ABSENCE EXCUSED Mayor King announced that Leauge, Chosan Detachment Unit will be sponsoring a Saturday, October 1, 1988 Park VFW Post. 00- the VFW Post, Marine Corps. and the Chosan Young Marines Flag Retirement Ceremony, at 10:00 a.m. at the Baldwin 00- Mayor King declared Oral Communications open on any subject and invited those wishing to speak to come forward. Edward Shanick, 701 S. 1st Avenue, #107, Arcadia, asked Council to take into consideration to allow the sale of pumkins be for a 30 day duration period as it is for the sale of Christmas trees as stated in the Baldwin Park Municipal Code Section 5.56.020 et. seq. Gilbert Cisneros, 3402 San Gabriel River Parkway, stated he had taken out permits for a room addition to his house, which he has been working on since October 1987, and when called for an inspection the Building Division told him his permits had expired due to the 180 day limitations and permits would have to be taken out again. He asked for an interpretation of the limitations of permits. City Attorney Flandrick stated, regarding the sale of pumpkins, the City will see if there was someway there could be administered approval for 30 days, if not, have this issue placed on the agenda of the next City Council Meeting. M/S/C: MCNEILL/IZELL. There were no objections. The following item was removed from the Consent Calendar for seperate consideration: Item No. 2 at the request of Councilwoman Lowes. Councilwoman Lowes requested that there be a correction made to the minutes of September 7, 1988, page 23, paragraph 1, last sentence. She stated the word aren't should be corrected to read are. It was moved and seconded to approve Item No. 2, with the correction to the Minutes of September 7, 1988 as requested by Councilwoman Lowes. M/S/C: LOWES/GIBSON. He stated the Planning Commission made several suggestions for dealing with the problem. He also explained that staff believes that the proposed 180 day period is reasonable, and the recommended amendment is necessary in order to correct an existing problem and protect the public health and safety. He stated that staff recommends that the City Council: 1) Aprove the Negative Declaration of Environmental Impact; and 2) Approve an ordinance amending Chaper 17.56 of the Baldwin Park Zoning Code. Mayor King declared the Public Hearing open on PUBLIC AZC-121 and invited those wishing to speak on HEARING this subject to come forward. OPEN Tony Bristol, respresentative for Texaco Distributor TONY in South El Monte, and operates a service station on BRISTOL Baldwin Park and Merced. He explained in order for them to comply should this be adopted it would be impossible due to the fact that they have less than the 20,000 square feet of lot area and do not see the possibility of additional property being bought. He stated that adoption of this rule will unfairly hurt other stations including their own. That if something could try to be worked out it would be equitable for everybody and things would be alot better, Kirn representative of the Texaco at 13852 Los Angeles KIM Street, stated she feels the signs put up has eliminated the problem. There has not been too many trailers comming by. Only on an emergency basis. City Attorney Flandarick stated that Staff and Council CITY have tried to solve the problem, but there are no ATTORNEY pratical way of dealing with this. Sandy Lucas, 14442 Bresee, stated signs have been SANDY posted at the service station on Los Angeles, but the LUCAS problem still exist. She also stated that she has seen for herself trailers that are still lining up all hours of the day and has taken pictures and has submitted them to Council. Mayor King declared the Public Hearing closed. CLOSED Councilman Izell stated he has witnessed trucks drive COUNCIL up on top of the curb, leaving the trailer hanging over the sidewalk. No attendant came out and did anything. It was moved and seconded to approve the Negative NEGATIVE Declaration of Environmental Impact. M/S/C: DECLARA- IZELL/LOWES. TION APPROVED It was moved and seconded to approve Ordinance No. ORDINANCE 997, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY NO. 997 OF BALDWIN PARK AMENDING CERTAIN OF THE CITY ZONING FIRST REGULATIONS RELATING TO AUTOMOBILE SERVICE STATIONS READING) CASE NO. Director of Housing and Economic Development Hemer explained that the public hearing is the last step required prior to submitting the GPR to HUD. In September 1988, the GPR was reviewed andd approved by the CDBG Advisory Committee with a recommendation to appropriate additional funding to the low interest Residential Revolving Loan Program when new funds become availabe. It is recommended that, following the public hearing, the City Council approve the GPR and instruct staff to incorporate any and all public comments into the final adopted GPR. Mayor King declared the Public Hearing open on the GPR 13th Year Community Development Block Grant CDBG) Program and invited those wishing to speak on this subject to come forward. There were none. Mayor King declared the Public Hearing closed, It was moved and seconded to approve the Grantee Performance Report GPR) 13th Year Community Development Grant CDBG) Program and incorporate any and all public comments into the final adopted GPR. There were no objections. 00- REPORTS OF OFFICERS, COMMISSIONS AND COMMITTEES City Manager Webb explained the Council and Chamber representatives made some progress, however, the committee has scheduled a meeting to take place the second week of October and hopefully finalize its recommendation to the Board of Directors and the City Council. 00- PUBLIC HEARING CDBG PROGRAM INTRODUCED STAFF REPORT PUBLIC HEARING OPEN CLOSED GPR REPORT APPROVED AB1693 DISCUSSED COUNCIL INITIATIVES Councilwoman Lowes asked that the Landfill be scheduled on the next to consider whether Council wants proposed Arcadia council meeting to take a stand. ARCADIA LANDFILL Councilwoman Lowes also stated she had an interest in the traffic flow on Los Angeles Street from these trucks that plan on going seven days a week for 20 to 30 years. Councilman Izell requested that the Chief of Police look into an ordinance prohibiting utility trailers, parked on the street, to remain unattended by the drivers. He suggested to look at the City of Pico Rivera's ordinance regarding this.
