sierra Vista High School swimming pool changing room building. M/S/C: GIBSON/KING. There were no objections. Director of Administrative Services Yelton stated that a study relating to the Finance Division has cited several serious deficiencies. It was recom- mended that the City undertake the preparation of a policy and procedure manual to improve these deficiences, A proposal has been submitted by McGladrey Hendrickson & Pullen to assist the Finance Division in the preparation of the manual. Funding for this was provided in the adopted budget. It was moved and seconded to approve a contract with McGladrey Hendrickson & Pullen in the amount of $21,000 for the preparation of a policy and proce- dures manual and authorize the city Manager to execute the contract. Director of Community Services Smith explained that notification has been received relating a potential safety hazard at the southeast corner of the inter- section of Olive Street and Walnut Street. He out- lined the problems with parked vehicles, children walking in the streets and the need for a sidewalk. It was moved and seconded to direct Community Services to construct a sidewalk on the walnut Street frontage of 13656 Olive Street and to construct a sidewalk across the property to the south if voluntary dedica- tion can be obtained. M/S/C: IZELL/KING. There were no objections. NEW BUSINESS Councilman Izell explained the problem that exists in front of the post office with people receiving tickets from the police for jaywalking. There is no convenient crosswalk in the area in front of the post office and he requested that something be done regarding this. Council discussed this with the Staff and the Chief of Police. Council requested that Staff look into this situation a report back at the next Council meeting. Councilman King thanked all the people who worked on behalf of Measure F, because it was through their work that the measure passed. He also stated that their efforts against CRA should be pursued in the Legislature so that there is an equal opportunity for all to compete with other cities for private enterprise. Council also discussed the passage of Propostition 62 and its effect on the City's Utility Tax. Council directed Staff to conduct a study on this and to come back with a recommendation to the Council. 00- PROP 62 PASSAGE STUDY REQUESTED ORAL COMMUNICATIONS Mayor White declared Oral Communications open and invited those wishing to speak to come forward. Laurette H. Layte, 13824 Maseline, spoke regarding the petition submitted that requested the sidewalk at Olive Street and Walnut Street. Bess Jenkins, 13056 Amar Road, spoke regarding the use of the swimming pools at the high schools and the people not receiving timely notification of the change of days for trash pickup. Justina Ramirez, 4924 Wimmer, spoke regarding the pools being available for use all year, the speed limit on Maine and the difficulty in crossing the street on Maine. Sandra Kersley, former City Librarian, introduced the new City Librarian, Dolores Pedro and gave a brief description of her background and qualifi- tions.
