The CITY COUNCIL of the City of Baldwin Park met in REGULAR SESSION at the above time and place. ROLL CALL Present: Councilmembers Linda Gair, Ricardo Pacheco, Bill Van Cleave, Mayor Pro-Tern Marlen Garcia, and Mayor Manuel Lozano Also Present: Dayle Keller, Chief Executive Officer; Arnold Alvarez-Glasman, City Attorney; Mark Kling, Chief of Police; Jose Sanchez, Finance Director; Shafique Nayier, Public Works Director; Melecio Picazo, Interim Community Development Director; Manny Carrillo, Recreation/Community Services Director; Dolores Gonzalez-Hayes, Housing Director; Maria A. Contreras, City Treasurer; Kathryn Tizcareno, City Clerk; Rosemary M. Ramirez, Chief Deputy City Clerk and Kathleen Sessman, Deputy City Clerk PROCLAMATIONS, PRESENTATIONS AND COMMENDATIONS A proclamation was presented to Janet Reese, Assistant Superintendent of Adult and Community Education, John Ken-Vice Principal, and Denise Tornatore proclaiming March 17-21, 2003 as Adult and Community Education Week. Chief Kling introduced newly appointed Police Department employee, Officer Richard Reynaga. TRIBUTE TO RETIRING COUNCILMEMBER LINDA GAIR Presentation for Councilwoman Gair's retirement from office. A surprise tribute to retiring Councilmember Linda Gair was made. Councilmember Gair was presented with awards and certificates of commendation acknowledging her years of municipal service and public official service PUBLIC COMMUNICATIONS Richard Iniquez, thanked Councilwoman Gair for her contributions and dedication to the City and residents of Baldwin Park. Mr. Iniquez expressed concern with the increasing amount of graffiti and gang activity throughout the City. Mayor Lozano directed Chief Kling to schedule a meeting with Baldwin Park School Police to address this matter. CONSENT CALENDAR APPROVED A motion was made to approve Consent Calendar Item Nos. INITIATING PROCEEDINGS FOR THE 2003-2004 LEVY OF ANNUAL ASSESSMENTS FOR THE CITY OF BALDWIN PARK LIGHTING AND LANDSCAPING MAINTENANCE DISTRICT, AND ORDERING THE PREPARATION OF A REPORT PURSUANT TO THE PROVISIONS OF DIVISION 15. PART 2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA," was waived. RESOLUTION APPROVING PROGRAM SUPPLEMENT AGREEMENT NO. M006 TO ADMINISTERING AGENCY-STATE AGREEMENT NO. 07-5323 FOR THE CONSTRUCTION OF VARIOUS CITY AND ISTEA STREETS Further reading was waived, read by title only, and Resolution No. 2003-014 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING PROGRAM SUPPLEMENT NO. M006 AND ADMINISTERING AGENCY-STATE AGREEMENT NO. 07-5323 FOR THE IMPROVEMENT OF VARIOUS STREETS," was adopted. RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO FILE AN APPLICATION AND DESIGNATING THE SIGNATURE AUTHORITY FOR THE 2003-2004 FUNDING CYCLE OF THE STATE DEPARTMENT OF CONSERVATION BEVERAGE CONTAINER RECYCLING GRANT Further reading was waived, read by title only, and Resolution No- 2003-011 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO FILE AN APPLICATION FOR AND SERVE AS SIGNATURE AUTHORITY FOR THE PURPOSE OF RECEIVING 2003- 2004 FUNDING OF THE STATE DEPARTMENT OF CONSERVATION BEVERAGE CONTAINER RECYCLING GRANT," was adopted. AWARD OF CONTRACT FOR THE CONSTRUCTION OF MERGED AVENUE AND BIG DALTON AVENUE IMPROVEMENTS, CIP 878 The City Council awarded the contract to E.C. Construction Company in the amount of $379,790.14 for the construction of Merced Avenue and Big Dalton Improvements, CIP 878. The Mayor was authorized to execute the Agreement. The Director of Public Works was authorized to execute any necessary change orders in an amount not to exceed ten percent 10%) of the original contract amount. The Mayor was authorized to execute the Agreement. Staff was authorized to appropriate $28,260 from the Landscape and Lighting Assessment District for this project Account 121.53.5020). APPROVAL OF A TWO 2) YEAR CONTRACT EXTENSION FOR ENGINEERING SERVICES FOR THE PARK MAINTENANCE ASSESSMENT AND LIGHTING AND LANDSCAPING ASSESSMENT DISTRICTS BERRYMAN AND HENIGAR The City Council approved a two 2) year Contract Extension with Berryman and Henigar in an amount not to exceed $9,200 for the Park Maintenance and Lighting and Landscaping Assessment Districts for FY 2003-04 and 2004-05. The Mayor was authorized to execute the Agreement. PUBLIC HEARING PUBLIC HEARING TO CONSIDER A RESOLUTION AUTHORIZING THE CITY OF BALDWIN PARK TO ESTABLISH FEES FOR THE RECOVERY OF MUNICIPAL NPDES RELATED COSTS Mayor Lozano declared the public hearing OPEN for public participation. There was no one wishing to speak, therefore Mayor Lozano declared the public hearing CLOSED. A motion was made to waive further reading, read by title only, and adopt Resolution No. 2003-006 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, ESTABLISHING FEES FOR THE RECOVERY OF MUNICIPAL NPDES RELATED COSTS." MOTION: Mayor Lozano SECOND: CouncilmemberVan Cleave Carried PUBLIC HEARING TO CONSIDER AN ORDINANCE AMENDING CHAPTER 110 OF THE BALDWIN PARK MUNICIPAL CODE, TO UPDATE REQUIREMENTS FOR BUSINESS PERMITS." A motion was made to OPEN and CONTINUE the public hearing to March 19, 2003. MOTION: Mayor Pro Tern Garcia SECOND: CoundlmemberGair Carried COUNCIL STAFF REQUESTS AND COMMUNICATIONS GRAFFITI Mayor Lozano expressed his concern with the increase in the amount of graffiti seen throughout the City. He requested that Chief Kling meet with the Baldwin Park School Police in an effort of working together to assist enforcement of this issue. There were no objections. IMPLEMENTATION OF AN OUT OF ORDER STREET LIGHTING REPORTING Councilmember Pacheco inquired about out of order streetlights and suggested implementing a process that would address a quick response time for repair and/or replacement of out of order streetlights. He also inquired as to the identity of Southern California Edison's light pole standards. GANG ORDINANCE RECEIVED FROM LOS ANGELES Mayor Pro Tern Garcia commented on possibly using the ordinance received from Los Angeles regarding enforcement. There was no further discussion on this matter POLITICAL SIGN REMOVAL Councilmember Gair requested that code enforcement enforce the City's ordinance regarding the removal of political signs. There were no objections. BALDWIN PARK HIGH SCHOOL STUDENT WALKOUT City Clerk Tizcareno inquired on the Baldwin Park High School Student Walk-out. Chief of Police Kling reported that there were no reportable incidents. ADJOURNMENT There being no further matters for discussion, the meeting was adjourned at 8:25 p.m. Approved by the Council at their meeting held March 19, 2003.
