COUNCIL OF CITY HALL, WEDNESDAY, The City Council of the City of Baldwin Park met in regular session in the Council Chambers at 6:00 p.m. ROLL CALL: PRESENT: COUNCILMEMBERS GALLEGOS, KEYSER, IZELL, MCNEILL AND MAYOR LOWES ALSO PRESENT: City Manager Penman, City Attorney Bowers, Acting Dir. of Administrative Services Cole, Acting Dir. of Human Services Rose, Chief of Police Lanza, City Treasurer Montenegro, and City Clerk Gair 00- REPORTS OF OFFICER, COMMSISSIONS AND COMMITTEES City Manager Penman requested that Steve Filarsky, the City's Labor Relation Attorney, present the Staff Report on the General Employees Request for Unit Modification and Recognition." Filarsky: By way of introduction I would just like to give you a brief history and explain why we are here this evening. A request for affiliation was filed by the Service Employees International Union, Local 347, seeking to change the current CLOCEA unit, which the City has recognized for approximately the last ten years. As a consequence of filing that petition for affiliation they opened up a challenge period for the unit recognition. The current CLOCEA unit represents Miscellaneous Employees in the City. Not included in that unit are sworn police and non-sworn police, and the managers and executive group in the City. So they represent all persons essentially lower than the mid-management level in both the City Hall areas and the City Yard areas. A unit consisting of approximately 78 or 80 employees. Subsequent to filing the Notice of Affiliation we were required to notify every employee that a challenge period was opened. We so provided that notice in writing to all the employees and we received a petition for recognition filed by a group of employees who seek to become the Professional and Technical Employees Association Unit in the City. This petition was signed by 27 of a possible 28 employees to be represented. The petition conformed to the requirements of the City * s Employer/Employee Relations Resolution. As a result of filing that petition we now have a hearing situation to determine whether that request for recognition by the Professional and Technical Unit should be granted. And the election would CON'T) most likely be conducted under auspices of the City Clerk's Office sometime within the next 10 to 14 days. The other part of the election process will involve the original petition for affliation, which was filed by Service Employees International Union, during which the employees that remain under the general unit will be voting on whether or not they want to affiliate with SEIU. The other alternative available to them is to vote for no representation. So, this evening, we have sent out, prior to the meeting, notice to the SEIU Employer Organization that this petition for recognition was filed by the Professional and Technical Unit, and have given them an opportunity to address the Council in a hearing situation, to voice whether or not, they approve or disapprove, of the proposed recognized unit. We requested them to notify us ahead of time of their position on the matter, so that we could be better prepared to handle whatever may come up. And as of this evening we have not heard from them one way or the other. With respect to the hearing process before us tonight, I suggest that we first hear from anyone in the audience that is opposed to the recognition petition filed by the Professional and Technical Unit. And I would suggest that we hear from them now. Then we hear from any proponets of the proposed unit who want to add anything additional. And then after hearing from everyone, we close the hearing and adjourn to Closed Session for determination by the City Council. Once that determination is made, we come back and announce a decision and take action on that decision this evening. With that, unless there suggest we open it up to Professional and Technical City Council. are any questions, I would any opponets of the proposed Unit who wish to address the Mayor Lowes declared the meeting open for Public Input and requested that anyone wishing to speak in opposition to the proposed Professional and Technical Unit to come forward at this time. There were none. Mayor Lowes then requested that anyone wishing to speak in favor of the proposed Professional and Technical Unit to come forward at this time. Rick Jojola, Acting President, association, stated the following: for the proposed We would like to thank the City Council for the opportunity to hear our request for recognition. Our intent in forming this association varies widely among the employees who signed the petition for recognition. But the major factor agreed upon by all who signed is the need for unity. By uniting as a group, we feel that we will have that opportunity to pool our talents and work for a common cause, which is improving the welfare of this City. Like the Management Association, our intent is to meet as a unit to discuss the ways and means of solving problems as identified and directed upon us by management.
