Approve Support of Proposition 71 on the June 7, 1988 Ballot Government Spending Limitations and Accountability Act It was moved and seconded to approve Consent Calendar Items No. 1-7 and 9-10. M/C/S: GIBSON/LOWES. There were no objections. The following item was removed from the Consent Calendar for separate consideration: Item No. 8 at the request of Councilwoman McNeill and Mayor King. In response to Councilwoman McNeill*s concern regarding relinguishing this property and Mayor King's concern regarding the effect the sale of this property could have on parking for the Civic Auditorium, City Manager Webb explained that the action being taken would grant an option only and the City is under no obligation if senior housing cannot be built and that parking spaces are adequate for the Civic Auditorium. There are 217 spaces not including spaces on Ramona Boulevard and the railroad property. The senior housing would add 75 units and not effect the parking. Director of Housing and Economic Development Hemer, in answer to Council questions, stated that the lady living in the home on that property would have a first priority consideration as a tenant in the new housing. He explained that time does not allow a delay in taking an action on this item because application must be made by June 15th and this will be the last of the federal program. He also explained that the City will retain the right to approve or disapprove of the architectural features of this project if TELACU is given a grant. Councilman Izell made a motion that Item No. 8 be tabled until a later date. Councilwoman McNeill seconded the motion. City Planner Rangel explained that this request was initiated by the owner of an existing self-storage facility in order to expand his facility. He stated the reasons for establishing this area as an 01 zone and that this expansion would be a non-conforming use in that zoning. Staff feels that this could be con- sidered as an allowable use in manufacturing zones at a later date. Staff and the Planning Commission res- commend denial of this request. Mayor King declared the Public Hearing open on AZC-120 and invited those wishing to speak on this subject to come forward. There were none. Mayor King declared the Public Hearing Closed. It was moved and seconded to approve Resolution No. 88-58, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING AN AMENDMENT TO THE BALDWIN PARK ZONING CODE CHAPTER 17.23 TO ALLOW SELF-STORAGE AS A USE PERMITTED IN THE 01, OFFICE INDUSTRIAL ZONE WITH A CONDITIONAL USE PERMIT APPLICANT: GARY R. SMITH; CASE NO. AZC-120)". M/S/C: GIBSON/IZELL. There were no objections. Director of Community Services Smith introduced the Public Hearing on the Citywide Landscaping and Lighting District for FY 1988-89, Ordering the Annual Levy and Collection of Assessments for Certain Landscaping and Lighting in an Existing Maintenance District". Director of Community Services Smith explained the creation of the Landscaping and Lighting District and the annexation of the West Ramona Lighting and Land- scape Maintenance District in July of 1966. He out- lined the estimated costs for 1988-89 and explained that rate adjustments have not been made in four years, A cost of living increase of 4% is recommended Mayor King declared the Public Hearing open on the Citywide Landscaping and Lighting District for FY 1988- 89 and invited those wishing to speak on this subject to come forward. Frank Ramirez, 4924 Wimmer, asked if the parks were included in the district, asked that the City take better care of the lights in the district, and commented on the total fees collected through this district. Frank Fitzgerald, 14802 Clydewood, commented on the good job that the landscaping people do in the City and expalined how to report burned out street lights. Herschel Keyser, 13645 Rexwood, stated that this is a tax in opposition to Proposition 62 and suggested that the money given to the Chamber of Commerce be used for the district. Justina Ramirez, 4924 Wimmer, commented on her tax bill confirming that there was no increase in the district for four years and suggested that the City cut back on its' use to lower costs. Mayor King declared the Public Hearing closed. It was moved and seconded to approve Resolution No. 88-59, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE ANNUAL LEVY AND COLLECTION OF ASSESSMENTS FOR CERTAIN LANDSCAPING AND LIGHTING IN AN EXISTING MAINTENANCE DISTRICT, PURSUANT TO THE PROVISIONS OF DECISION 15, PART 2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, FOR FISCAL YEAR 1988-1989". M/S/C: GIBSON/IZELL. There were no objections. 00- ANTHONY BEJARANO HERSCHEL KEYSER JUSTINA RAMIREZ CLOSED RESOLUTION NO. 88-59 ADOPTED REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES Director of Community Services Smith stated that the Capital Improvement Program before Council represetns a five year projection of major infra- structure and community improvement activities. He outlined the short term and long term objectives of the program and explained that the City would fund these programs by utilizing Federal Aid to Urban FAU) monies and Gas Tax GT) monies. The Council will receive new information and possible revisions regarding this program in the future. Council expressed their concern about the condition of the streets in the City due to overloaded trucks that travel on them and the need to repair the streets properly. They also commented on the need to up-date some of the street repairing equipment. It was moved and seconded to approve the Capital Improvement Program for 1988-1993 as presented. M/S/C: IZELL/MCNEILL. There were no objections. Director of Community Services Smith stated that staff had been in contact with Webster's Disposal regarding their advance billing practices. John Summer, from Webster's, was present at the meeting and requested to address the Council. John Summer, 528 Alexander, Glendale, representative of Webster's Disposal, explained that the previous manager of Webster's was no longer in Baldwin Park. Advanced billing procedures have been used by Webster's since the 1960's. This is done in order to control the skip" factor with people who move from the area and do not pay their trash bills. Webster's loss from this is about $5,000 a quarter. Mr. Summer and the Council discussed some alternatives to the advanced billing procedures, the retroactive fee that was collected, the pending appeal of the small claims action of Mr. Keyser's case, and possible ways of notifying the public of their rights regarding the retroactive charge. Herschel Keyser commented on the appeal that Webster's has initiated against his case and complimented Councilman Izell for asking the Council to join with him in this case. 00- HERSCHEL KEYSER ORAL COMMUNICATIONS Mayor King declared Oral Communications open and invited those wishing to speak on any subject to come forward. ORAL COMMU NICATIONS Aileen Pinheiro, 13009 Amar Road, spoke regarding the Civic Auditorium, the need for a wagon wheel and for more room at the museum, and the possibilty of the old funeral home being used for the museum. AILEEN PINHEIRO Justina Ramiraz, 4924 Wimmer, asked about the term All Agencies" on the property tax bills. JUSTINA RAMIREZ ANTHONY BEJARANO Anthony Bejarano, 3508 Big Dalton, spoke regarding the issuance of permits for developments and the inspection of projects, dangerous fences around projects, code enforcement, catering trucks, a store in the Pavilion and the police force. Herschel Keyser, 13645 Rexwood, spoke regarding the credit application proposed by Webster's and Webster's being a monopoly. HERSCHEL KEYSER Raul Reyes, 3160 Athol, spoke regarding the condition of the Senior Citizens' Center, the lack of funds for this, and possibly putting this issue on the ballot for bonds. RAUL REYES Pam Schnabel, 14217 Los Angeles Street, spoke concern- ing the horrible situation on her street with trucks driving there. PAM SCHNABEL Mayor King declared Oral Communications closed. 00- CLOSED It was moved and seconded to adjourn the regular meeting of the City Council at 8:49 p.m. to an adjourned regular meeting on Wednesday, June 8, 1988, at 7:00 p.m. in Room 307 of City Hall.
