The CITY COUNCIL of the City of Baldwin Park met in REGULAR SESSION at the above time and place. ROLL CALL Present: Coundlmembers: Marten Garcia, David Olivas, Bill Van Cleave. Chief Deputy City Clerk ANNOUNCEMENTS Mayor Lozano requested to adjourn in memory of Ms. Doris Lane. an active senior resident of the City of Baldwin Park. Upon request by Mayor Pro Tern Pacheco and by Council consensus, a request to prepare a proclamation proclaiming September 27, 2004 as Family Day, was approved to be presented at the Council meeting of September 1, 2004. Staff was authorized to begin the necessary preparations for a City sponsored Family Day event to be held Saturday, September 25. 2004. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS The City Council joined the Mayor in presenting the Commendations as follows: The Mayor administered the Oaths of Office and was joined by the City Council in presenting Certificates of Appointments to newly appointed and re-appointed Personnel, Planning and Recreation and Community Services Commissioners. The presentation of a Certificate of Appreciation to Explorer Julio Alvarez for Service to Police Department Explorer Post was postponed to an unspecified date. PUBLIC COMMUNICATIONS Mr. Dan Trunco. resident, spoke on issues relating to Councilmember Van Cleave. WARRANTS & DEMANDS Report was approved, received and filed. CLAIM REJECTION MARYCRUZ AGUAYO 7.05.04) The City Council rejected the claim of Marycruz Aguayo 7.05.04) and directed staff to send the appropriate notice of rejection to claimant. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR THE PERIOD OF AUGUST 19, 2004 TO AUGUST 31, 2004 The City Council approved the preparation and presentation of the proposed certificates, proclamations and plaques as outlined in report dated August 18, 2004. CHANGE ORDER #1 FOR THE INSTALLATION OF TRAFFIC SIGNAL AT GARVEY AVENUE AND THE 1-10 FREEWAY OFF-RAMP, CIP 878B The City Council approved Change Order #1 in the amount of $23,000 and authorized the Director of Public Works to execute the necessary documentation. DECLARE CITY PROPERTY STORED IN THE AUDITORIUM AS SURPLUS The City Council declared the items stored in the auditorium as surplus property and authorized staff to sell or discard the surplus property accordingly. AWARD OF CONTRACT FOR SERVICES RELATED TO THE REPAIR OF CONCRETE INFRASTRUCTURE IMPROVEMENTS The City Council awarded an annual contract to Top Notch Construction in an amount not to exceed $70,000 for Fiscal Year 2004-05 and authorized the Mayor to execute the Agreement. RESOLUTION AUTHORIZING REWARD PAYMENT TO WITNESS ON CONVICTION OF VANDALISM SUSPECTS Further reading was waived, read by title only and Resolution No. 2004-058 entitled. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA. AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS", was adopted. STATUS OF CITY NEWSLETTER The City Council reviewed the status of the Baldwin Park newsletter and received and filed report dated August 18, 2004. CONSENT CALENDAR ITEMS REMOVED FOR DISCUSSION SUPPORT FOR THE BALDWIN PARK UNIFIED SCHOOL DISTRICT ADULT AND COMMUNITY EDUCATION Mayor Pro Tern Pacheco expressed his support of having a GED Testing Center however, requested that a letter be sent to the School District requesting additional information as to the reason for the dissolution of the previous testing center and any other pertinent information relative to its closure. A motion was made to send a letter to the School District requesting additional information as suggested by Mayor Pro Tern Pacheco and, that a letter of support be sent to the California Department of Education urging that Baldwin Park Unified School District Adult and Community Education be granted G.E.D. testing center status. MOTION: Mayor Pro Tern Pacheco SECOND: Councilmember Van Cleave Carried REPORTS OF OFFICERS ORDINANCE AMENDING CHAPTER 72 OF THE BALDWIN PARK MUNICIPAL CODE ESTABLISHING A PARKING SCHEDULE FOR PERMIT PARKING ON CERTAIN SCHOOL STREETS Director Naiyer presented the report as follows: This report requests that the City Council introduce for first reading Ordinance No. 1238 which will amend the current parking restriction schedule on certain streets and allow permit for parking adjacent to certain schools from 7:00 a.m. to 6:00 p.m., Monday through Friday for a limited period. This permit will expire September 1, 2005, unless an extension is approved by the City Council. In several schools in the Baldwin Park School District there is no sufficient parking available for teachers and school staff. District staff members are forced to park on school grounds or on the streets adjacent to or in front of the schools. During street sweeping hours, they are ticketed on a regular basis for parking violations. This issue has been raised during several 2 + 2 meetings between the members of the City Council and the Baldwin Park Unified School District. The School District contacted Public Works for assistance several months ago. Skvarna, Superintendent of Schools, requesting to allow teachers and staff to park on streets adjacent to certain schools due to the acute parking problem. Public Works staff investigated the situation and observed that school staff parking is a serious problem in certain schools. As they have no reasonable alternative to parking on the street, receiving tickets on a regular basis for parking violations does not seem fair to them. The Baldwin Park Police Department is justified in giving tickets based on the regulatory signs posted on these streets. Staff is recommending that the signs be replaced with signs that allow permit parking per State of California Vehicle Code. Local authorities can allow preferential parking to school personnel to park on specified streets. To make it legal, the City Council has to pass an ordinance as Council has done in the past. Public Works staff will perform the removal and installation of signs. The District has agreed to pay for the manufacturing of signs and printing of permits approved by Public Works and the Police Departments. Permit for parking will be issued by the Public Works Department of the City of Baldwin Park. The City sweeps the streets once a week. The District has agreed to do it more than once a week and submit their sweeping records to the Public Works Department for the purpose ofAB939 compliance. Director Naiyer concluded by stating that the signs will be posted to only one side of the street, which is adjacent to the school- At present, most school staff is parking on this side on weekdays during school hours. The impact of the posted signs allowing the parking will be negligible on residents except that the school staff will not be getting parking tickets. Staff is proposing that this permit procedure be implemented on a trial basis for one year. It is anticipated that the School District will construct new parking lots so that these signs can be eliminated at that time. Councilmember Garcia expressed concern with the proposed ordinance particularly because she feels that the method in which this item has been presented and requested by the District has circumvented the process. This matter was discussed at a 2+2 meeting on October 17. 2002. At that time, alternatives were given by those present, and it was determined that the School District would take this matter back to the district for implementation of a resolution. It was never intended for this matter to come back to the Council for the purpose of establishing an ordinance or policy. She further stated that adoption of this ordinance will set a precedence and expresses a form of preferential treatment for district staff members. Such action will be unfair to the residents, who oftentimes, have requested preferential treatment, however, have been denied. Councilmember Garcia further suggested that in the future, staff verify with applicable committee members to ascertain that these types of matters and/or requests are not duplicated in effort. Mayor Pro Tern Pacheco concurred with the comments made by Councilmember Garcia and expressed his opposition to adoption of this ordinance. After discussion, a motion was made to deny introduction of Ordinance No. 1238 and to refer this matter back to the 2+2 Committee for their review and handling. MOTION: Mayor Pro Tern Pacheco SECOND: Councilmember Van Cleave BIB] 38356-U01 2004-U02 08-U02 18-U02 CC-U02 MIN-U02 LI1-U03 FO8420-U03 FO35391-U03 DO59391-U03 C4-U03 MINUTES1-U03 1/3/2005-U04 ROBIN-U04 REGULAR-U05 2004 08 18 CC MINL³×City Council Minutes August 18, 2004 Page 5 ORDINANCE ADOPTING BY REFERENCE, CHANGES TO THE LOS ANGELES COUNTY CODE TITLE 10, RELATING TO ANIMAL CARE AND CONTROL SERVICES Interim Director Mousavi presented the report as follows: This report requests that the City Council introduce for first reading Ordinance No. 1241. which will amend Baldwin Park Municipal Code Chapter 92 relating to Animal Control. As a result of the recent incidents in which large numbers of animals have been kept in confined and unsanitary conditions, the Los Angeles County Board of Supervisors adopted an animal facility grading system on June 29, 2004. The new system is designed to assist pet owners and general consumers in their selection of animal related businesses. The system will provide a letter grade like that currently provided to restaurants. A motion was made to waive further reading, read by title only and introduce for first reading. Ordinance No- 1241 entitled. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING CHAPTER 92 OF THE BALDWIN PARK MUNICIPAL CODE TO ADOPT BY REFERENCE TITLE 10 OF THE LOS ANGELES COUNTY CODE RELATING TO ANIMAL CONTROL". MOTION: Councilmember Olivas SECOND: Councilmember Garcia NOES: Councilmember Van Cleave and Mayor Pro Tern Pacheco Carried POLICE DEPARTMENT TECHNOLOGY UPGRADE At the conclusion of Council's review of a PowerPoint presentation outlining the proposed Police Department Technology Upgrade, a motion was made to: 1) Authorize the Chief of Police to proceed with the police technology upgrade renovation project; 2) Authorize the Interim Finance Director to appropriate the necessary funds from the various grant funding sources into the appropriate Police Department Cost Center 25; and 3) Direct the Chief of Police to provide updates to the City Council, via status report, once the project is complete. MOTION: Councilmember Marien Garcia SECOND: Councilmember Olivas Carried COUNCIL / STAFF REQUESTS AND COMMUNICATIONS REQUEST BY MAYOR LOZANO FOR DISCUSSION OF MOSQUITO ABATEMENT PROGRAM At the request of Mayor Lozano and by Council consensus, staff was directed to bring back this matter in September, with alternatives for continued mosquito abatement within the City of Baldwin Park. There were no objections. Councilmember Olivas requested staff to reproduce the flyer distributed by the Vector Control such that it is more legible. There were no objections. Councilmember Olivas requested that the City look at other options the District might have pertaining to mosquito abatement. He also suggested looking at the option of providing this service in-house. There were no objections. RELAY FOR LIFE PARTICIPANTS ACKNOWLEDGED Councilmember Garcia thanked all staff members who participated in the recent Relay for Life event. REQUEST FOR RESIDENTIAL CODE ENFORCEMENT Councilmember Garcia referred to an anonymous letter she received regarding the lack of maintenance of a residential property located at Laurens and Ohio Streets. She stated that the living conditions of this residence are deplorable. There are many existing health and safety code violations present. She suggested that this matter be handled immediately by way of enforcement. She further stated that if the City does not have the authority to enforce this matter, that an ordinance allowing such enforcement be brought back for Council review and adoption. There were no objections. ENFORCEMENT OF NON-PERMITTED ICE CREAM TRUCKS Councilmember Garcia expressed concern with the fact that some ice cream vendors are not displaying their city issued decal and perhaps some are operating without a city issued permit- She requested that the City Council review how these vendors are permitted and that staff ensures that only permitted trucks are in the City. There were no objections. PROPERTY MAINTENANCE ENFORCEMENT OF 99^ STORE Mayor Lozano requested staff to contact the 99^ store with a demand for immediate property maintenance. Should the property owner/tenant refuse to clean up the property. Mayor Lozano requested City staff to dean. and send the owner a bill for service. There were no objections. PROPOSED ORDINANCE REGULATING RESIDENTIAL FENCE HEIGHTS Councilmember Olivas informed the Council that staff is currently researching existing regulations of residential fence heights. He suggested that if there is not an existing ordinance on record, that an ordinance be developed for review and Council consideration of approval. There were no objections. PROPOSED POLICY RELATING TO REVENUES GENERATED BY PUBLIC PHONES LOCATED ON PUBLIC RIGHT-OF-WAYS Councilmember Olivas informed the Council that staff is currently looking into developing a policy that would generate revenues for public phones located within public right-of-ways. A report will be forthcoming for Council review and consideration of approval.
