The Flag Salute was led by Councilman King. INVOCATION FLAG SALUTE ROLL CALL PRESENT: ALSO PRESENT: COUNCILMEN IZELL, KING, ROLL CALL AND MAYOR WHITE City Manager Webb, City Attorney Flandrick, Dir. of Admin. Services Yelton, Dir. of Community Serv. Smith, Dir. of Housing & Economic Development Hemer, Chief of Police Hoskin, City Planner Rangle, City Treasurer Montenegro, and City Clerk Gair 00- The absence of Councilman Gibson was excused. ABSENCE EXCUSED 00- City Clerk Gair gave the Oath of Office to Police Officers Craig Taylor and James Kolbach after an introduction about their backgrounds and quali- fications, given by Chief Hoskin. Mayor White read and presented a Resolution of Commendation to John Glyn for his service to the City and to civic organizations. Mr. Glyn, former President of the Chamber of Commerce, thanked the council and stated that he wished he were staying in the area to continue his envolvement. Mayor White presented Councilman King with a twenty year pin for his service to the City as a Councilman and as a Commissioner. Councilman King commented on those years of service and expressed his appreciation for being allowed to serve. 00- City Clerk Gair presented the Consent Calendar: 1. CALENDAR There were no objections* APPROVED 00- PUBLIC HEARINGS Mayor White introduced the Public Hearing on/ A request for a zone change from R-l Single Family Residential Planned Development Overlay Zone), approval of a Development Plan for a 38 unit single family planned development and approval of a tentative tract map for a 39 lot subdivision, located at 12845, 12855 & 12867 E, Salisbury Street; Applicant: Alexander/ Catania". The use of the planned development process is appropriate for this property because of its size and configuration. Staff feels that the project will be an asset to both the neighborhood and community. Mayor White declared the Public Hearing Open on Z-464 and invited those wishing to speak to come forward. Tim Good, representing the architectural firm of Booth and Good, described the style of architecture and the village like atmosphere of the project. He offered to answer any questions that the Council might have. In response to Councilman King's question Mr. Good pointed out the common area, the fencing and the lot lines. Mayor White declared the Public Hearing Closed. Mayor White introduced the Public Hearing on, A City initiated request to consider an amendment to the General Plan Land Use Element of the City of Baldwin Park from Multiple Family Residential to Single Family Residential, and a zone change from R-3 High Density Residential) to R-l Single Family Residential), or other changes as the City Council deems necessary on approximately 29.4 acres of land/- Location: Amar/Judith; Applicant: City of Baldwin Park". Mayor White stated that it is recommended that this item be continued until the February 18th council meeting. Councilman King and Councilman Izell requested that the Planning Commission be requested to review this item for further information. They asked about the possibility of allowing lots built as R-3 to remain as legal non-conforming, what kind of developments ments might be built and the possibility of annual inspection fees and landscape maintenance. They also spoke regarding the need for good police protec- tion in that area and better management of units in the area so that commercial developments are more easily obtained. Council asked that it be made clear that this item is not being returned to the Planning Commission to override their decision, but just to request that they take another look at the area and that more information be given. Mayor White stated that the Public Hearing on AGP-74 & Z-462 would be continued to the council meeting of February 18th. 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Director of Community Services Smith explained the agreement that the City has with Webster's Refuse Disposal. Under the terms of this agreement Webster's is entitled to an annual rate adjustment, A cost of living increase is required to be made each year based on a Consumer Price Index CPI) comparison. Dumping fees or other cost changes are negotiated by both parties. He stated that the CPI for September 1985 through Sep- tember 1986 was 3.3%. This will result in a $ 21 per month increase for single family dwellings and a $ 13 per month increase for multiple units. He also explained the new dump fee increases and the financial impact this will have on Webster's. Staff is recommending that the cost of living increase be granted as requested and that Council consider the requested dump fee increase. In response to Councilmen's questions Director of Community Services Smith stated that it was cost- ing about $1 per household for the increases that Webster's is absorbing. Webster's rates compare fairly good with other communities especially since our contract provides for unlimited pick-up. Council discussed the rate increases and some felt that the cost of living increase should be granted at this time and that the added cost should be renegotiated on both sides. They also expressed some concern over the direction that rates seem to be headed. It was moved and seconded to approve Resolution No. 87-4, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO. 86-7 SETTING FEES AND CHARGES FOR ISSUANCE/ PROCESSING AND FILING OF VARIOUS CITY SERVICES, PERMITS AND LICENSES". M/S/C: KING/IZELL. There were no objections. City Engineering Rait stated that the Public Utilities Code authorizes the Los Angeles County Transportation Commission to establish local transportation zones where it can be determined that the RTD or municipal transit operator can- not otherwise provide adequate and responsive local transportation services in a cost effective manner." She explained the necessity of initiating a request for a Transportation Zone and outlined the procedures for implementing a transportation zone. Council adopted a resolution on July 3, 1985 approving the transportation zone concept. Super- visor Schabarum has now requested a resolution from the cities supporting the formation of a transporta- tion zone. A representative from Forsythe and Associates, the consultant working with the County on this project, was introduced by City Engineer Rait and a slide presentation was given regarding the proposed transportation zones. In response to Council questions the representative stated that the competitive bidding for the zones would not make it possible for one bidder to win all bids and cities would not be caught in a mono- poly. Infor- mation was requested from staff regarding the number of houses in the City that do not have sidewalks and the number that are owned by absentee landlords. Personnel Manager Cole stated that the City has always realized the importance of good management of potential risks and the need for more prudent management has been emphasized by the instability of the insurance market and the spiraling costs of all claim settlements. She explained the specific steps that should be taken to implement a comprehensive risk management program and recommended that the City Council adopt the Risk Management Policy Statement. It was moved and seconded to approve the Risk Management Policy Statement as presented. M/S/C: IZELL/KING. There were no objections. City Manager Webb explained the new amendments to the Ralph M. Brown Act that were signed into law last August. One of the new requirements is that the agendas for City Councils, boards, commissions and committees are to be posted in areas freely accessible to the public. Two areas are being designated for posting at City Hall; the display case by Council Chambers and the City Clerk's Office window on the second floor. It was moved and seconded to approve Resolution No. 87-7, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ESTABLISHING LOCATIONS FOR POSTING THE AGENDAS FOR MEETINGS HELD BY THE CITY". M/S/C: I2ELL/KING. There were no objections. City Attorney Flandrick stated that the death of Councilman McNeill requires that Council fill the vacancy either by appointment or by calling a special election. Two resolutions are before Council should they choose to call an election. It was moved and seconded that a Special Municipal Election be held to fill the vacancy created by the death of Councilman McNeill. M/S/C: IZELL/ KING. There were no objections. It was moved and seconded to approve Resolution NO. 87-7, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL ELECTION TO BE HELD ON TUESDAY, JULY 14, 1987 FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES". It was moved and seconded to approve Resolution NO. 87-8, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO RENDER SPECIFIED SERVICES TO SAID CITY RELATING TO THE CONDUCT OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, JULY 14, 1987. She presented a drawing of a flag that had been submitted and read the description of what the colors of the flag represented. Council discussed the flag for the City and recom- mended that this item be placed on the next agenda. 00- ORAL COMMUNICATIONS CITY FLAG Mayor White declared Oral Communications open and invited those wishing to speak on any subject to come forward.
