Acting Chief of Police Kies, Dir. of Public Works Mousavi. Dir. of Rec/Community Services Nunez. City Treasurer Montenegro. Deputy City Clerk Branek. and City Clerk Gair 00- Mayor Vargas stated that the Public Hearing on tonight's agenda will be continued to December 4th. 00- PRESENTATION Acting Chief of Police Kies announced that Police Sergeant Robert Delgado will be presented a Twenty Year Employee Pin at the December 4th Council meeting. Acting Chief of Police Kies told of the Academy's background, and the education offered to each participant. He introduced Officer Villines and told of the hours donated by Officer Villines with the academy participants. PAGE NO. 2 NOVEMBER 20, 1996 Nancy Sanchez. Graduate of the Citizens Academy, expressed the academy's appreciation to Council for providing programs like the Citizens Academy to the community. 00- ORAL COMMUNICATION Mayor Vargas declared Oral Communications open and invited those wishing to speak on any subject to come forward. Abel, Sequel Contractors, thanked Council for the opportunity to plea Sequel's case for the Baldwin Park Boulevard Street Reconstruction Project. He further stated that they are anxious to get started if awarded the contract. Shawn Smith. Sequel Contractors, 1224 Woodruff Ave, Downey, stated that Sequel appreciates the fact that other contractors will not have an opportunity to steal their bid advantages, because someone made a mistake. There being no other speakers, Mayor Vargas declared Oral Communications closed. 00- CONSENT CALENDAR The Consent Calendar consisted of the following: Mayor Vargas requested Item No. 8 be removed for separate consideration. 1. Approve Award of Contract Installation of Bikeway Routes CIP 606 Works Striping and Marking, Inc. 8. Approve Award of Contract Baldwin Park Boulevard Francisquito Avenue to Merced Avenue) Street Renovation Project CIP 604 Federal Project No. STPL-5323(004) Sequel Contractors. Inc. 9. Approve Appropriation of Funds City's Share of Sierra Vista High School Pool Maintenance $5,842.32 FY 1995-96 It was moved and seconded to approve the Consent Calendar Items No. 1-7 & 9 M/S/C: MUSE/LOZANO. There were no objections. Director of Public Works Mousavi requested Council reject all bid proposals submitted for the construction of Baldwin Park Boulevard between Francisquito Avenue and Merced Avenue, CIP 604. and instruct staff to re-advertise the contract. He explained the bid error that Excel Paving estimated which resulted in the second bidder, Sequel Contractors, Inc., being the lowest responsible bidder. Because of the irregularities, staff recommended that Council reject all bids and authorize staff to readvertise the project. Council requested staff obtain a legal opinion and staff requested the firm of Richards, Watson & Gershon to evaluate the circumstances and provide their findings. The firm confirmed staff's recommendation in accordance with provisions of the specifications, section g) of the Instruction to Bidders and reject all bids received for this project and authorize staff to readvertise the project for new bids. In response to Mayor Vargas. Director Mousavi stated that a copy is available pertaining to the mistake, and that it is on file in the Public Works Office. Excel Paving was the only bidder that made this mistake on the bid sheet. The number on the bid sheet was a 4, but it was read and looked like a 1. The copy that was received from Excel is a faulty copy. It was not clear if the mistake is the City's or the contractors. Excel's argument is, if they knew the quantity was 400 instead of 100. then they would have bid their quantity for a lesser price. If the bid is awarded to either contractor there may be a claim from the other contractor. Mayor Vargas stated that all information should be clear, and that he feels uncomfortable in approving the recommendation. If not for advise from Richards. Watson & Gershon he would award the bid to Sequel. He instructed staff to be sure before the bidders sign for their bid packet, that they understand the documents. If there is something that they do not understand, the contractors ask their questions before signing and leaving with the bid packet. In response to Councilmember Lowes, Director Mousavi stated that if the quantity was corrected it would be higher than the next lowest bidder. She stated that she does not see the problem awarding the bid to Sequel, and now everyone knows all the bids amounts. She agreed with Mayor Vargas that if it wasnt for the legal advise, she would vote to award the bid to Sequel. City Attorney Bower stated, if read correctly 1472, Excel is claiming that they would have bid a lower unit price, so that you can not take what they bid at the 1172 figure and multiply that out as if that were 1472. In response to Councilmember Lozano, Director Mousavi stated that if Council rejected the bids. a new bid proces will begin tomorrow and the same contractors are welcome to submit their bids. City Manager Yeats requested that an adjustment be made in the specifications to make the bid competitive again. In response to Mayor pro tern Muse, City Manager Yeats explained that Excel was willing to hold to the price, but that would allow them to change their bid. Mayor pro tern Muse requested a staff report on the measures that will be taken to prevent this type of error from happening in the future. It was moved and seconded to reject all bids and readvertise the project. M/S/C: MUSE/LOZANO. There were no objections. 00- PUBLIC HEARING Mayor Vargas introduced the Public Hearing pertaining to Amending Section 153.520, Billiard and Pool Hall Regulations" of the Baldwin Park Municipal Code Applicant: City of Baldwin Park; Case No: A2C-139." M/S/C: LOWES/LOZANO. There were no objections. 00- COUNCIL/STAFF REQUESTS Councilmember Lowes requested that staff contact the Metrolink and Judy Wright regarding the trains horns honking at 5:10 a.m. and 6:30 a.m. She felt that it is a matter of educating the engineers on the noise level of the horns. City Clerk Gair announced that Code Enforcement Supervisor Dozmati was one of two persons, out of fifteen that passed a difficult certification exam. He is now a Certified Code Enforcement Officer. Mayor Vargas stated that this weekend he noticed more graffiti in town. He stated that he wants to be sure that the graffiti is taken down quickly. He requested that all City employees fill out a report form to report graffiti when they are on their way to work, and those working out on the streets. The report forms should be carried in all the vehicles. In response to Mayor Vargas. Chief Kies stated that with regard to graffiti, the gang investigators work closely with the City Yard crew. they take photos regularly and gain intelligence information from that. Those are difficult cases to prosecute, because you have to have witnesses. With regard to gang activity, the gang investigators are working on it. and recently assigned a new detective from the detective bureau. The Special Enforcement Detail SED) has been reassigned to the patrol force. It is a temporary reassignment and he anticipates reinstating it soon. Councilmember Lowes requested the phone numbers for the Code Enforcement Office and Graffiti Hot Line be included on the Council business cards. Mayor pro tern Muse acknowledged that Directors Yeats. Nunez, and Mousavi participated in the American Heart Walk. there were 8 teams, and $1400 was raised for the fund. A total of $20.000 was raised. In response to Mayor pro tern Muse, Director Nunez stated that staff has been in contact with In-N-Out. and there has been some reluctance from Mrs. Snyder in having the Community Center named after her. She preferred that it be done as the corporation. He also stated that there are two things to be presented regarding the public art component. The first is an art class at the Community Center, that will consist of a number of senior citizens and they will be preparing a proposal. The proposal will be for materials and supplies. They will be contracting with a number of artists that will come in and assist. A sketch would be placed on location for the mural. Monies are available through SDC and it may not be enough to cover all the costs, but it could be incorporated into the marquee concept. Mayor Vargas and Mayor pro tern Muse stated that Council wanted something in individual places, proposals were to be brought back to Council, and that the utility companies are interested in funding that kind of art work. The inside of the rotunda is to be like a museum. It was requested that staff bring this to a Study Session so that Council can have input. Mayor pro tern Muse requested that customer surveys be available at all the public counters. Mayor Vargas requested that surveys be given to all the parents who have children that participate in recreation programs. Director Nunez stated that a general survey will be developed by staff and included in the Tuesday Status Report. 00- It was moved and seconded to adjourn the regular City Council meeting at 7:50 p.m. M/S/C: LOWES/MUSE.
