He is only the 107 Certified Code Enforcement Officer in the State of California. Mayor Lowes presented Supervisor Dozmati with an Award of Certification from the California Code Enforcement Corporation. Bob Baca, representative of Congressman Matthew Martinez' Office presented Code Enforcement Officer Dozmati with a Special Congressional Recognition Certificate. 00- ORAL COMMUNICATIONS Mayor Lowes declared Oral Communications open and invited those wishing to speak on any subject to come forward. October, 1996, he received a citation stating that he needed a Conditional Use Permit. He submitted 22 sets of plans, notified all the neighbors, and paid $1200 in fees. On March 24th he received a letter requesting a better set of plans. He has paid $12,000 to start the purchase of the property and wants to stay on the property. He will do what ever it takes to stay in business. He asked that someone answer his questions. Ricardo Pacheco, Baldwin Park, stated that if Council is not going to appoint someone to fill the vacant position the City will be in trouble. He received 1.800 votes during the last campaign, and asked his supporters to stand who want to see him appointed to the vacant Council position. He has a degree in engineering, a good reputation, and wants to see the City move forward. He asked that he be appointed. He feels that the City is better off after having Fidel Vargas as mayor. Conrado Magdaleno, Baldwin Park, stated that he is ready for the next election. If it is a special election, it can be conducted anytime, don't wait until November. He asked that Mr. Bill not do business with the City any longer; and that City Clerk Gair and City Treasurer Montenegro be neutral and help everyone that is running for office. Margarita Vargas, 14129 Ohio, stated that she read the letter in the Tribune that Mayor Lowes wrote which stated that every vote counts. She voted for Ricardo Pacheco and she wants him appointed. She further stated that CounciimemberVan Cleave is against bilingual translations. Dan Trunco, Baldwin Park, stated that Councilmember Van Cleave has stated that he does not want a rubber stamp to fill the Council seat. He asked how can Councilmember Van Cleave accuse Ricardo Pacheco of being a rubber stamp? That Councilmember Van Cleave was in the same spot as Ricardo Pacheco not long ago. Jody Castro, 13241 Emery, stated that the last time there was a vacant seat on council, Councilmember Van Cleave had to wait, that he could not be appointed. Councilmember Van Cleave asked that Paul Reyes be appointed to the vacant Council seat. Councilmember Van Cleave has done more for the City than anyone in the City. Mr. Nunez does a good job running the Community Center. Dennis Kies deserves the appointment as Chief of Police. Jesse Platta. stated that he spoke last meeting about appointing Mr. Pacheco. Mr. Pacheco has a good education. Mr. Reyes has run several times for office and never won. and Mr. Pacheco only lost by 100 votes. Oscar Sanchez. stated that he has known Mr. Pacheco since 1975 when he was a child and now he sees a man running for office. PAGE NO. 3 APRIL 16, 1997 Graciela Aguileria. Baldwin Park, stated that Ricardo Pacheco works with more than 250 youth at St. John's. He helps the youth prepare to go to college. She feels that hate has come to the City and she feels she lives in Nazi Germany and this upsets her. The City needs a Police Chief and the member on the City Council. Mr. Pacheco is not a Fidel Vargas puppet. Melissa Vargas. Baldwin Park, stated that Fidel Vargas was elected the first time 1992) by 1500 votes, the 1994 election by 2500. She supports the appointment of Ricardo Pacheco. Manuel Zamora, stated that he has lived here for 42 years. The Council is acting like children. He asked why Acting Chief Kies has not been appointed as Chief of Police because the City needs to promote from within. Nathan Esparza, Baldwin Park, stated that the two measures on the ballot clarified that the people like to vote and they do not want an appointment. He asked why Council doesn't appoint an independent, qualified person to the Council. If Council cannot find that person, then go to a special election. Listen to the people and solve the problem. Roy Test, 15115 Kenoak, asked everyone in the room to think about. If Mr. Pacheco was in Mr. Bill's position would Mr. Pacheco appoint Mr. Van Cleave. David Muse, 3575 Vineland, stated that the measures on the March ballot received the most votes. If a Councilmember runs for Mayor, that person should resign from their Council seat. The people of Baldwin Park are paying for the special election. He didn't vote to spend $40,000 for a special election and he did not see, on the last ballot, a place to vote for a special election. Mr. Pacheco is qualified and he came in third place. Leoria Richard, 3336 Millbury. stated that Council has an impasse and the City needs to get beyond this. Council has a responsibility to appoint someone, even appoint someone that did not run for Council. Mr. Pacheco did not win, so he lost. She does not support the appointment of Mr. Pacheco. The voters elected Council to do what is right, to find solutions. Mrs. Zamora, La Rica, stated that she is the mother of 3 children, and that wants a better community for her family. She supports Mr. Pacheco being appointed to Council. Marlen Garcia, Baldwin Park. stated that two Councilmembers refused to appoint Mr. Pacheco to the vacant seat. The voters did not vote for Paul Reyes. they voted for Ricardo Pacheco. Marsha Arkin. Baldwin Park, stated that the people have voted, and the vote was, we want to elect, no appointment, so conduct a special election. Susan Van Cleave, Baldwin Park, stated that people come into the Van Cleave hardware store daily, and that a number do support Pacheco. The majority want an election not an appointment. The amount of hardware sold to the City is minimal. Councilmember Van Cleave has been involved in the City. He was one of those that started Baldwin Park Beautiful which involves 60-100 kids picking up trash, and cleaning up weeds. The composition of those students is changing 90 % now Asian not Hispanic. She told of the committees that Councilmember Van Cleave is a member of and his desire to bring in new business to the City. Richard Garcia, 14404 Merced, asked what kind of message is the City sending to the kids. The City did not have enough candidates running for Council. The City does not attract businesses. He urged Council to put aside personal differences. He supports Ricardo Pacheco and Ten Muse. He commented on the number of police officers at the meeting and that they could be used on patrol Another City election is a waste of money. Mr. Siegfried, Baldwin Park, stated that he used the police department twice in the last month, and was glad they responded. He is an American and does not hate anyone, even though he may not agree with everyone. Patrick Mower, Baldwin Park, stated that the City does not seem like it is falling apart. He felt safe because the police attended the Council meeting. The people that lost the election lost. It has no bearing on the appointment. This is not a foreign country, the election represents the turning over of power without force. He agreed that there should be an election. He does not always agree with Council's decisions. Levi Richard, Puente and Merced, stated that the police department does a good pb and when he calls them he gets results. He lives 10 doors off Merced on MHlbury and there have been prostitutes there for years and he hopes they get out. He feels that Acting Chief Kies should have the position of Chief of Police. He supports an election, because there is no prize for anything but first place. The City should do business with Mr Bill's Hardware and with any other business in the City. The people need to shop Baldwin Park first. Sarah Van Cleave, Baldwin Park, congratulated the Council, that this is the most people to attend a meeting in two years. People were complaining about Mayor Lowes, but she was Mayor before. Mr. Van Cleave is her father, raised the family without prejudice. She supports a special election. The fact is. we may not know what the people wants since only 5.000 voted in the last election out of 72,000 residents. People want to be represented with streets that are repaired, clean city. and a safe community. People are afraid of change, and the community has changed a lot in the last 40 years Because people voted that the City Clerk and the City Treasurer should be elected, that does not mean that everyone wants an election. He asked where Council stands on Prop 208, 209, 218 and other issues. Hillel Arkin, Baldwin Park, stated that Mr. Vargas appointed him to the Personnel Commission and for two years they did not do anything. He asked where is the civil service commission and the police commission? There being no other speakers, Mayor Lowes declared Oral Communications closed. 00- REPORT OF OFFICER City Attorney Olivas requested Council adopt either a resolution appointing a new member to the Council or a resolution calling for a November 4, 1997 special election to fill the current vacancy. Council is mandated to either fill the vacancy by appointment or call a special election to fill the vacancy. If action is not taken, then Judicial intervention may be required to compel the council to make a decision. The court could order the Council to make a decision under threat of contempt of court or may order the council to set an election. It was recommended that Council decide to either adopt a resolution to appoint or call for a special election. If no action is taken, then instructions are needed concerning the filing of an action in court to compel the Council to decide. Mayor pro tern Muse stated that people have a right to their opinion, the election was only a month ago, and she does not want to spend money on an election. She supports appointing Ricardo Pacheco to fill the vacant Council seat. Councilmember Lozano stated that Mr. Pacheco is qualified to fill the vacant Council seat. He does not want to spend the money on an election, he would rather see the money spent on the youth or senior citizens. It was moved and seconded to appoint Ricardo Pacheco to fill the vacant Council seat. M/S: MUSE/LOZANO. Councilmember Van Cleave objected. Discussion: He stated that he is not prejudice. When he votes he will always try to do what has to be done and what is right. Mr. Pacheco has nothing but endorsements from Mr. Vargas and his supporters. ROLL CALL VOTE: AYES MUSE AND LOZANO NOES VAN CLEAVE AND LOWES Motion was rejected. It was moved and seconded to hold a special election on November 4, 1997. M/S: VAN CLEAVE/LOWES. Mayor pro tern Muse and Councilmember Lozano objected. In response to Councilmember Lozano, City Attorney Olivas stated that if nothing is done today, it would be a Judicial decision. The Judge is not likely to order an appointment, but could order the special election in November. The court costs are approximately $2,000 and if there were additional court appearances it could cost between $5.000 and $10,000. Mayor Lowes asked Council to vote to hold an election, rather than go before a Judge and pay the extra expense. Mayor pro tern Muse stated that she did not want to incur more expense by going to court, and named the things that could be accomplished with the money instead of using it for an election. The only thing to do is to abstain from voting and show that she disapproves of the election. Therefore she will withdraw her opposition and abstain from voting. Councilmember Lozano stated that he did not want to spend $60,000 for the election and the costs of the court. He stated that it is a waste of the money. He. too. will withdraw his opposition and abstain. In response to Mayor Lowes, City Attorney Olivas stated that with two yes and two abstentions the motion will carry based on case law and Roberts Rule of Order. It was moved and seconded to approve Resolution No. 97-23, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION ON TUESDAY. NOVEMBER 4, 1997, FOR THE ELECTION OF A MEMBER OF THE CITY COUNCIL TO FILL A VACANCY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES." It was moved and seconded to approve Resolution No. 97-24, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES CONSOLIDATE A SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 4, 1997, WITH THE SCHOOL ELECTION TO BE HELD ON THE DATE PURSUANT TO SECTION 10403 OF THE ELECTIONS CODE." ROLL CALL VOTE: AYES VAN CLEAVE AND MAYOR LOWES__________________ NOES NONE ABSTAIN MUSE AND LOZANO Motion carries City Clerk Gair stated for the information of the public that the Law states that the City must hold an election at the next regularly scheduled election. The City is too late for the June, 1997 election, therefore the City can only consolidate a special election on November 4. 1997. Law does not allow for an earlier. Director of Public Works Mousavi stated that the new vehicle is diesel and it would be utilized in the park. The vehicle is a larger size than what is currently being used. The vehicle uses a small amount of gas, like a lawn mower. The electric vehicle is three times as much in price as a diesel In response to Mayor Lowes, Director of Public Works Mousavi stated the size of the engine, that the gasoline engine may not be able to pull the load that the diesel can, and occasionally the vehicle will be used for pulling a load. Appellant: Jose Alcayaga; Location: 15007 Ramona Boulevard). Appeal Resolved Public Hearing Dismissed). 00- REPORTS OF OFFICERS. COMMISSIONS, AND COMMITTEES Management Assistant Fukushima requested Council award the contract to provide fixed route and demand responsive transit services to San Gabriel Transit SGT), as well as, authorize staff to finalize the agreement with SGT. A study of transit needs resulted in several changes to the current Program including, but not limited to 1) establishing a local fixed route shuttle providing service within the City; and 2) restructuring the existing diat-a-ride service by providing demand-responsive service using a combination of taxicab service and vans or minibuses to meet the needs of seniors, the disabled and residents who are unable to use the fixed-route service. Staff forwarded a request-for-proposal RFP) to fifteen operators. After staff evaluated all of the proposals and checked references it was recommended that Council approve the award of contract for transit services to San Gabriel Transit. In response to Mayor pro Tern Muse, Management Assistant Fukushima stated that four vehicles will be dedicated to the fixed route, and the vans will run every so often on the fixed route. Dispatching services will be provided for the residents. Mayor pro tern Muse stated that she wants a program built in that will let the people know that another van will be by if the van is full. In response to Mayor pro tern Muse, Director Mousavi stated that a design and color will be brought back to Council on the vans. The drivers will all be bilingual. Mayor pro tern Muse stated that she would like the ridership surveys to come back to Council and that a survey be done after six months of service. In response to Mayor pro tern Muse and Councilman Van Cleave. Duke Perrin, San Gabriel Transit stated that there is a four month delay ordering the gasoline engines, and the engines are convertible to propane. The vehicles can be converted at a cost of $3,500 each, that $736,000 is a lot of money, and that the company will consider the conversion at their expense. Vans have been ordered by a firm in Idaho and there may be a way to get those vans since a financial commitment has not been made. and they have the California smog equipment. The vehicles are all handicapped equipped, safety rails will be installed in each van, and that gasoline engines do not pull as much as diesel. Director Mousavi stated that the agreement for San Gabriel Transit will be brought back in two weeks for approval, the contact has not been finalized. It was moved and seconded to approve award of the contract for transit services to San Gabriel Transit and to bring back a contract to Council. M/S/C: MUSE/LOZANO. There were no objections. Director of Public Works Mousavi requested Council approve the plans and specifications for the construction of the Pacific Avenue and Howellhurst Drive Storm Drain Project and give authorization to the Los Angeles County Department of Public Works for its construction operation and maintenance Completion of the storm drain project will provide relief from flooding in the area bordered by Pacific Avenue, Puente Avenue and Havenbrook Street. The project includes the reconstruction of the intersection of Pacific Avenue and Ardilla Avenue in order to eliminate the dip along Pacific Avenue at the City limit. The Engineer's estimate is $200,000 for the portion of the project within the City and the County will administer the construction of the project. Funding for the project will be provided entirely by the County. It was recommended to be approved. It was moved and seconded to approve the plans and specifications for the construction of the Pacific Avenue and Howellhurst Drive Storm Drain Project and give authorization to the Los Angeles County Department of Public Works for its construction, operation and maintenance. M/S/C: LOZANO/MUSE. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS In response to Councilmember Lozano. Director Mousavi explained the work being conducted by the contractor on the Maine/Olive Street Storm Drain. In two months the storm drain will be completed. City Manager Yeats stated that he is working on a Report on Proposition 218 for Council. City Clerk Gair stated that in order to avoid politicizing our parade, the Southern California Band and Orchestra Association has agreed to have the annual parade on November 8th which is the week after the election. Council agreed by unanimous consent to hold a Study Session. 00- It was moved and seconded to adjourn the regular meeting of the City Council at 9:10 p.m. in memory of Jose Rodriguez, long time resident.
