The CITY COUNCIL of the City of Baldwin Park met in REGULAR SESSION at the above time and place. ROLL CALL Present: Council Members: Linda Gair, Ricardo Pacheco, Bill Van Cleave, Mayor Pro- Tem Marlen Garcia, and Mayor Manuel Lozano Also Present: Arnold Alvarez-Glasman, City Attorney; Dayle Keller, Chief Executive Officer; Mark Kling, Chief of Police; Jose Sanchez, Finance Director; Shafique Nayier, Public Works Director; Rick Forintos, Community Development Director; Manny Carrillo, Recreation/Community Services Director; Kathryn Tizcareno, City Clerk and Rosemary M. Contreras, City Treasurer; and Kathleen Sessman, Deputy City Clerk ANNOUNCEMENTS Mayor Lozano requested that this meeting be adjourned in the memory of Deputy David March, who was killed during a routine traffic stop. Councilmember Gair requested that this meeting be adjourned in the memory of her good friend Virginia La Mascus who lost her battle to bone cancer. Councilmember Gair stated that Ms. La Mascus was a 40-year member of the Church of Christ in Baldwin Park. Councilmember Pacheco announced the newly produced cable television show, Baldwin Park Today" noting that the first segment of the show is now showing on the Baldwin Park cable channel. ts Councilmember Gair announced that the Baldwin Park Chamber Choir recently attended a major competition in San Francisco and won awards in the following categories: 1st place; Gold Medal; and the Adjudicated Award, meaning that they were scored by all judges in the range of 95-100%. Mayor Lozano invited the participants to attend a future City Council Meeting for recognition and presentation of a plaque. Councilmember Gair will contact Chorus Director so arrangements can be made. Councilmember Gair congratulated Councilmember Pacheco on his appointment as Public Works Director of the City of South Gate. The following individuals spoke on behalf of the Community Union, respectively, Larry Ortega, 1649 Flannigan St., Ontario); Gabriel Chavez. 652 W. Granada Ct, Ontario); Raul Sanchez, Victorville, CA); Lesley Soto, 3108 Robinette Ave., Baldwin Park); Ricardo Baretta, 1350 Dahlen. Baldwin Park); Rosa Soto, 3108 Robinette, Baldwin Park; Mario Perez, 3000 Vineland Ave., Baldwin Park); David Villegas, 13240 Waco, St., Baldwin Park); John, La Mirada, CA); Eva Guerrero, 3515 Elwin. Baldwin Park); Maria Elena Rivera, Baldwin Park resident); Dan Trunco, Walnut St., Baldwin Park); and Eliazar Ramirez, 11449 Olive St., Baldwin Park) regarding the benefits, successes and funding needs of the Community Union Program. Mayor and City Council stated that as a result of Federal funding cuts. funding had to be cut from certain organization and the Community Union is one of those organizations. It was further noted that Community Union has an opportunity to apply to various agencies for grant funding, all members have offered to assist Community Union in their search for grant funding. APPROVAL TO PARTICIPATE IN THE 2002 SUMMER LUNCH PROGRAM GOO^O) The City Council appointed the Director of Recreation and Community Services as an agent. The Director of Recreation and Community Services was authorized to conduct all negotiations, execute and submit all documents including, but not limited to, applications, agreements, payment request and so on, which may be necessary to administer the grant. APPROVAL OF AN ALLOCATION OF ADDITIONAL FUNDS FOR THE AGREEMENT WITH KORVE ENGINEERING FOR CONSULTANT SERVICES TO ASSIST IN THE BALDWIN PARK TRANSIT BUS PROCUREMENT &oo-30) The City Council authorized staff to allocate an additional $2.500 of Proposition A funds to Korve Engineering to complete the bid specifications for the purchase of larger buses for Baldwin Park Transit. JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT 390-35) The City Council approved the release of $14.614 in Juvenile Accountability Incentive Block Grant JAIBG) funds to the County of Los Angeles, for the purpose of creating a consolidation of allocated funds between neighboring cities, thus providing for contracted services of a prosecutor from the Los Angeles County District Attorney's Office. The Deputy District Attorney assigned from these funds will specifically be used for vertical prosecution of serious juvenile offenders). The Chief Executive Officer was authorized to execute the WAIVER OF DIRECT SUB GRANT FROM UNIT OF LOCAL GOVERNMENT form. Director Naiyer responded to inquiry stating that staff is waiting for validation from the code regarding the pending Gas Tax issues. Director Naiyer also indicated that by the end of the 90% of the Crt/s streets would be completed. The City Council approved the plans and specifications and authorized staff to advertise and solicit bids for the FY 2001-02 ISTEA Street Improvement, CIP 801. MOTION: Councilmember Gair SECOND: Mayor Pro Tern Garda Motion Carried DOWNTOWN MASTER PLAN TIMELINE AND DESIGNATION OF COUNCIL PROJECT AD HOC COMMITTEE AND PROJECT STEERING COMMITTEE GOO-SO) Chief Executive Officer noted a change of date of the Public/Community Workshop from 29th of May to May 30, 2002. There were no objections. A motion was made to appoint Councilmember Pacheco and Mayor Pro Tern Garcia as Council representatives for the Downtown Master Plan Project Ad Hoc Committee. E- Team staff was directed to seek two volunteers each from the Planning, Recreation and Community Service and Housing Commission to serve on the Downtown Master Plan Project Steering Committee. MOTION: Councilmember Pacheco SECOND: Mayor Pro Tern Garcia Motion Carried APPROVAL OF RESOLUTION OF INTENT TO CREATE A CITYWIDE PARK MAINTENANCE ASSESSMENT DISTRICT OVERLAY AND ASSESSMENT FEES 360-30) Councilmember Gair expressed her support for putting this before the people. She stated that it is going to take strategizing and hard work to present the benefits and purpose of this 50% fifty-percent) increase to property owners and get them to vote yes. She suggested a committee be formed as an outreach regarding this issue and suggested that they start strategizing and promoting. Director Sanchez responded that at present at least two public meetings are planned to be held at the Community Center with staff from various departments available to inform, educated and update the community as to various improvements that have been made in the last five years since the formation of the Park Assessment District, the cost increases that have taken place and the future planned improvements that have been proposed. Director Sanchez stated that the purpose is to bring information addressing why this increase is being proposed and what benefits it will hold for the community and property owners. A motion was made to waive further reading, read by title only and adopt Resolution No. 2002-045 entitled. A motion was made to waive further reading, read by title only and adopt Resolution No. 2002-046 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR STREET PARK MAINTENANCE IN THE CITYWIDE PARK MAINTENANCE ASSESSMENT DISTRICT IN THE CITY OF BALDWIN PARK." MOTION: Mayor Pro Tern Garcia SECOND: Coundlmember Pacheco Motion Carried APPROVAL OF RESOLUTION ESTABLISHING THE CITY'S POLICY FOR THE ISSUANCE OF FIREWORK PERMITS PURSUANT TO SECTION 93.06 OF THE BALDWIN PARK MUNICIPAL CODE 640.20) A motion was made to approve Exhibit A-1, a straight lottery in which every applicant is qualified for a permit and the first fourteen organizations chosen by lottery will receive permits. MOTION: Coundlmember Van Cleave SECOND: Coundlmember Gair Motion Failed NOES: Coundlmember Pacheco; Mayor Pro Tern Garcia and Mayor Lozano Coundlmember Van Cleave expressed support for the lottery but feels it inappropriate and unfair to categorize organizations. He supports option 1 and feels a straight lottery would be a better process for all parties involved. Coundlmember Pacheco stated that new organizations want to participate and learn the process. He further stated that an emphasis should be placed on youth programs. Coundlmember Gair inquired what happens in the event that there are not enough applicants in a group for the number of permits available. Assistant to the Chief Executive Officer Bouton responded to inquiry stating that in such an event the remaining permit or permits will be allocated in a general lottery of all the applicants who did not receive permits in the group drawings. Mayor Lozano stated it is the time for change, in the past this process was restricted for specific groups. He further expressed his desire to allow other organizations the opportunity to participate. A motion was made to waive further reading, read by title only and adopt Resolution No. 2002-042 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ESTABLISHING THE CITY'S POLICY FOR THE ISSUANCE OF FIREWORK PERMITS PURSUANT TO SECTION 93.06 OF THE BALDWIN PARK MUNICIPAL CODE."
