The following item was removed from the Consent Calendar for separate consideration: Item No. 7 at the request of Mayor King. Mayor King wished to point out that the City Manager is taking into consideration the issue of trash separation in relation to Item No. 7. ITEMS NO. 1-6 & 8-11 APPROVED ITEM NO. 7 ITEM NO. 7 APPROVED PUBLIC HEARINGS City Planner Rangel introduced the Public Hearing on Z-477 & TM-46701, The intent of the City Council to consider a request for approval of a change of zone from R-l, Single-Family Residential to R-l PD) Single-Family Residental Planned Development Overlay zone, a development plan allowing the construction of 13 single-family homes and a Tentative Tract Map allowing the subdivision of three 3) lots into 13 lots for residential purposes pursuant to Chapter 17.54 and Sections 17.20.020 and 16.01.070 of the City Code respectively". City Planner Rangle explained that the subject property is composed of underutilized deep lots and land locked parcels. This project will be served by a public street rather than a private street and will not be a gated project. He explained the arrangements that have been made with certain property owners regarding problems relating to the realignment of the street and stated that the staff is recommending approval of this project with tile roofs instead of composition shingle roofs. Mayor King declared the Public Hearing open on Z-477 & TM-46701 and invited those wishing to speak on this subject to come forward. Myrtle Ave., Monrovia/ stated that they concur with the recommendations of staff and that he is available to answer any questions. Mayor King declared the Public Hearing closed. It was moved and seconded to approve Resolution No, 88-46, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN AND A TENTATIVE TRACT MAP APPLICANT: OWEN DEVELOP- MENT; CASE NO. Z-477 & TM-46071; LOCATION: 482•;5- 4837 FORTIN STREET)". M/S/C: GIBSON/LOWES. There were no objections. It was moved and seconded to approve Ordinance No. 986, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-l TO R-l PD) APPROXIMATELY 1.86 ACRES APPLICANT: OWEN DEVELOPMENT; CASE NO. Z-477; LOCATION 4825" 4837 FORTIN STREET)". M/S/C: GIBSON/ MCNEILL. There were no objections. City Engineer Rait introduced the Public Hearing on Assessment District 88-1, A Public Hearing to consider the formation of an assessment district pursuant to the Municipal Improvement Act of 1913 Assessment District 88-1, Ahern Drive) and to consider the award of a contract for the work proposed pursuant to the District. City Engineer Rait explained that this Public Hearing is continued from the April 20th regular meeting and concerns the proposed Ahern Drive Assessment District. She stated that nine construction bids were received and an excellent low bid of $66,034.50 was submitted by San Gabriel Paving Company of Ontario. This bid along with a possible City contribution of $35,041.17 will result in a reduction of the proposed assessments for this project. She further explained the availabilty of possible additional funding for this project from the City through the use of Transportation Development Act Funds issued under SB 821. She outlined the Council actions that are necessary if there is a majority protest and the actions neccessary if there is not a majority protest. In response to Council's questions. City Attorney Flandricic stated that a contribution by the City to this project would set a practical precedent", not a legal precedent. The matter is committed to the Council's discretion and may well be something that will be expected later on. Mayor King declared the Public Hearing open on AD 88-1, Ahern Drive Assessment District, that was continued from April 20, 1988, and invited those wishing to speak on this subject to come forward, Billie Bernal, 3732 Ahern Drive, spoke regarding having put in curbs and gutters 27 years ago and the Ice House paying less for the improvements than she is. He gave a comparison of Bernal's properties as: $1,435.86 and the Ice House, Bernie Martin, 3749 Ahern Drive, stated that he was satisfied with the price and he withdrew his protest. Justina Ramirez, 4924 Wimmer, asked if the school district will be contributing to the assessment district no), and if the $66,000 figure quoted was the total cost yes). Helen Martinez, 3713 Ahern Drive, asked about the amount of street that would be improved and suggested that Ahern be made a one-way street. Elsina Figueira, Baseball Street, El Monte, stated her objection to the fee assessed her property as opposed to the Ice House's fee. Mayor King declared the Public Hearing closed. City Attorney Flandrick stated for the record that the percentage of protests received, not including the protest withdrawn, was 27.4% and this did not constitute a majority. It was moved and seconded to approve Resolution No. 88-47, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING ITS DECLARATION OF INTEN- TION TO ORDER CREATION OF ASSESSMENT DISTRICT 88-1 AHERN STREET) TO PROVIDE FOR A CITY CONTRIBUTION". M/S/C: GIBSON/IZELL. There were no objections. It was moved and seconded to approve Resolution No. 88-48, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CONFIRMING THE ASSESSMENT, ORDERING THE IMPROVEMENT AND APPROVING THE ENGINEER'S REPORT IN AHERN ASSESSMENT DISTRICT NO. 88-1". A 4% cost of living increase is proposed due to increases in utility costs of water and power. Costs for the district have exceeded the revenues in recent years and the short-fall has been covered by general fund subsidies and uncommitted carry-over funds. Rates have not been adjusted for four years. It was moved and seconded to approve Resolution No. 88-51, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE ENGINEER'S REPORT" FOR CERTAIN LANDSCAPING AND LIGHTING MAINTENANCE IN A MAINTENANCE DISTRICT WITHIN THE CITY OF BALDWIN PARK". It was moved and seconded to approve Resolution No. 88-52, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS INTENTION TO PROVIDE FOR ANNUAL LEVY AND COLLECTION OF ASSESSMENTS FOR CERTAIN LANDSCAPING AND LIGHTING IN AN EXISTING MAINTENANCE DISTRICT, PURSUANT TO THE PROVISIONS OF DIVISION 15, PART 2. OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND SETTING A TIME AND PLACE FOR PUBLIC HEARING THEREON". M/S/C: GIBSON/1ZELL. Frank Ramirez, 4924 Wimmer, stated some figures to the Council relating to revenues collected for the Landscaping and Lighting District and said he would be back with more information at the June 1st hearing. Marsha Arkin, 4344 Stewart, requested direction signs that point out the Senior Citizens' Center. Mildred Welch, 4421 Baldwin Park Blvd., inquired about when she would be receiving the money for the property sold to the City. Justina Ramirez, 4924 Wimmer, inquired about when the signals at Olive and Baldwin Park Blvd. will be working. Gayle Zaus, 4340 Merced, thanked Council for cleaning the area around Ina Street. Robert Olivas, 3727 Ahern, asked regarding the pay- ment plan for the Ahern Drive improvements. Joanne Bommarito, 13147 Shaver, requested a signal at Baldwin Park Blvd. and Bess Avenue and for the No Parking Anytime signs to be put up again along Bess Avenue.
