CALL TO ORDER ROLL CALL Present: Councilmember Bejarano, Councilmember Pacheco, Mayor Pro Tern Olivas, Mayor Lozano. Absent: Council Member Garcia excused. INVOCATION Led by Council Member Bejarano PLEDGE OF ALLEGIANCE ANNOUNCEMENTS Mayor Lozano closed in memory of the recently deceased Baldwin Park infant and directed staff to send a Letter of Condolence to the family. Mayor Pro Tern Olivas closed on behalf of those affected by the violence in Lebanon. PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS Presentation of Proclamation proclaiming September 25, 2006 as Family Day in the City of Baldwin Park Page 1 of 5 2006 08 02 CC MINHÄ—@¸—Õ>Xþ Mayor Lozano read the proclamation proclaiming September 25th as Family Day in the City of Baldwin Park. Mayor Lozano & Council Member Pacheco requested that the statistics of the CASA Study be published in the NOW. There were no objections. Administration of Oath of Office and presentation of Certificates of Appointment to newly appointed Recreation & Community Services Commissioners Erika Christine Arevalos North Park High School), Michelle Guzman Baldwin Park High School) and Bryant Ortega Sierra Vista High School) The oath of office & certificate of appointment were presented to re-appointed Recreation & Community Services Commissioner Bryant Ortega PUBLIC COMMUNICATIONS NONE CONSENT CALENDAR Motion: A motion was made to approve Consent Calendar Item Nos. 1 7 as presented and as follows: Moved by Mayor Pro Tern Olivas, seconded by Councilmember Pacheco. 1. WARRANTS & DEMANDS City Council received and filed the report. 2. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR THE PERIOD OF AUGUST 2, 2006 TO AUGUST 15, 2006 City Council approved the preparation and presentation of the awards as outlined in staff report. 3. MINUTES City Council approved the minutes of the July 5, 2006 Regular) meeting. 4. REJECTION OF CLAIMS City Council rejected the claims of 1) Hazel Bendezu, Fatima Padilla and Emanuel Mares 01 05 016A, B & C); and 2) Felipe Rodriguez 01 05 020A) and directed staff to send the appropriate notices of rejection to claimants. 5. 2nd READING OF ORDINANCE NO. 1288 City Council waived further reading, read by title only and adopted on second reading Ordinance No. 1288 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 53.11 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO CONSTRUCTION AND DEMOLITION DIVERSION DEPOSITS." 6. RE-CERTIFICATION OF TELACU SENIOR COURT, INC. AS A BALDWIN Page 2 of 5 2006 08 02 CC MINHÄ—@¸—Õ>Xþ PARK COMMUNITY HOUSING DEVELOPMENT ORGANIZATION CHDO) City Council 1) re-certified TELACU, Senior Court, Inc. TELACU) as a CHDO for the City of Baldwin Park and 2) awarded $62,000 from the mandated fifteen percent 15%) of HOME Program Funds; and 3) authorized the Mayor to execute the amended Services Agreement with TELACU for ADA improvements to eight affordable housing units located at 14442 Pacific Avenue in an amount not to exceed $62,000. 7. 2nd READING OF ORDINANCE NO. 1290 City Council waived further reading, read by title only and adopted on second reading Ordinance No. 1290 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING PART 5 OF CHAPTER 153 OF THE BALDWIN PARK MUNICIPAL CODE TO ADD PROVISIONS RELATING TO A REDEVELOPMENT OVERLAY." SET MATTERS PUBLIC HEARINGS 8. PUBLIC HEARING TO CONSIDER AN EXTENSION OF THE URGENCY ORDINANCE ESTABLISHING A MORATORIUM ON PROFESSIONAL, MEDICAL AND DENTAL OFFICES; DRIVE-THRU ESTABLISHMENTS AND WATER STORES/KIOSKS Motion: Approve A motion was made to adopt the Reports of Measures taken to alleviate the conditions that led to the adoption of Ordinance NO. 1287" and waive further reading, read by title only and adopt as an Urgency Ordinance No. 1291 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK EXTENDING A MORATORIUM ON 1) PROFESSIONAL, MEDICAL AND DENTAL OFFICES; 2) DRIVE-THRU ESTABLISHMENTS AND 3) WATER STORES/KIOSKS ON ANY PROPERTY WITHIN THE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROEJCT AREA AND SUB AREAS 2 & 3 OF THE SIERRA VISTA REDEVELOPMENT PROJECT AREA." Moved by Mayor Lozano, seconded by Councilmember Pacheco. City Planner Harbin presented the report. Mayor Lozano opened the public hearing for those in opposition of the proposed Ordinance. Dr. Victoria Chen, Dr. Jyh C. Chang, Mr. Kuo Chung Chen, Mr. Simon Lee and Thomas Carey spoke. The public hearing was opened to those wishing to speak in favor of the proposed Ordinance. Seeing no further interest, the public hearing was declared closed. Mayor Lozano, Council Members Bejarano & Pacheco commented on the moratorium. Council Member Bejarano requested that in the future, staff advise individuals when their property is in a redevelopment area. Moved by Mayor Lozano, seconded by Councilmember Bejarano. REPORTS OF OFFICERS 9. CONSIDERATION OF ADOPTION OF AN ORDINANCE REAFFIRMING THE APPLICABILITY OF THE UTILITY USER TAX TO TELEPHONE COMMUNICATION CHARGES BASED ON TIME OR DISTANCE City Attorney Scher presented the report Motion: A motion was made to waive further reading, read by title only and introduce for first reading Ordinance No. 1292 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SUBDIVISION C) OF SECTION 35.097 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO PREVIOUSLY APPROVED EXEMPTIONS FROM THE UTILITY USER TAX." Moved by Mayor Lozano, seconded by Councilmember Bejarano. 10. REVIEW OF COMMISSION APPLICANTS AND CONSIDERATION OF APPOINTMENTS TO FILL THE JUNE 30, 2006 SCHEDULED VACANCIES ON VARIOUS COMMISSIONS; AND THE UNSCHEDULED VACANCY ON THE HOUSING COMMISSION Continued from July 19, 2006) Council Member Bejarano requested that the incumbents be re-appointed to the Planning Commission. Council Member Pacheco requested that the appointments be deferred until there is a full quorum of the Council. There were no objections. CITY COUNCIL / CITY CLERK / CITY TREASURER / STAFF REQUESTS & COMMUNICATIONS 11. Request by Councilmember Ricardo Pacheco for discussion on the following: a) Request for Council discussion and direction to staff to establish framework and policy for fiscal accountability. Council Member Pacheco requested that staff provide a month-to-month report to keep the Council updated on the budget and the fiscal impacts of budget amendments. He also requested that contracts with consultants be re-evaluated to see if staff could perform those same duties. Council Member Bejarano presented a re-structuring plan, including a timeline for staff to follow, in order to meet the Council's goals for a balanced budget. He requested Council consensus to direct staff to work on implementation of a re-structuring plan. Council Member Pacheco requested that staff not implement any changes without first receiving approval of the Council. Mayor Lozano & Mayor Pro Tern Olivas also commented on the proposed plan. Mayor Pro Tern Olivas requested that Council bring their ideas to the table for the special meeting of August 9, Page 4 of 5 2006 08 02 CC MINHÄ—@¸—Õ>Xþ 2006. There were no objections. City Attorney Scher inquired about Council Member Bejarano's proposed meeting dates. He advised that he had specifically chosen the dates based on the fact that they were off-meeting weeks and ensure that there is enough time for staff & Council to work on the plan. For the benefit of the audience, Mayor Lozano announced the Pride of the Valley 5K Run. ADJOURNMENT There being no other matters for discussion the meeting was adjourned at 8:30 p. m.
