City Planner Rangel explained that the general plan amendment and zone change request was initiated to reclassify the subject property's general plan land use designation. The subject property is located west of the 605 freeway and south of the Walnut Creek Wash along Perez Place. The property is located within the Delta Redevelopment Project area. The subject property is currently zoned OS which staff feels has little or no use. Staff feels that land use designation should be changed to General Manufacturing and that the zoning should be changed to I, Industrial and subsequent to the Planning Commission's consideration of the proposed General Plan Amendment and zone change, an application for a parcel map was received by the city which involves the subject property. Staff and the Planning Commission's recommendation to the City Council is to Adopt the Negative Declaration of Environmental Impact, approve AGP-77 amending the General Plan Use designation from Open Space to General Manufacturing, and approve Z-469 changing the zoning from OS to I. Staff also recommends that the City Council approve PM-1118 allowing a two 2) lot subdivision for industrial purposes subject to the listed conditions stated in the staff report. Mayor King declared the Public Hearing open on the Amendment to the General Plan AGP-77), Zone Change Z-469), and Parcel Map PM-1118) and invited those wishing to speak to come forward. There were none. Mayor King declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 87-72, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A PARCEL MAP ALLOWING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FOR APPROXIMATELY 2.0 ACRES OF PROPERTY LOCATED ALONG THE 200 BLOCK OF N. PEREZ PLACE", and staff and the Planning Commission's recommendations as listed in the staff report. M/S/C: IZELL/WHITE. There were no objections. City Planner Rangel explained that Mejia's Wholesale Nursery is proposing to use a total of 2.4 acres on two separate properties for plant cultivation. Both properties are linear-shaped and are approximately the same size, about 1.2 acres each. Access and on-site circulation appear to be adequate for this type of use. Both properties have two means of access* Site one has access to Dalewood Avenue and Ledford Street and is served by a twelve foot dirt service road. Site 2 has access to Ledford Street and Farnell Street and is served by a fifteen foot wide service road. He explained that approximately 76,000 square of the properties in question are zoned R-l. The remaining portion of the subject properties are zoned R-3. Adjacent zonings are R-3 and R-l and 01. Single- family residential use surrounds most of the properties except for the adjacent 01 zone property which is vacant and two lots in the R-3 zone which are developed with small apartments. Staff feels that the proposed OS zone is a more suitable classification of the subject properties then the existing zone. Permitting a nursery seems reasonable. Staff feels that the proposed nursery should only be approved for a limited time, 3 years, since there is a possibility that the City may want to develop these properties for recreational purposes and for parking purposes in conjunction with the future development. The Planning Commission and staff recommended that the City Council approve the Negative Declaration of Environmental Impact, the Findings of Fact and AGP-76, Z-467, and CP-456 subject to the listed conditions in the staff report Mayor King declared the Public Hearing open on the Amendment to the General Plan AGP-76), Zone Change Z-467) and Conditional Use Permit CP-456) and invited those wishing to speak to come forward. Frank Ramirez, 4924 Wimmer Avenue, asked how many times changes can be made to the General Plan and how many times zone changes can be made. And if meetings would be held on these changes. City Attorney Flandrick responded that changes to the General Plan can be changed four 4) times a year and change of zone can be changed an unlimited amount of times and that meetings would be conducted on these changes. MCNEILL/KING NOES COUNCILMEMBER: NONE_______________________ ABSENT: COUNCILMEMBER: GIBSON Mayor King introduced the Public Hearing on CP-25 and PM-1114, An appeal of the Planning Commission's decision to deny a request for modification of a conditional use permit pursuant to Section 17,54.150 of the City Code in order to allow a portion of the rear of a property occupied by an existing church to be sold and combined with an adjacent property, and a request for approval of a tentative parcel map for a two 2) lot subdivision pursuant to Section 16.01.070 of the City Code. City Planner Rangel explained that the applicant, Ascension Evangelical Luthern Church has requested approval of a tentative parcel map to create two parcels; the second is a request to modifiy a conditional use permit allowing a portion of a church owned property, located at 14855 Pacific Avenue, to be sold-off and combined with an adjacent property in order to reduce the size of the parcel. He further explained that the Planning Commission denied the applicant's request. The applicant has appealed this decision to the City Council at this time. The site is composed of three parcels; the property at 14855 Pacific Avenue, the parcel at 3714 Puente Avenue Single Family house) and the third parcel is a vacant landlocked parcel. If the tentative parcel map PM-1114) is approved, the three existing parcels will be consolidated into two parcels. City Planner Ranqel further explained that the modification of CP-25 is required prior to the approval of the tentative parcel map and can only be approved if it can be proven that the proposed parcel is adequate in size and shape to accommodate the existing church facility including parking. The applicant's site plan contains a few other minor deficiencies. RESOLUTION NO. 87-73 APPROVED ORDINANCE NO. Staff feels that the churches observed to have traffic and parking problems may have been constructed years ago under less stringent parking standards than those which are in effect today. Staff feels that the current parking standards are adequate and since the applicant meets City parking standards, the applicant's request should be approved subject to the refinements stated in the staff report* Staff recommends that the City Council approve the Negative Declaration of Environmental Impact, Adopt the Findings of Fact and Approve CP-25 and approve PM-1114. Mayor King declared the Public Hearing open on the Conditional Use Permit CP-25) and Parcel Map 1114 PM-1114) and invited those wishing to speak to come forward. Lawrence W. Speight, Speight Engineering Company, Inc., 8301 E. Florence Ave», Downey, representing Ascension Luthern Church, explained that the Planning Commission denied their request to subdivide a parcel and modify a Conditional Use Permit for a church because of a present parking problem associated with church facilities in Baldwin Park. Therefore the applicant conducted a survey of 20 church facilities that in summary 18 of the 20 had adequate parking, one church appeared to be underserved with parking and 13 churches of the 20 did not utilize off-site parking. He stated that the existing parking at their facility is more than adequate to accompany their parking needs and since all requirements are met, thay request Councils approval. Patricia Dixon, 15147 Howellhurst Dr., representing the Church members, stated that the members are looking at ways to improve the lot, therefore asked that the Council grant approval to their request. Mayor King declared the Public Hearing closed. Councilwoman McNeill stated that do to the facts that the only problem the Planning Commission had is the parking, and this property has more than enough parking spaces, she sees that there are no problems with the Church's request. Director of Housing & Economic Development Hemer, explained that the submission of two UDAG applications to HUD for proposed projects in the Sierra Vista Redevelopment Project are for industrial reuse and met City objectives of providing new employment opportunities and enhancing the City's tax base. He outlined that both projects proposed by Award Metals and Virginia Industrial Properties request City assistance in acquisition of an additional four parcels and of five properties that will need Federal assistance. $2,560,000 would be requested from HUD for the project proposed by Award Metals and $1/260,000 would for the project proposed by Virginia Industrial Properties. Following the Public Hearing/ it is recommended that the City Council authorize the Staff to submit UDAG applications for both of the projects described. Mayor King declared the Public Hearing open and invited those wishing to speak to come forward. PUBLIC HEARING OPEN STAFF REPORT HEMER PUBLIC HEARING OPEN There were none. Director of Community Services Smith explained that the old irrigation system at the Puente Avenue underpass and the San Bernardino Freeway has deteriorated where it can no longer be effectively repaired and has made it impossible to maintain the plant materials, which has dried out do to the lack of watering. He further explained that it was felt the appearance of the underpass required attention since the construction work on the Puente/Merced project was proceeding. A bid opening was publicly opened and only a bid from Mariposa Landscaping was received whose price was competative to the estimated construction cost. Staff recommended a construction contract be awarded to Mariposa Landscaping. It was moved and seconded to award a contract for Irrigation System and Landscaping of Puente Avenue Underpass at 1-10 Freeway. M/S/C: WHITE/IZELL. Cutler St., spoke about the Santa Fe Trail. Anthony Bejariano, spoke about the auditors that come in to review the City's financing and if other auditors can bid for this service. City Manager Webb, explained that a contract for audit services are approved annually. Pam Schnabel, 14217 Los Angeles St., spoke about California passing a bill to tax social security. Asked if a letter would be sent to congress indicating that the people do not want social security to be taxed. Mayor King suggested that this issue be looked into and as individuals do something. Giovanni Monterroso, 3271 Frazier St., spoke about traffic and speeding problems on Frazier and if the City would look into putting a stop sign at the intersection of Frazier and Waco.
