PACIFIC AVENUE, BALDWIN PARK. The adjourned regular meeting of the Baldwin Park City Council took place on January 13, 1988, at 7:06 p.m. in the Council Chambers. Mayor King presided. Flag salute was led by Mayor King. Council Members Izell, McNeill and Mayor King. ROLL CALL: PRESENT: JANUARY 13, 1988 7:06 P.M. FLAG SALUTE ROLL CALL STAFF: City Manager Webb City Attorney Flandrick Captain Lanza Art Rangel, City Planner Larry Onaga/ Associate Planner Robert Ruth, Assistant Planner and Alice Nichols, Secretary. The absences of Councilmen Gibson and White were excused. * * City Council convened at 7:06 for a Joint Planning Commission/City Council Study Session. CITY COUNCIL CONVENED AT 7:06 P.M. FOR JOINT PLANNING COMMISSION CITY COUNCIL STUDY SESSION First item: Mini-mall developments. Associate Planner Onaga presented the written staff report on mini-malls. Items that were identified for discussion were: proliferation, traffic and parking problems, aesthetics, loitering, littering and noise and high turn over rate. Onaga presented slides showing mini-malls in the City and in other cities of the Valley. Discussion centered on the fact that at present proliferation does not seem to be a problem in Baldwin Park. It was stated that mini-malls should be defined. Guidelines should be established now. The City has no right to regulate competition, as supply and demand will take care of that. Circulation in many of the sites is a problem, so is parking as perceived by some of the members of the Council. Some places use parking spaces for loading purposes, thereby eliminating some parking temporarily; some trucks leak oil so badly that perhaps concrete surfacing on parking lots should be required; perhaps a way to handle the present uses is to regulate by zone. The City, through the conditional use permit process, can address items such as the need for better design, circulation, traffic, loitering and litter. Tying concerns to zoning requirements can assure the City of what it wants. It was inquired if at the time of plan review staff knows what is the intended use of the property. Rangel responded that usually not and that too many restrictions could preclude some development from occurring. Council and Planning Commission recommended the conditional use permit and design review process to regulate mini-malls with conditions of approval to be added to help mitigate potentially adverse effects and improve design. MOTION TO INSTRUCT STAFF TO CONTINUE WITH CUP PROCESS WITH ADDED STANDARDS FOR IMPROVED DESIGN AND LESS ADVERSE EFFECTS Second item: Regulation alcoholic beverages. of uses selling REGULATION OF USES SELLING ALCOHOLIC BEVERAGES City Planner Rangel presented the written staff report highlighting that the uses which do not pose as much of a problem are on-sale uses associated with legitimate restaurants and off-sale in conjunction with large supermarkets. The rest of uses associated with bars, mini malls and small convenience stores appear to be responsible for higher crime rates and all the other problems previously discussed. It was stated that specific information stating which packaged stores generate the most calls to the police was not available at the meeting. It was very hard to identify liquor related crime. But package stores generate more calls than places such as Alpha Beta. The Alcoholic Beverage Control Board would rule in favor of the City but this applies to applications in high crime areas. The Baldwin Park Police Department has statistics by location and the types of crime associated with each of them according to Captain Lanza. Attorney Flandrick stated that the City can accomplish its goals by regulating permits based on population, distance between uses, zoning matters 7 distinction between types of licenses, beer bar, on-sale without food is a prime circumstance for problems. Regulation of traffic generation, parking lot clean-up enforcing etc. If the situation gets really bad the City Council can recommend filing an action suit. CUP requirements are hard to police. Public phones should be restricted to the inside of an establishment. Attention was given to the cost involved in revocation of conditional use permits. A fee could be attached for the cost of inspecting. Perhaps a bond could be required to pay the cost of revocation. Council and Planning Commission instructed staff to develop definitions distinguishing legitimate restaurants from bars and supermarkets from convenience stores and refine and take necessary course of action to implement the following measures: 1. Eliminate these uses from existing zones where sales of alcohol are not necessary or desirable; 2. Codify some general conditional use permit criteria similar to the City of Oakland which will put the burden of proof on the applicant to demonstrate that the proposed use will not impact adjacent properties, result in an increase in crime/ become a nuisance, or create an undue concentration of uses in the area; 3. Adopt the ABC ratio or any other suitable values to use as a guide in determining concentration levels of alcohol sale outlets in area of the City; 4. Codify a standard that provides a minimum separation between similar alcohol sale outlets; and 5, Incorporate some general policy statements into the General Plan addressing the placement and number of liquor outlets in the City. MOTION TO INSTRUCT STAFF TO DEVELOP DEFINITIONS AND PROCEED WITH RECOMMENDED MEASURES Third item: Design Review. City Planner Rangel presented the written staff report recommending that the Planning Commission and City Council direct staff to draft an ordinance giving the design review committee more authority in design review and to retain an architectural firm to be part of that committee and give staff more authority to withhold occupancy permits for poor workmanship. Slides of various design were shown. It was discussed that many times the streets are very dirty when there is construction and the contractor should be responsible for the clean-up. The building inspector has the final approval of a project. Holding final occupancy is used as leverage with a developer. Many times plans meet code but the design is very sloppy. Time delays are very costly to developers. City Planner Rangel stated that once the City gets aggressive about plan review and the word gets out the architects will submit better designs rather than go through the delay. McNeill moved to approve all of staff's recommendations. Izell seconded with the stipulation that it would include all zones except residential zones with four or less units. All were in favor. City Planner Rangel presented the written staff report recommending that the Planning Commission and the City Council direct staff to adopt an interim policy of individual letters not to exceed twenty four inches in height and 66 percent of the store frontage. It was pointed out that the code should regulate freeway signs in a different manner than signs for other parts of the City. Stores that are part of a nationally known chain usually request to be allowed their own sign design. Even though the City has approved changes in the sign code some of these changes are very hard to enforce. New merchants should be given literature on the types of signs that are allowed along with their business license. City Planner Rangel recommended the use of Cortez lettering for Maine Avenue. Some of the members of the Commission stated that this would be very monotonous. But a need for guidelines relating to signs in general was acknowledged. Council and Planning Commission directed staff to work on sign criteria. CBD SIGN PROGRAM MOTION TO DIRECT STAFF TO WORK ON SIGN CRITERIA Public hearings. None. * * PUBLIC HEARINGS Old Business. None OLD BUSINESS New Business. None. * * NEW BUSINESS Oral Communications. Janette Roca, 14637 California Avenue, stated that Five Brothers furniture store have spent $5/000, for their sign. What would happen if a new sign ordinance were in effect? City Planner Rangel stated that the sign would become a legal nonconforming sign. Charles Wild, owner of a bar at 14237 Garvey Avenue, stated that there is a great need for phones along the freeway. That the telephone company states they do not install them because of the vandalism problem. On another matter he stated that he was very offended because his property was shown in one of the slides as not very attractive. He stated that he has been wanting to get a permit from the City to construct a new building on his property for a long time and the City has refused stating a number of reasons. He also was interested about the report on a code enforcement study. City Planner Rangel stated that the survey had gone out late because the consultant had been delayed. City Manager Webb stated the code enforcement matter would be in the City Council meeting agenda for January 20.
