Mayor Lowes presented the proclamation to Pat Montgomery. President and Terrie Bickel, Chairman. Mike Salas introduced the Baldwin Park All Stars, 7th and 8th Grade Girls Basketball Team and told of their tournaments. Mike Salas presented a plaque to Sgt. Delgado, President of the Police Association, for sponsoring the team. Mrs. Corner thanked Council and the Police Association for their support. Mayor Lowes presented Achievement Awards to the team. 00- ORAL COMMUNICATIONS Mayor Lowes declared Oral Communications open and invited those wishing to speak on any subject to come forward. The Committee received applications from all over the San Gabriel Valley and interviewed the 12 finalists. Three employees from Baldwin Park were among the finalist. Erica Rodriguez was one of six people to be awarded a scholarship. Mrs. White told of Erica Rodriguez' background, education, goals and accomplishments. Erica Rodriguez, stated that she appreciates all the work Council has gone through and the improvements in the City. The things that the City has today is because of people that have a vision for the youth. Dick Tatum, Baldwin Park, stated that he has attended some controversial Council meetings. He appreciates the Baldwin Park Council for being punctual, because Pomona delays meetings if too many people attend. The last meeting he attended in Pomona was delayed two hours and adjourned quickly because it was late. There were no objections. 00- PUBLIC HEARINGS Mayor Lowes stated that the Public Hearing pertaining to An Appeal of the City Council relating to the Planning Commission Decision Pertaining to a Zone Variance Appellant: Alfredo Rodriguez; Case No: ZV 643; 3749 Grace Avenue)," was continued to May 21, 1997. Mayor Lowes introduced the Public Hearing pertaining to An Appeal of the City Council pertaining to the denial by the Planning Commission of Conditional Use Permit for the off-site sale of beer and wine. Owner: UNOCAL; Property Location: 1606 Puente Avenue; Case No: CP-560)." Planning Technician Schonborn stated that the applicant requested approval for a conditional use permit to allow the off-site sale of beer and wine with an existing service station and new 1,456 sq. foot mini-market. The approval of the conditional use permit to allow the off-site sale of beer and wine will over concentrate the census tract by allowing a total of 12 licenses, three licenses more than what is allowed by the Department of Alcoholic Beverage Control ABC). ABC will issue a license if the City can make a finding of public convenience and necessity. Tomson's Market is located within 200 feet of the subject property on the same intersection, and currently holds an active off-site license. Staff recommended Council uphold the Planning Commission's decision and, approve the Negative Declaration, adopt the Findings of Fact, approve CP-560 for the new 1,456 sq. foot mini-market, and deny the request for off-site sale of beer and wine. Mayor Lowes declared the Public Hearing open and invited those wishing to speak pertaining to the conditional use permit for the off-site sale of beer and wine to come forward. Scott Peotter. Project Manager for UNOCAL. explained UNOCAL's view on alcohol and the investment that UNOCAL is willing to make. He presented slides of the existing site and referred to 19 conditions that UNOCAL is willing to follow. UNOCAL is willing to locate an existing liquor license to the site. There being no other speakers, Mayor Lowes declared the Public Hearing closed. Councilmember Lozano, stated that he felt that the half million dollar investment is good, but he could not support the beer and wine sales. In response to Councilmember Lozano, Mr. Peotter stated that locations that have not been granted the beer and wine license UNOCAL has not funded. UNOCAL is doing the beer and wine sales because of competition. The sales of beer and wine are not that significant, it is a convenience and then the customer picks up chips and other items. Councilmember Van Cleave stated it is too convenient to get gas and get alcohol, and that he could not support the beer and wine sales. He referred to contaminated property by Target that UNOCAL will not clean up, and asked why should the City approve a beer and wine license since there has been no cooperation from UNOCAL. City Attorney Olivas advised that the contaminated property may be an issue, but the two issues should not be linked. Making a decision on the beer and wine issue should be separate. Mayor pro tern Muse stated that she was the sole person to vote against beer and wine sales at USA. The transferring of a license is creative, but it still leaves the area over concentrated. There is a need for a mini-mart in that area, but she could not support the sales of beer and wine. The calculations that are used is county wide and derived from the county population. It is based on a 10 year census. In response to Mayor Lowes and Councilmember Lozano, Mr. Peotter stated that they may be able to purchase a license within the census tract, then the net effect to the City would be no increase in the census. He explained the formula for the census tract used by the Alcoholic Beverage Control. He gave an example of the purchase of a license in the City of Stanton, that was bought as a full license and changed it to only beer and wine. It will be an investment to the community They are willing to relocate a current license. This would be an investment the City would not have otherwise and it would be located in a commercial zone. It was moved and seconded to approve Resolution No. 97 25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING AN APPEAL OF THE PLANNING COMMISSIONS DECISION TO ADOPT THE NEGATIVE DECLARATION, ADOPT THE FINDINGS OF FACT, APPROVE THE NEW 1,456 SQUARE FOOT MINI-MARKET, AND DENY THE REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW OFF-SALE BEER AND WINE." M/S/C: LOZANO/MUSE. Mayor Lowes introduced the Public Hearing pertaining to Approve the Annual Plan/Consolidated Plan for FY 1997-98 23rd Year CDBG Program and HOME Program." Director of Community Development Cervantes explained that the Annual Action Plan for the 23rd Year CDBG Program/Home Program under the Consolidated Plan. The estimated funds to be allocated under the Consolidated Plan were listed in the staff report. The purpose of the CDBG Program is to carry out activities benefiting the low and moderate income persons and eliminate blighted conditions in the City. The HOME Program was developed to expand the supply of decent, safe, sanitary and affordable housing to very low-income and low-income. He identified the $300.000 carry over funds. The recommendations of the CDBG Advisory Committee the City Manager and Executive Management Team were listed in the draft Plan. It was recommended that Council conduct the public hearing to approve the Annual Action Plan with or without modifications Mayor Lowes declared the Public Hearing open and invited those wishing to speak pertaining to the Consolidated Plan to come forward. Tim Varnum, Ettie Lee Youth & Family Services, reported on the diversion program, the percentage of people served by gender and ethnicity, and that two parenting classes are graduating this evening. Marsen, Baldwin Park Community Food Center, thanked Council for any assistance Council is willing to give this year He stated that the current NOW exaggerated the number served it is 800 per month Emergency food is only given to those that are homeless This is the Food Center's 11th year of operation. Gloria Nunez. Mano A Mano. stated that she was thankful for the opportunity to introduce the program to Council She summarized the services that they provide to the community Carol Lang, Services for Independent Living, stated that they have been servicing Baldwin Park for 5 years She told of the organizations mission and statement of their services. She explained what advocacy entails There being no other speakers, Mayor Lowes declared the Public Hearing closed. In response to Mayor pro tern Muse. City Manager Yeats explained that the Street Light Program was allocated to the Reserve Funds out of the Landscape and Lighting Assessment District in order to move funds for the Street Renovation Program Mayor pro tern Muse stated that under the Public Services section Baldwin Park 2000 was not included and she would like to continue the action plan throughout the whole City Monies are available from the Waste Management Recycling Program. Healthy Cities, and allocate $20,000 from CDBG Funds In response to Mayor Lowes and Mayor pro tern Muse, Management Assistant Mimura, stated that Baldwin Park 2000 would be classified under Planning Administrative Costs and would not fall under Public Services. There is a 20% cap on the Administrative Costs Public Services has a cap of $315,000. and the City is at the max now If the funding for BP 2000 is taken from Public Services, something would have to be sacrificed to stay under the cap Mayor Lowes stated that the Teen Pregnancy applied for $45.000, the CDBG Advisory Commission voted to give them nothing, but staff recommended $13,750 The funding is basically for salaries, copying of materials, and it is a service that is already available She recommended to delete $13,750 from the Teen Pregnancy Prevention Program and transfer Public Facilities for Baldwin Park 2000 Councilmember Lozano stated that the Teen Pregnancy Prevention Program said that there are problems and both genders are responsible. The Program Administration and the Planning and Building Capacity is limited to $415,000, which is already over the limit. In response to Mayor Lowes. Mr. Varnum replied that he had requested independent living skills for the Food Bank. but he was comfortable not receiving the funding as they found another source of funding. Mayor pro tern Muse explained that WINGS agreed to move into the Family Service Center. She proposed to reduce WINGS funding to $5,000. The East San Gabriel Valley for the Homeless reduce to $5.000. The Voucher Program be kept at $35,000. The changes would generate $12,750 that could be placed in Public Facilities and Improvements for Baldwin Park 2000. Management Assistant Mimura said that Fair Housing Council could be shifted from Administrative Costs to Public Services and that would free up $15,000 for Baldwin Park 2000. Mayor Lowes expressed her problem regarding Baldwin Park 2000 was because it was not mentioned for funding prior to tonight's meeting. Any project that wants to be funded should be brought up at the beginning of the process so that they can be evaluated prior to coming before the City Council. Mayor pro tern Muse felt that Council has the Job to make decisions, and applicants know that there can be changes in CDBG funding up to the last minute. The process in our community has been started and needs to be continued. The City has been nominated for the All-American Cities Award and Baldwin Park 2000 is one of the projects that's being recognized. Only one-quarter of the residents have been asked what they feel the needs are in the community. City Manager Yeats explained that Code Enforcement is budgeted for an additional officer, while we recruit for the officer and go through the process, there would be a salary savings of about $17,000, so that could be allocated into Baldwin Park 2000 survey. It is anticipated to use $15,000 of the Recycling money which would total $32,000. And, if the City wins the All-American Cities Award the City will receive a $10,000 grant, which would give the City enough to do the Baldwin Park 2000 survey. Healthy Cities will contribute $5,000. There are programs in the school that address teen pregnancies, but Council can direct Teen Pregnancy to do certain parts of their program. They do have a program that addresses parenting for fathers and parent responsibility for teen fathers. Mayor Lowes and Mayor pro tern Muse agreed that literature does not need to be handed out at games. Teen Pregnancy Program can set up a booth. Mayor pro tern Muse recommended that Joint Meetings be held with the Housing Commission and the Recreation/Community Services Commission for the opportunity to make site visits of these agencies, meet the staff, and make that a part of the proposal or funding. It was moved and seconded to approve staff's recommendations, adopt the Annual Action Plan and to include $50,000 for Baldwin Park 2000. M/S/C: LOZANO/MUSE There were no objections. Mayor Lowes introduced the City Council Public Hearing pertaining to the Approval to transfer the title and parcel of City owned land located at 14337 Merced Avenue Assessor's Parcel Number 8554-027-906) to the City's Redevelopment Agency to facilitate an affordable housing development." Director of Community Development stated that D.C. Corporation is proposing a nineteen 19) unit single-family residential development, of which eight 8) of the units will be sold to low and moderate income homebuyers. The Agency has removed approximately 140 dwelling units as part of Redevelopment Projects. The City is obligated to provide replacement units. The proposed eight 8) units will help in the replacement program. The blighted condition that currently exists on the Merced property will be eliminated. Staff recommended Council approve the transfer of the title and parcel of land located at 14337 Merced Avenue to the Redevelopment Agency. Mayor Lowes declared the Public Hearing open and invited those wishing to speak pertaining to the transfer of title and parcel of land to come forward. There were none. It was moved and seconded to approve Resolution No. 97- 26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A TRANSFER OF THE TITLE AND PARCEL OF LAND LOCATED AT 14337 MERGED AVENUE TO THE REDEVELOPMENT AGENCY AND MAKING CERTAIN FINDINGS HEREWITH." State law does not allow the County's General Fund to fund the Fire Department due to its special district status. Without the resources, fire protection and paramedic units may come from farther away. delays may occur, and support units may not be available. A special tax will appear on the June 3rd ballot as Proposition E. The special tax would be $48. a slight reduction from the current assessment. Vacant land will be assessed, and the annual increases would be capped at CIP or 2%, whichever is less. Only registered voters in those areas where the special tax would be levied are allowed to vote. The special tax requires two-thirds voter approval to pass. Staff recommended Council approve the resolution supporting Proposition E. City Manager Yeats introduced Area Fire Chief Lockhart. B It was moved and seconded to approve Resolution No. 97- 27,"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS SUPPORT FOR PROPOSITION E, A SPECIAL TAX REPLACING THE CURRENT BENEFIT ASSESSMENT THAT HELPS FUND THE LOS ANGELES COUNTY CONSOLIDATED FIRE DEPARTMENT." M/S/C: LOZANO/MUSE. There were no objections. Assistant to the City Manager Roessler requested Council approval of a General Fund allocation of $5,000 to offset the cost of sending a delegation to the All-American City competition. The City of Baldwin Park has been named as one of thirty finalist for All-American City designation. The All-American City competition is the nation's most prestigious award for grassroots, community problem solving. The 48-year-old award recognizes ten communities each year for cooperatively tackling challenges and achieving results Staff recommended approval. Letters of donations have been sent to 100 people It was moved and seconded to approve a $5,000 General Fund allocation to offset All-America City Award competition expenses. M/S/C: VAN CLEAVE/MUSE. There were no objections. City Manager Yeats explained that the All-American Cities Award is awarded for problem solving at the grass roots level, involving the schools, residents, and businesses. The City has a good chance of winning the award, he felt. The fixed-route shuttle service is available to the general public at a cost of $ 25 per passenger. The dial-a-ride service will also be available to the general public at a cost of $ 50 per passenger for travel to areas within the city limits and to selected medical facilities outside the city. Finally, the taxicab service will be available to seniors and disabled persons at a cost of $1 for the first 4 miles and $1.80 per mile thereafter. The aggregate amount to provide these services is $663,500. Prop A funds will be used to provide for these services. It was recommended that Council approve the agreement. It was moved and seconded to approve the agreement with San Gabriel Transit for transit services. M/S/C: LOZANO/MUSE. There were no objections. 00- COUNCIL/STAFF REQUESTS AND COMMUNICATIONS Councilmember Van Cleave requested a Council booth for all celebrations in the park. Mayor Lowes requested handouts be available to Council to pass out at the Council booth. In response to Councilmember Lozano, Marina Montenegro stated that her mother, Ana Montenegro, was recovering from her surgery so well that she has gone to Arizona for her nephew's first communion. Mayor pro tern Muse requested: 1) Staff to keep Council informed about what can be done to support the Library; 2) The Council minutes be put on the Internet. City Manager Yeats stated that staff is attending a computer show in Las Vegas with direction to look at all the internet process with the soft ware; 3) Work with the Director of Public Works and the Director of Recreation/Community Services on the Outdoor Tree House at Barnes Park Council agreed by unanimous consent; 4) Staff send a letter in support to continue the daytime curfew. Council agreed by unanimous consent; 5) Revise the Community Center Corporation to tap into foundation monies and to work with Mayor Lowes, City Manager, and the Director of Recreation/Community Services. Council agreed by unanimous consent; and 6) Everyone to attend the Community Garden, bed building day on May 24th. City Attorney Olivas will start a project, at no cost to the City, with the high schools for the Future Lawyers of Baldwin Park. He told of the classes he would offer, the mock trial, and a graduation luncheon. That was the Silhouette Baton Club.
