COUNCIL OF CITY HALL, WEDNESDAY, The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Izell. The Flag Salute was led by Chief of Police Hoskin. Waive Further Reading and Adopt RESOLUTION NO. 87-50 AMENDING RESOLUTION NO. 86-86 SETTING FEES AND CHARGES FOR ISSUANCE, PROCESSING AND FILING OF VARIOUS CITY SERVICES AND PERMITS It was moved and seconded to approve the Consent Calendar as presented. There were no objections. 00- PUBLIC HEARINGS CONSENT CALENDAR APPROVED Mayor pro tern Gibson introduced the Public Hearing on the intention of the City Council to establish an Underground Utility District along Ramona Boulevard. Director of Community Services Smith stated that as of 1987, $840/000 has been allocated to the City of Baldwin Park by the Public Utilities Commission. Approximately $420,000 would be expended for the undergrounding of the Ramona Boulevard utilities within Baldwin Park. The City of Irwindale will contribute $630,000 toward this particular undergrounding project. The proposed undergrounding can be done at no cost to the adjacent property owners. It is anticipated that construction will begin in July, 1988. PUBLIC HEARING INTRODUCED UTILITY DISTRICT STAFF REPORT SMITH Mayor pro tern Gibson open on the fomation District and invited come forward. declared the Public Hearing of an Underground Utility those wishing to speak to PUBLIC HEARING OPEN Frank Ramirez, 4924 Wimmer, asked regarding the fees of the Utility District and if they are set fees. Director of Community Services Smith explained that this is a special district that is provided for under State Law* Theses funds are not tax revenues. These funds are required to be deposited by the Utility Companies and allocated out to the State. This is the only thing these funds can be used for. Each city has a bank that they can utilize for this purpose. In response to other questions asked by Mr. Ramirez, City Attorney Flandrick stated that the fees are set by the Public Utilities Commission. They are based on a percentage of the utility companies gross revenues and no cost is allocated to the taxpayer. Mayor pro tern Gibson declared the public hearing closed. It was moved and seconded to approve Resolution No. 87-51, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION TO ESTABLISH UNDERGROUND UTILITY DISTRICT 87-1 ALONG RAMONA BOULEVARD. Director of Community Services Smith explained that the West Ramona Lighting and Landscape Maintenance District was formed in 1980 and assessed only those residential units located within the Ramona Redevelopment Project Area. In 1981 the District was converted to a City- wide District and Council authorized annexation of the West Ramona District, This annexation simplified accounting and reporting procedures and allowed different rate structures to be maintained so that those who did not reside in the West Ramona Project would not be assessed for that maintenance. He outlined the estimated costs for the Fiscal Year 1987-88 and the proposed assessments for the same period. He also explained that staff is working with the County for clarification of the assessment district on the property tax bills. Mayor pro tern Gibson declared the Public Hearing open on the annual levy and collection of assessments for certain landscaping and lighting district and and invited those wishing to speak to come forward. Leo King, 3830 Grace Street, spoke regarding the confusion onthe tax bills regarding the landscape and lighting district and encouraged the Council to vigorously pursue this being changed. Frank Ramirez, 4924 Wimmer, spoke regarding there being two different assessment districts. He asked if there is more than one maintenance district and if the landscaping is citywide. Director of Community Services Smith stated that there is one Citywide Maintenance District with different rates for property within the district. There is a separate and different rate for West Ramona. The landscaping is for medians and light- ing and does not apply to parkway areas. That area is to be maintained by the adjacent property owners. In response to further questions of Mr. Ramirez/ Mr. Smith stated that no bills have accured for the district. This is a projected cost, an annual levy. Mayor pro tern Gibson declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 87-52, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE ANNUAL LEVY AND COLLECTION OF ASSESSMENTS FOR CERTAIN LANDSCAPING AND LIGHTING IN AN EXISTING MAINTENANCE DISTRICT, PURSUANT TO THE PROVISIONS OF DIVISION 15, PART 2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, FOR FISCAL YEAR 1987-1988." Robert Olivas, 3727 Ahern, spoke regarding the need for sidewalks and street repaying in the area that resides. He referred to a petition from the neigh- borhood that had been submitted a few years ago. Anthony Bejarano, 3508 Big Dalton, spoke regarding City requirements for building or expanding drive- ways and people being written up for parking on grass when it is actually a gravel area. Mayor pro tern Gibson declared Oral Communications closed.
