There were no objections. 00- Mayor pro tern Gibson introduced the Public Hearing on the intention of the City Council to order the vacation of a sewer easement relating to 1303 Vineland. Director of Community Services Smith explained that in 1965 the City acquired an easement over a portion of property adjacent to 1303 Vineland Avenue extending to Virginia Avenue with intentions to construct a sewer within this easement. The construction of a sewer is no longer necessary and the City has no further need to retain this easement. Pacific Industrial Realty Inc., representatives for the property owner has requested that the City initiate vacation proceedings for this easement. Therefore, on May 20, 1987 the City Council adopted a Resolution of Intention for sewer easement vacation and now Staff recommends that the City Council adopt a Resolution ordering the vacation of this sewer easement. It was moved and seconded to approve Resolution No. 87-58, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE VACATION OF A SEWER EASEMENT LOCATED ADJACENT TO 1303 VINELAND AVENUE 87-V-l). M/S/C: IZELL/GIBSON. There were no objections. Mayor pro tern Gibson introduced the Public Hearing on the intention of the City Council to order the vacation of an alley easement located south of Nubia Street, North of School Street, West of Maine Avenue and East of Wimmer Avenue, Director of Community Services Smith explained that the County of Los Angeles acquired easements from property owners/ prior to the City's incorporation, along Wimmer Avenue for the purpose of future alley construction. The proposed alley is not improved and is not a part of the Circulation Element of the General Plan. Therefore, Kenneth C. and Leona V. Willis, owners of the property located at 4975 Maine Avenue have requested that the City initiate vacation proceedings for this existing easement which relates to the entire alley. On May 20, 1987 the City Council adopted a Resolution of intention for the alley easement vacation and now Staff recommends that the City Council adopt a resolution ordering the vacation of this alley easement. Mayor pro tern Gibson introduced the Public Hearing on the proposed amendment to the Zoning Code to permit interim uses not otherwise provided for in the FC, 01, 1C and CM zones with a conditional use permit. The new districts, FC, 01, 1C and CM were established to encourage flexable coordinated redevelopment of properties primarily along the San Bernardino Freeway. Any new development within these zone districts requires compliance of the Zoning Code and Redevelopment Agency approval for compliance of the Sierra Vista Redevelopment Plan. There is now a need to provide for interim uses within the Project Area, and staff is suggesting that the city may want to consider approving a use or development on a property on a short term basis while property in another area of the project is being assembled to accommodate that same use on a permanent basis. Providing for such interim uses would allow a business to come into Baldwin Park immediately while the lengthy property assemblage procedure is in process within a permanent site. In order that the City and Agency retain the control necessary to assure that the interim use is temporary and the use is relocated within one of Baldwin Park's Redevelopment Projects, staff is recommending that the use first obtain a conditional use permit including a condition that the interim use may exist for no more than one year and a six month extension with good cause; another condition would be that the principal of the business would enter into an agreement with the Redevelopment Agency requiring that they locate in a permanent location within a Baldwin Park Redevelopment Project Area unless the Agency deems the use unfit for one of its project areas. Staff and the Planning Commission recommend that the Council approve the Negative Declaration of Environmental Impact and adopt AZC-114 amending the zoning code to provide for interim uses in the FC, 01, 1C and CM zone district with a conditional use permit. Council stated they would like to make one change to the ordinance in the time allowed that such use is temporary or interim in nature and will be completely removed from the lot where it is located within the time set forth as a condition of approval on the conditional use permit, if no time is is specified, a period of one 1) year from and after the date of approval of the conditional use permit. It was moved and seconded to approve Ordinance No. 963, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONING CODE AMENDMENT TO CHAPTERS 17.16, 17.21, 17.23, 17.24 AND 17.25 OF THE ZONING CODE ADDING INTERIM USES NOT OTHERWISE PROVIDED FOR IN THE FC, 01, 1C AND CM ZONE DISTRICTS WITH A CONDITIONAL USE PERMIT APPLICANT: CITY OF BALDWIN PARK, CASE NO. AZC-114) Mayor pro tern Gibson introduced the Public Hearing on the Budget for the Fiscal Year 1987-88. City Manager Webb explained that there are changes proposed to be made and incorporated in the budget, all have to do with the Capital Improvement Program. This project was included in the proposed budget prior to learning that the completion would be in fiscal year 1986-87, therefore this should be deleted from the budget. Cost for the Francisquito Storm Drain and pavement rehabilitation of Merced Avenue should be included in the budget. The storm drain project on Olive east of the City limits was originally part of the County Capital Improvement Program. However the County is eliminating projects thay feel should be the responsibility of the City. The cost of the project is $400/000 which is being requested to be added to the Capitol Improvement Program budget. The funds for storm drain project will be from gas tax funds. Charges of financing the Community Center are also to be included in the budget. With these changes the City Manager is requesting the Council adopt the Budget for the Fiscal Year 1987-88. It was moved and seconded to approve Resolution No. 87-60, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING THE BUDGET FOR THE CITY OF BALDWIN PARK FOR THE FISCAL YEAR COMMENCING JULY I/ 1987 AND ENDING JUNE 30, 1988". There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS, COMMITTEE Director of Community Services Smith explained that the Capital Improvement Program represents a five year project of major infrastructure and community improvement activities. The proposed program allocates expenditures of funds for major thoroughfares through the City utilizing Federal Aid to Urban FAU) and Gas Tax GT) monies. The Construction of off-site improvements necessary for Redevelopment Projects are also included within this program. Other short term objectives included the construction of a new Community Center/ the expansion of Morgan Park, bus shelter installation storm drain installation in selected reaches of Francisquito Avenue and Olive Street and the pavement rehabilitation of Big Dalton and Vineland Avenue between Pacific Avenue and Merced Avenue. Long term objectives are somewhat speculative due to financial constraints, therefore staff is unable to better quantify projects beyond the next two years, The update and implementaion of the CIP is an ongoing effort and revisions may be expected to this program as new information becomes available. Staff is recommending that the Council approve the Capital Improvement Program as submitted. It was moved and seconded to approve the five year Capital Improvement Program. M/S/C: IZELL/GIBSON. He feels that there is some confusion in the code and asked that staff get back with Council on this issue. 00- ORAL COMMUNICATINS Mayor pro tern Gibson declared Oral Communcatins open and invited those wishing to speak to come forward. Roy Test, 15115 Kenoak, stated that he would like to see something done soon about the All Star Automotive Parts building. Mrs. Aghbashian, 12853 E.
