The CITY COUNCIL of the City of Baldwin Park met In REGULAR SESSION at the above time and place. ROLL CALL KAISER PERMANENTE TAX EXEMPT STATUS NEIGHBORING CITIES WORKING TOGETHER ANNOUNCEMENTS FROM SENATOR SOLIS' OFFICE ANNOUNCEMENTS FROM ASSEMBLYMAN GALLEGOS Present: Councilmembers: Manuel Lozano, Ricardo Pacheco, Ten Muse, and William Bill" Van Cleave Absent: Mayor Lowes was absent/unexcused. Also Present: David Olivas, City Attorney; Richard A. LeGarra, Chief of Police; James B. Hathaway, Director of Finance; Ralph Nunez, Director of Recreation and Community Services; Steve Cervantes, Director of Community Development; Ana Montenegro, City Treasurer; Kathryn V. Tizcareno, City Clerk and Rosemary M. Ramirez, Deputy City Clerk PUBLIC COMMUNICATIONS Al Contreras, Baldwin Park, referred to an article in the Tribune that Kaiser has not paid property taxes in the last four years due to their status as Non-profit Organization. Mr. Contreras feels that Kaiser is not a Non-Profit Organization and that they Kaiser) should pay taxes, of which the City could be receiving $2,000,000.00 in tax revenue. Conrado Magdaleno, stated, that Kaiser Hospital has always been a Non-Profit Organization. Councilman Elect Mark Breceda, Irwindale, congratulated Mayor Lozano and Councilman Pacheco and Councilwoman Elect Linda Gair on their election/re-election, and looks forward to a positive working relationship with the Baldwin Park City Council. Robert Barajas, Senator Hilda L. Solis' Office, said Senator Solis will host a Health Fair and House Conference on March 20th at Kaiser. There will be speakers such as Sharon Davis, who will discuss leading causes of death and disease in women and various women's health issues. There will be screening for diabetes, hearing, vision, mammograms, and blood pressure. Also, when you see an oncoming car with no headlights and you flash your own lights, it is a gang symbol where the first person does that is indicating that you're a target and they could follow you and could harm you. She also warned about people who impersonate AT&T service technicians who call and ask you to dial 90#. If you do this, you allow the person on the other line to make long distance calls and have it charged to you. Volunteer Income Tax Agency will offer free help with the preparation of tax forms for low income, elderly, and non-English speaking people. Frances Serpa, Baldwin Park, inquired as to why her husband's ballot was not counted. George Marr, Baldwin Park, reminded the Council of the traffic conditions on Vineland and asked that this matter be addressed as soon as possible. Hermina Llamas, Los Angeles Street, Baldwin Park, complained about a resident who lives in front of Geddes School who has claimed ownership of the sidewalk in front of this particular home. She feels the owner of the home should not fight for the sidewalk since it belongs to the City. Roy Tess, Baldwin Park, emotionally expressed his anger as he referenced a recent political mailing he received. Lillian Mower, Baldwin Park, is upset over the political mailing she received in the mail. Larry Walton, Baldwin Park, hopes Council will increase the Police Department with officers. He believes that we should consider D.A.R.E. programs in the 7th, 8th, and 9th grades, since these are the grades where we are losing the kids to gangs. Larry Walton wished to thank the Council for their help to the Little League. Marlen Garcia expressed her appreciation to Ms. Teri Muse her sincere dedication and service to the people of this Community. Ms. Garcia hopes the Council will vote to appoint Ms. Muse to the City Council Vacancy. Those who spoke in favor of a Special election are as follows: Larry Walton, Patrick Mower and George Man". Patrick Mower, Baldwin Park, also received the same horrible flyer. He blamed Manuel Lozano for these flyers. He emotionally expressed his anger in that La Raza has something to do with some of the candidates who won the election. He is upset with the turning over the election process to Foreign Power". Mayor Pro-Tern Lozano exclaimed that he was very offended with the terms La Raza" and Foreign Power" which is a racist comment and stated that he Mayor) will not tolerate any racism in this chamber nor in this Community. Emily Loeb, Baldwin Park, recited the poem on the bottom of the Statue of Liberty, and said the ethnic heritage is our power. Marlen Garcia, 14404 E. Merced Avenue, Baldwin Park, rebutted comments made by Mr. Mower saying she is willing to bear arms to defend her and everyone's rights in this Country. Pilar Carranza, Garvey apartments, Baldwin Park, thanked Councilmembers Lozano, Pacheco, and Muse for their support with the apartment situations. CONSENT CALENDAR David Olivas announced an amendment of Consent Calendar, Bell South Contract, which amends term of 1-year contract between the City of Baldwin Park and BellSouth Wireless with option to renew 2nd and 3rd year contracts which was a negotiated term. City Clerk Tizcareno presented the Consent Calendar as follows: The Certificate of Posting for March 3, 1999 was approved. AND BELLSOUTH WIRELESS DATA PARK". Councilman Van Cleave abstained on all warrants to Mr. Bill's Hardware financial conflict of interest). City Council approved the plans and specifications and authorized staff to advertise and solicit bids for the construction phase of the project at an estimated cost of $310,000, of which funds have been set aside as part of the Capital Improvement Program and CDBG funds FY 1998-99. Council adopted Resolution No. 99-16 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO. 99-2 A CLASSIFICATION PLAN FOR THE CITY'S CLASSIFIED AND UNCLASSIFIED POSITIONS"; and, Waive further reading and adopt Resolution No. 99-17 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION 99-3 A BASIC SALARY PLAN FOR THE EMPLOYEES OF THE CITY OF BALDWIN PARK". Council approved to renew the contract with Irwindale Police Department for their use of the City of Baldwin Park's jail facility. Council adopted Resolution No. 99-18 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK RELEASING JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT FUNDS TO THE COUNTY OF LOS ANGELES" and, approved the release of its funds under the Juvenile Accountability Incentive Block Grant JAIBG) to the County of Los Angeles, so that consolidation of allocated funds between neighboring cities will provide for the contracted services of a prosecutor from the Los Angeles County District Attorney's Office for vertical prosecution of serious juvenile offenders. An agreement was approved between the City of Baldwin Park and Spillman Technologies, Inc. in the amount of $192,065, as allowed by Section 34.23 C) of the Baldwin Park Code of Ordinances; and, approve the agreement between the City of Baldwin Park and BellSouth Wireless Data, LP, in the amount of $47,900, as allowed by Section 34.23 B) of the Baldwin Park Code of Ordinances. MOTION: Councilwoman Muse SECOND: Councilman Pacheco Motion Carried. COUNCIL/STAFF REQUESTS AND COMMUNICATIONS NELL SOTO RECOGNITION Councilwoman requested that the City prepare a plaque honoring Assemblywoman Nell Soto for her long years on the Pomona City Council and AQMD years also. TRAFFIC FORUM MEETING CHIEF'S FORUM TARGET DONATION ADJOURN Chief LeGarra informed the Council that there would be a traffic forum at the Community Center on Monday, at 6:30 p.m. to discuss private insurance at the intersection of Baldwin Park and Ramona and on March 24th, at 6:30 p.m. at the Community Center, Chief LeGarra also reminded the Council of the Chiefs Forum to be held on March 24,1999 at 6:30 p.m. at the Community Center. The new helicopter will be on display. Ralph Nunez was happy to report that he had received a check from Target for a grant that will benefit the little league of approximately $200 and a new scoreboard for their fields.
