The City Council of the City of Baldwin Park met in an adjourned regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. The Flag Salute was led by Councilman King. ABSENCE EXCUSED Mayor White West Covina West Covina 00- introduced Chester Shearer, Mayor of and welcomed him and others from to the Council Meeting. 00- INTRODUC- TION Mayor White stated this is the time and place for a Public Hearing on CP-445, to listen to the concerns of the residents of West Covina, An appeal of a conditional use permit to allow the construction of a 200 room hotel, lounge/night club and to allow the on-site sale of alcohol pursuant to Sections Sections 17.22.030.F, 17.22.030.H and 17.22.030.A of the City Code. Applicant: Baldwin Park Inn Associates/A General Partnership 7 Location: 14635 Towne Center, as property generally situated at the northeast corner of Puente Avenue and Garvey Avenue)". Mayor White asked Mr. Shearer if he would at this time make a presentation on behalf of the City of West Covina Mr. Shearer, explained that a portion of the site is within the City of West Covina while the balance of the site abuts a single-family residential neighborhood in the City of West Covina. He further explained that in reviewing the proposed site plan, significant changes have occurred in the plan that were not a part of the plan considered within the environmental impact report for the Puente-Merced Redevelopment Project in 1984. The Mayor of West Covina addressed issues such as provisions for the handicapped; a form of an agree- ment between police, fire and emergency services. The City of West Covina has presented questions to issues ov privacy, shading and noise and feels these questions should be adequately addressed prior to any decisions being made. Should the City of Baldwin Park decide to approve this project the City of West Covina recommends that the following conditions be included in their approval of CP-445: 1. That an eight 8) foot high decorative block wall shall be constructed and maintained in and along the rear property line; and 2. That a six 6) foot wide planter with speciman plant materials and trees appropriate in size and type to create a solid plant screen shall be installed and maintained in and along the rear property line; and 3. That the hours of operation for the night club be limited to 11:30 a.m. to 2:00 a.m.; and 4. That no truck traffic shall be permitted at the rear of the hotel site between the hours of 6:00 p.m. to 7:00 a.m.; and 5. That this site be inspected for commpliance with the conditions enumerated herein every six months for the first two years then annually thereafter; and 6. That exterior lighting shall be provided in such a manner that no light or glare impacts surrounding properties; and 7. That all ground-mounted, wall-mounted and roof-mounted equipment not shown on the approved plans shall be screened from public view in a manner that is architecturally compatible with the main building. Plumbing Co., Inc. of Baldwin Park) stated he would like to see the project expedited as soon as possible. Mayor White declared the Public Hearing for the residents of West Covina closed. Director of Community Services Smith explained that this is an appeal of a Planning Commissions approval of CP-445 and that certain changes have occurred to the site plan and an addendum to the EIR has been prepared. The addendum asseses the impacts of the design and technical changes to the project. Staff, because of concerns brought up by the City of West Covina relative to privacy and noise, has added conditions which will change the distance of the tower further away from the rear of the residential properties and also raise the height of the block wall. The site plan has been designed so that the high level of activity areas will be located as far away as possible from the neighborhood neighborhood and oriented toward Garvey Avenue. He further explained that the joint parking agreement will allow efficient use by allowing the daytime uses to share parking spaces with those night time uses. Overall, staff feels that the site is adequate for the proposed uses and the additional on conditions of approval should make the uses more compatible with adjoining uses. Director of Community Smith stated that at completion we will have a positive impact on improving the image of the City and recommends that Council approve the addendum to the Puente- Merced EIR, adopt the Findings of Fact, and approve CP-445. Mayor White stated this is now the time and place to hear general discussion from the public on CP-445. There were none. Mayor White declared the Public Hearing closed. JIM HERRERA LINDA BROWN E.A. Council felt that these were adequate changes and stated they be included in the approval of CP-445. It was moved and seconded to approve Resolution No. 87-22, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK GRANTING A CONDITIONAL USE PERMIT ALLOWING A 200 ROOM HOTEL, NIGHT CLUB/LOUNGE AND TO ALLOW THE ON-SITE SALE OF ALCOHOL APPLICANT: BALDWIN PARK INN ASSOCIATES; LOCATION: 14635 TOWNE CENTER/- CASE NO. CP-445)", and included the conditions recommended by the City of West Covina. M/S/C: GIBSON/KING.
