The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 7:00 p.m. The Invocation was given by Councilman Gibson. There were no objections. 00- CONSENT CALENDAR APPROVED PUBLIC HEARINGS Mayor pro tern Izell introduced the Public Hearing on 87-V-3/ Ordering the Vacation of excess right-of-way along Badillo Street and Downing Avenue located adjacent to 14700 and 14728 Badillo Street". Mayor pro tern Izell declared the Public Hearing open on 87-V-3 and invited those wishing to speak on this subject to come forward. There were none. Mayor pro tern Izell declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 87-95, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE VACATION OF EXCESS RIGHT- OF-WAY ALONG BADILLO STREET AND DOWNING AVENUE LOCATED ADJACENT TO 14700 AND 14728 BADILLO STREET 87-V-3)". M/S/C: WHITE/GIBSON. There were none. Mayor pro tern Izell introduced the Public Hearing on AGP-79 & Z-471, A City initiated request to consider: 1) an amendment to the General plan Land Use Element Residential to Central Business District; and 2) a zone change from R-3/ High Density Residential to C-2, General Commercial; and 3) an amendment to the General Plan Circulation Element for the deletion of Ina Street between Maine Avenue and Bogart Avenue. Said zone change and General Plan Amendment includes approximately 3.12 acres of land Applicant: City of Baldwin Park/- Location: 4125-4203 Bogart Avenue, 14446-14455 1/4 E. Palmrose Street, 14443-14461 E. Ina Street)". Mayor pro tern Izell declared the Public Hearing open on AGP-79 & 2-471 and invited those wishing to speak on this subject to come forward. Justina Ramirez, 4924 Wimmer, inquired about the closing of Ina Street and how that would effect tenants on that street. Director of Community Services responded that the street will not be closed or touched until all properties have free access. Bobette Wright/ 3733 Paddy Lane, inquired about the closing of Palmrose Avenue, and spoke about the property that she owns and the law that allows owner/ participation in a project. She asked for her pro- perty to be reappraised, objected to the closing of Ina Street and asked that the street not be closed until tenants have been relocated. He also explained the procedure for property acquisition and stated that the property will be paid for that is required to extend the street. Frank Ramirez, 4924 Wimmer, questioned the zone change, because this area is part of the Sierra Vista Redevelop- ment Project and there is an appeal on this project in the courts that has not been decided. He wanted to know what precedence allows the zone change, City Attorney Flandrick stated that the case involving the Sierra Vista Project is on appeal and has nothing to do with the rezoning. The two are totally unconnec- ted and are two separate and distinct matters. State Law provides for rezoning when notice is given about hearings. This action has no connection with the court case. He also responded that there are many cases relat- ing to this. In response to Mr. Ramirez's question Director of Housing Hemer explained that the lack of access to the properties will not happen, because the street closures will not be done until all the property is acquired and the people are specifically located. Bobette Wright/ 3733 Paddy Lane, requested to be allowed to participate by buying into the project in the Downtown area. She explained that there are to be nine shops in the project and she wished to be allowed to buy something. She stated that the City is taking her business and she asked that it be included in the record that she is interested in purchasing a business in the project. Director of Housing and Economic Developement Hemer explained that acquisition of property within a project area means that the opportunity for owner/ participation is given if a person can propose an equivalent project, which would mean a 13 acre project* Eugolio Roca, 14637 California, read from Section 33339 of the Redevelopment Law and stated that he felt Ms. Wright should be allowed to participate, Mayor pro tern Izell declared the Public Hearing closed. It was moved and seconded to approve Resolution NO. 87-96, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMENDMENT TO THE CIRCULATION ELEMENT TO DELETE INA STREET AND TO EXTEND PALMROSE STREET AND AN AMENDMENT TO THE LAND USE ELEMENT MAP OF THE GENERAL PLAN FOR APPROXIMATELY 3.12 ACRES OF LAND APPLICANT: CITY OF BALDWIN PARK; CASE NO. AGP-709)". M/S/C: GIBSON/WHITE. There were no objections. It was moved and seconded to approve Ordinance No. 975, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-3 TO C-2 ON APPROXIMATELY 3.12 ACRES APPLICANT: CITY OF BALDWIN PARK; LOCATION: 4125 THRU 4203 BOGART AVENUE; 14446 THRU 14455 1/4 PALMROSE STREET AND 14443 THRU 14461 INA STREET)". Fairgrove St.)". City Planner Rangel explained that the property at the intersection of Fairgrove Street and Garvey Avenue is located in the Sierra Vista Redevelopment Project. Reclassifying the property would increase the quality of development of adjacent 1C zoned properties and help implement the objectives of the project area. The general plan amendment and zone change will improve development opportunities along the San Bernardino Freeway corridor for commercial and industrial uses and promote the assembling of small properties for larger scale development. It was moved and seconded to approve Resolution No. 87-97, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FOR APPROXIMATELY 39 ACRES OF PROPERTY LOCATED AT 13216 FAIRGROVE STREET". M/S/C: MCNEILL/WHITE. There were no objections. It was moved and seconded to approve Ordinance No. 976, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-3 TO 1C ON APPROXIMATELY 3.9 ACRES APPLICANT: CITY OF BALDWIN PARK; CASE NO. 2-472; LOCATION: 13216 FAIRGROVE STREET). M/S/C: MCNEILL/GIBSON. There were no objections. Mayor King introduced the Public Hearing on AGP-81 & Z-473/ A request for approval of: 1) a zone change from R-l, Single Family Residential Planned Development Overlay zone; 2) a Development Plan to allow a ten 10) unit single family development; and 3) tentative tract subdivision; and 4) an amendment to the General Plan Circulation Element to delete a portion of a future street Applicant: Chia-Sheng Hou & Hsu Pi-Lien Hou; Location: 3445- 3453 Big Dalton Avenue)". City Planner Rangel explained that the applicant is requesting a zone change from R-l, Single Family Residential, to R-l PD)/ Single Family Residential Planned Development for ten 10) single family dwell- ings. A street deletion is recommended since the portion of the street to be deleted is not necessary to fully develop the effected properties. Mayor King declared the Public Hearing open on AGP-81, TM-45896 & Z-473 and invited those wishing to speak on this subject to come forward. Susan Bachman, 3418 Big Dalton/ asked about this project being for homes or for condos and requested a stop sign along Big Dalton due to the heavy traffic. Al Durenzi/ L & D Engineering, 106 W. Lime, Suite 204, Monrovia, representing the developer, stated that his client is prepared to meet the required conditions and that he is available to answer any questions. Betty Lowes/ 14122 Chilcot, spoke about the consultant that had been hired to do the revision of the General plan and asked about the zone changes being made at this time. Anthony Bejarano, 3408 Big Dalton, asked about ten single family houses being built on Big Dalton and if a street would be built down the middle of the lots. He also spoke concerning the poor lighting on Big Dalton, Mayor King declared the Public Hearing closed. City Attorney Flandrick explained that the City Council will be approving three separate items, 1) an amendment to the General Plan; 2) approve the Planned Development and amend the resolution to include the approval of a Tentative Tract Map; and 3) a zone change. It was moved and seconded to approve Resolution No. 87-98, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN AMENDMENT TO THE CIRCU- LATION ELEMENT OF THE GENERAL PLAN TO DELETE A PORTION OF A FUTURE STREET LOCATED NORTHWEST OF BIG DALTON AVENUE APPLICANT: CHIA-SHENG HOU & HSU PI-LIEN HOU; CASE NO. AGP-81)". M/S/C: GIBSON/MCNEILL. There were no objections. It was moved and seconded to approve Resolution No. 87-99, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN FOR A 10 UNIT SINGLE FAMILY PLANNED DEVELOPMENT APPLICANT: CHIA-SENG HOU & HSU PI-LIEN HOU; CASE NO. Z-473 & TM-45896)". M/S/C: IZELL/GIBSON. There were no objections. It was moved and seconded to approve Ordinance No. 977, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-l TO R-l PD) ON APPROXIMATELY 1.45 ACRES APPLICANT: CHIA-SENG HOU & HSU PI-LIEN HOU; CASE NO. There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES City Clerk Gair explained that Council action is necessary to confirm the appointments of the students recommended by the ASB Director's at each of the local high schools. M/S/C: WHITE/MCNEILL. There were no objections. City Manager Webb stated that the City of Irwindale is working to relocate the Los Angeles Raiders into' that City. This move/ should it be successful, will bring many benefits to the San Gabriel Valley. Some of those benefits will be: an expected higher profile to the City/ significant economic benefits, increased property value, improved tax base and new jobs. It is recommended that the City Council support the relocation of the Los Angeles Raiders by minute action. It was moved and seconded that the City Council of the City of Baldwin Park support the move of the Los Angeles Raiders to the City of Irwindale and give their full support to the action taken by that city. There were no objections. 00- RESOLUTION NO. 87-100 APPROVED RELOCATION OF LOS ANGELES RAIDERS TO THE CITY OF IRWINDALE COUNCIL SUPPORT OF RELOCATION OF RAIDERS ORAL COMMUNICATIONS Mayor King declared Oral Communications open and invited those wishing to speak on any subject to come forward. Roy Test, 15115 Kenoak, asked for clarification on the code amendment regarding abandoned vehicles. Garland Hannon, 3132 Syracuse, spoke regarding the difference in fines for parking and the need for the traffic to be slowed down on his street. Mayor King declared Oral Communications closed. oo- City Attorney explained that there was a need for a Closed Session relating to Sails vs the City of Baldwin Park and a Workman's Compensation case, Kaiser vs the City of Baldwin Park. The closed session is authorized by Section 54956.9(a) of the Government Code. It was moved and seconded to adjourn to as Closed Session at 8:02 p.m. M/S/C: IZELL/WHITE. There were no objections. Council was back in session at 8:30 p.m. Roll Call remained the same.
