The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Izell. The Flag Salute was led by Councilman King. INVOCATION FLAG SALUTE ROLL CALL PRESENT: COUNCILMEN GIBSON, IZELL, ROLL CALL KING AND MAYOR WHITE City Manager Webb, ALSO PRESENT: City Attorney Flandrick, Dir. of Admin. Services Yelton, Dir. of Community Serv, Smith, Dir. of Housing & Economic Development Hemer, Chief of Police Hoskin, City Planner Rangle, and City Clerk Gair 00- The absence of City Treasurer Montenegro was ABSENCE excused. EXCUSED 00- City Clerk Gair gave the Oath of Office to Police OATHS OF Officer Dorothy Hoyt after an introduction and a OFFICE description about her background and qualifications POLICE was given by Chief of Police Hoskin. Note and File for Infromation Only Puente-Merced Environmental Impact Report PULLED FOR SEPARATE ACTION) Mayor White stated that he was recommending that relative to Item No. 8 that the City Council appeal the decision of the Planning Commission and call a meeting for February 20, 1987 to consider the matter and to hear any concerns that persons might have. It was moved and seconded to appeal the decision of the Planning Commission regarding this item and a meeting of the City Council be held on Friday, February 20, 1987. M/S/C: WHITE/KING. GO- MAYOR* S RECOMMEN- DATION APPEAL OF PLANNING COMMISSION & MEETING APPROVED ITEM NO. 8 APPROVED CONSENT CALENDAR ITEMS NO. 1-5 & 7 APPROVED PUBLIC HEARINGS Mayor White introduced the Public Hearing on the, San Gabriel River Redevelopment Project, with respect to the issuance by the Baldwin Park Redevelopment Agency of its Tax Allocation Bonds in the aggregate principal amount of not to exceed $10,000,000. The Bonds are proposed to be issued to realize savings in interest costs by refinanc- ing the Agency's short term San Gabriel River Redevelopment Project 1985 Tax Allocation Notes". Director of Housing And Economic Development Hemer explained that the Redevelopment Agency has evidenced its intention to refinance the San Gabriel River Redevelopment Project through the issuance of its Tax Allocation Bonds, The Bonds will refund in full the Agency's $6,000,000 San Gabriel River Redevelopment Project 1985 Tax Allocation Refunding Notes. He further explained that it is necessary that the City Council conduct a public hearing on the proposed financing in order to satisfy the federal tax requirements as amended under the Internal Revenue Code of 1986. It was moved and seconded to approve Resolution No. 87-14, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE REFINANCING OF A PORTION OF THE SAN GABRIEL RIVER REDEVELOPMENT PROJECT BY THE BALDWIN PARK REDEVELOPMENT AGENCY". Director of Housing and Economic Development Hemer explained that it is recommended that Council adopt a resolution finding that a substantial effort to meet the low and moderate income housing needs in the City is being made, which is more than equivi- lent to the funds which would otherwise be required to be set aside according to Section 33334.2 of the Health & Safety Code with respect to the San Gabriel River Redevelopment Project. Section 33334,2 requires that 20% of the tax alloca- tion from any redevelopment be set aside for low and moderate income family housing needs unless certain findings can be made. No need exists for such set aside because the existing programs exceed the bene- fit requirement of the code section. Therefore, the Agency is relieved of the obligation to provide additional tax increment proceeds to provide low and moderate income housing in the community. It was moved and seconded to approve Resolution No. 87-15, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING THAT A SUBSTANTIAL EFFORT TO MEET LOW AND MODERATE INCOME HOUSING NEEDS IN THE CITY OF BALDWIN PARK IS BEING MADE AND THIS EFFORT, INCLUDING THE OBLIGATION OF FEDERAL FUNDS FOR LOW AND MODERATE INCOME HOUSING IS EQUIVALENT IN IMPACT TO THE FUNDS OTHERWISE REQUIRED TO BE SET ASIDE PURSUANT TO SECTION 33334.2 OF THE CALIFORNIA HEALTH AND SAFETY CODE AND THAT CONSIDERATION HAS BEEN GIVEN TO INCREASED HOUSING REQUIREMENTS RESULT- ING FROM IMPLEMENTATION OF THE SAN GABRIEL RIVER REDEVELOPMENT". M/S/C: GIBSON/KING. There were no objections, 00- Mayor White declared Oral Communications open and invited those wishing to speak on any subject to come forward. There were none. There were no objections. The regular meeting of the City Council reconvened at 7:45 p.m. Roll Call remained the same.
