The CITY COUNCIL of the City of Baldwin Park met in REGULAR SESSION at the above time and place. ROLL CALL Present: Coundlmember Marien Garcia, David Olivas, Bill Van Cleave, Mayor Pro-Tern Ricardo Pacheco, and Mayor Manuel Lozano Also Present: Sid Mousavi, Interim Chief Executive Officer; Stephanie Scher, City Attorney; Mark Kling. Chief of Police; Hennie Apodaca, Interim Finance Director; Shafique Naiyer. Public Works Director; Melecio Picazo, Interim Community Development Director; Manny Carrillo. Recreation and Community Services Director; Kathryn Tizcareno, City Clerk; Maria A. Contreras, City Treasurer; and Kathleen Sessman, Deputy City Clerk ANNOUNCEMENTS Mayor Lozano offered his deepest condolences to all those men and women who have lost their lives this past week in Iraq. Mayor Lozano announced that on May 28, 2004 at the Senior Citizen Center a breakfast will be held acknowledging USA soldier Victor Chavez. He further requested that Captain Marcus U. Alaniz be recognized and that the city host a breakfast in his honor upon his return from Iraq. Coundlmember Garcia announced that the Eastside Little League is celebrating their 50th Anniversary and will be hosting a 50th Anniversary Dinner and Auction on May 15, 2004 at the Baldwin Park Community Center and invited everyone to attend and support our local groups. Councilmember Olivas stated that last Saturday Cinco de Mayo was celebrated. He stated that Cinco De Mayo is a date that signifies freedom and we should remember that as in all wars, including the war we are involved in today, we are fighting for freedom. He stated that our prayers are with all those who are fighting to preserve our freedom. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS A proclamation was presented to Baldwin Park Seniors proclaiming the month of May 2004 as Older Americans Month." A proclamation was presented to 2004 Miss Poppy Adriana Garcia proclaiming May 9-15, 2004 as Poppy Week." Presentation of Certificates of Recognition to City Employees for their participation on the Baldwin Park Freeway Task Force was tabled to June 2, 2004 meeting. PUBLIC COMMUNICATIONS Mayor Lozano requested an article in the NOW and that the names of Jones Junior High Color Guard be put up on the marquee. Mayor Pro Tern Pacheco requested staff research whether funding is available for expanding Senior Center, programs and events. Dan Trunco requested council consideration of having a separate exercise facility for senior citizens. Dr. John Kerr announced that on May 12, 2004 at 9:00 a.m. at the Community Center the 3rd Annual Older American Recognition Day will be celebrated and invited all to attend. Janet Torres inquired whom she needed to talk to regarding re-establishing the Pony League, Council directed Director Carrillo to meet with Ms. Torres and address issue. CONSENT CALENDAR APPROVED Mayor Pro Tern Pacheco requested that the following items be removed from the Consent Calendar for discussion: 1) Item 1-E ORDINANCE AMENDING CHAPTER 118 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO MASSAGE ESTABLISHMENTS 2) Item 1-F APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE AND SOLICIT BIDS FOR THE INSTALLATION OF TRAFFIC SIGNALS AT FRANCISQUITO AVENUE AND GARVEY AVENUE. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR THE PERIOD OF MAY 6, 2004 TO MAY 18, 2004. The City Council approved the preparation and presentation of the proposed certificates. proclamations and plaques. APPROVAL OF CHANGE ORDER NO. 2 FOR ADVANCED APPLIED ENGINEERING, INC. The City Council approved Change Order No. 2 with Advanced Applied Engineering, Inc. in an amount not to exceed $19,084. A motion was made to waive further reading, read by title only and adopt on second reading Ordinance No. 1233 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CHAPTER 118 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO MASSAGE ESTABLISHMENTS." MOTION: Mayor Pro Tern Pacheco SECOND: Councilmember Van Cleave Carried AWARD OF CONTRACT FOR THE CONSTRUCTION OP BARNES PARK IMPROVEMENTS, CIP 619C In response to a request by Councilmember Olivas, Director Carrillo provided Council with a brief summary of the improvements and the new State of the Art facility that will be part of this project. The Mayor was authorized to execute the Agreement. Additional funds for Hirsch & Associates, Inc., in the Amount of $30,000 for construction support for this project were approved. The Director of Public Works was authorized to execute any necessary change orders in an amount not to exceed ten percent) 10%) of the original contract amount. The reallocation of $200.000 of CDBG funds in FY 2003-04 budget from the Civic Auditorium to the Barnes Park project was approved. Staff was authorized to appropriate funds in the amount of $1,878,822 to complete the construction of this project. The addition of this project to the Capital Improvement Projects for FY 2003-04 and 2004-05 was approved. MOTION: Councilmember Olivas SECOND: Mayor Pro Tern Pacheco Carried REPORTS OF OFFICERS INTRODUCTION OF AN ORDINANCE AMENDING SECTIONS 97.5 TO TITLE IX OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO BLINDER RACKS In response to an inquiry by Councilmember Olivas. City Attorney Scher confirmed that Ordinance 1235 had been reviewed and approved by City Attorney's office. A motion was then made to waive further reading, read by title only and introduce for first reading Ordinance No. 1235 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTIONS 97.5 TO TITLE IX OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO BLINDER RACKS." MOTION: Councilmember Van Cleave SECOND: Mayor Pro Tern Pacheco Carried DIRECTION AND APPROVAL FOR THE RENAMING OF THE FAMILY SERVICE CENTER Mayor Pro Tern Pacheco stated that a public input meeting had been held and public input had been collected. He stated that the community strongly supported the renaming of the Family Service Center to Ten G. Muse Family Service Center. A motion was made to approve the renaming from the Family Service Center to the Ten G. Muse Family Service Center. Staff was direct to proceed with the necessary steps to finalize signage. Approved the date of July 29, 2004 for the renaming ceremony. Approved rendering of bronze plaque and authorized the Interim Finance Director to expend $2,941 from account 100.81.5210 to purchase the necessary items. MOTION: Mayor Pro Tern Pacheco SECOND: Councilmember Garcia Carried REVIEW OF IN-HOUSE COMMITTEE ASSIGNMENTS CONTINUED FROM APRIL 21.2004) A motion was made to table item to the May 19, 2004 meeting. MOTION: Mayor Pro Tern Pacheco SECOND: Mayor Lozano Carried INTRODUCTION OF AN ORDINANCE AMENDING SECTIONS 38.15, 38.16, 38.17 AND 38.18 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO SMOKING IN AND AROUND PUBLIC BUILDINGS AND PUBLIC PARKS CONTINUED FROM APRIL 21.2004) Councilmember Garcia stated that this non-smoking ordinance will only apply to city property and explained that this is an important amendment to our city code and a strong step towards building a healthy community. If the ordinance meets council approval it will be considered during meet and confer and brought back sometime in June 2004 for approval. In addition, City Attorney Scher requested clarification from council on the language regarding smoking on sidewalks and what the desired non-smoking boundaries are when council is talking about parks. After a brief discussion, council directed staff that the ordinance should encompass the full perimeter, including sidewalks of parks and other recreation related facilities and the full perimeter of non-recreational city facility, sidewalks not included. Councilmember Garcia requested that prior to meet and confer with our employee groups staff look into providing smoking jessation programs to employees interested in taking advantage of it. Councilmember Olivas requested staff look at finding a location at City Hall where employee's can smoke that is not outside the Council Chambers. A motion was made to direct matter back to staff for handling, staff was directed to take matter to meet and confer and revise ordinance as appropriate. MOTION: Councilmember Garcia SECOND: Mayor Pro Tern Pacheco Carried A JOINT MEETING OF THE CITY COUNCIL AND THE REDEVELOPMENT AGENCY TO CONSIDER AMENDMENT 2004 TO THE REDEVELOPMENT PLAN FOR THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AREA REFERRED TO AS AMENDMENT 2004") AND THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT PREPARED IN CONNECTION THEREWITH At this time. Chair Lozano opened the Community Redevelopment Agency meeting for the purpose of conducting the Joint Meeting with the City Council.
