The elements that comprise it, as well as the elements that the City would like to incorporate in the General Plan. Where the City is in terms of the General Plan update and the process the City would like to go through. The goal of the update of the General Plan is to have this plan in a more user friendly format. An RFP has been drafted for everyone to look at, to get input and move to next City Council meeting to have approved and start the process of the General Plan updating. City Attorney Olivas stated the 1971 Legislature required that cities adopt a General Plan. The General Plan is to be considered a blue print for development throughout the City. Not only does it have to be adopted, it has to be legally adequate. Legal adequacy means that it has to have the required elements, they must be consistent with each other. The process has to go by the Government Code beginning at Section 65300 concerning adoption, which requires a minimum of two public hearings, one before the Planning. There has to be proper notice and proper environmental analysis, whether it be a Negative Declaration or an Environmental Impact Report. All conditional use permits, variances, any land permits that the City approves must be consistent with the General Plan. The General Plan has to be updated periodically. Development Services Manager Hutar stated that the Government Code lists seven elements cities and counties must include in their general plans: land use, circulation, housing, conservation, open space, noise, and safety. City Planner Onaga commented on the Current General Plan. The current General Plan focused on residential density, and it was dropped to 20 units per acre. The City went to the Housing Element Update process and in 1994 a new Housing Element was adopted and it was accepted by State Department of Housing Community Development. The maximum density has not been changed in the R-3 zone. Instead of Citywide raising of the maximum density, the downtown area was selected to accommodate high densities. The RFP describes what the City wants the consultant to do. He summarized the Scope of Work which included a complete update of the General Plan, including the Environmental Impact Report. The elements listed in the RFP are the seven mandatory elements, although the open space and conservation would be combined. The RFP describes three optional elements which are economic development, community design, and air quality. The RFP requires the consultant to be bilingual. Staff is suggesting that a small committee that would include a couple of Councilmembers and staff be involved in selecting the consultant. Everything should conclude by May, 1998. In response to Councilmember Lozano and Mayor pro tem Muse, City Planner Onaga stated that the June, 1998 deadline has to do with the Housing Element. The consultant would play a major role in the community input process. A series of public meetings at various stages would be conducted. Surveys will be mailed to a cross section of the community to get additional input from people that cannot make it to the meetings. The surveys can take any number of forms. The consultant can prepare newspapers to go out to the community, to update people and to inform them when the next workshop would be conducted. In response to Mayor pro tem Muse, Director Cervantes stated that the outreach program can be as extensive as Council wants it to be. City Manager Yeats stated that Baldwin Park 2000 may need to be extended, and explained the survey to include comments on the General Plan. Mayor Lowes stated that on the last General Plan update the main focus was the housing element, because there was mixed up zoning and a moratorium was placed on building to redo the General Plan. Baldwin Park people wanted the very best in design, quality and space for a yard. She felt that this is still the peoples desire. She would still like to see the mixed use in a concentrated area rather than spreading the larger 25 units per acre. Director Cervantes stated that the trend nationally is to go to a smaller size lot. Parks have been identified within a quarter mile radius and see there is a deficiency in parks open space. With that benefit comes the cost for acquiring more park land, maintenance, operation, and all those issues. There are different ways to require space 1) develop a fee, if a developer wants to build some units, they would have to pay a fee that would go toward developing open space; and 2) build it within their development open space. Mayor Lowes felt that people want more open and not have gated communities. Mayor pro tern Muse asked if this would be the time to remedy the private streets? Councilmember Lozano stated that the City has 6.7 square miles and with 74,000 people the City will not have the resources available to maintain the current level that the City is at now. We need to concentrate in the area of single family homes. In response to Councilmember Lozano, Director Cervantes stated that the City has the potential, based on the codes, to build another 1,000 units. There are a lot of deep big lots, and under utilized space. Director Cervantes stated that in the City there are higher rate of owner Occupancy than estimated. In response to Commissioner Huetinck, Director Cervantes stated that the City could make a case of not increasing low income housing because the City has a higher occupancy of lower income people. We would not want to add more concentration. We have a lot of open space that we can still accomplish low and moderate income housing within a single family development.
