Bejarano, Mayor Pro Tern Marlen Garcia, Monica Garcia, Ricardo Pacheco, Council Members Maria Contreras, City Treasurer Susan Rubio, City Clerk The CITY COUNCIL of the City of Baldwin Park met in REGULAR SESSION at the above time and place. CALL TO ORDER INVOCATION Led by Pastor Jackson PLEDGE OF ALLEGIANCE ANNOUNCEMENTS Mayor Lozano expressed deep condolences to those who have lost their lives in Iraq and acknowledged the five year anniversary to the conflict. City Treasurer Contreras closed in memory of Grace Mitzler, BPUSD Employee. ROLL CALL Present: Councilmember Marlen Garcia, Councilmember Monica Garcia, Councilmember Pacheco, Mayor Pro Tern Bejarano, Mayor Lozano. Absent: None. Also Present: Vijay Singhal, Chief Executive Officer, Joseph W. He further announced that the Baldwin Park Sister City Association would be preparing a video to promote the City of Baldwin Park and requested a $500 contribution from the City for its production. Margaret Salonisen & Mary Doza, Baldwin Park Women's Club announced the success of their recent fundraising dinner. On April 2, 2008 at 1:00 p.m. they will be having a scholarship tea. Neil Evans, attorney representing Royal Coaches spoke about the proposed extension of the Royal Coaches contract. He referenced a letter that he submitted to the Council letter on file in the Office of the City Clerk.) Bill Salazar, owner Royal Coaches, stated that the intention is not to pass any added expenses to the public. He also stated that the value of the contact is not as high as the previous speaker stated. Mr. Salazar expressed his displeasure that Jan's Towing was given an extension in the City of Covina on Consent Calendar, and Royal Coaches did not have the opportunity to bid. Manuel Moreno, field supervisor/night manager of Royal Coaches spoke in support of the proposed contract extension. Joyce Nakashima spoke in support of Item #6 and expressed the importance of breastfeeding. Karen Sidusha, WIC representative spoke in favor of Item #6 and requested Council support of the resolution. Laura Santos, Royal Coaches stated for the record that Royal Coaches provides excellent service and that they are a community-minded organization located in the City of Baldwin Park. Margaret Salonisen, resident, expressed her support for those who live and work in Baldwin Park. Mary Doza spoke favorably about Royal Coaches. Elisa Moreno, resident spoke about the favorable service that Royal Coaches provides and expressed her desire that the contract stay in Baldwin Park Thomas Carey, resident spoke favorably about Royal Coaches. Yolanda Serna, Assemblymember Ed Hernandez' representative, announced that Cecelia Bernal of Baldwin Park will be recognized as Woman of Achievement. She also spoke favorably of Royal Coaches. Mary Ferrer announced that a Pleasantview student won a spelling bee and thanked the Council and staff for the recent presentation that they had at the school. Mayor Lozano requested staff follow up on the speed bump issue. Greg Tuttle, business owner, expressed concern regarding the composition of the PAC, specifically with Valley County Water Boardmember Mariana Lake. He further commented on the Police Department budget. James Treasure, resident spoke about the recent PAC meeting and the PAC process. He also stated that the Council would be held responsible for the failing health of those affected in the project area. Amelita Bes, resident, expressed her displeasure with the Council and asked them to stand with the residents of the City of Baldwin Park. Commissioner Magda Torrelas stated that the City needs to progress for the benefit of the children and fears that Baldwin Park would be left behind. Steve Duggan, Jan's Towing commented on the recent contract extension that his company received from the City of Covina and clarified that the terms of the contract had not changed, therefore, it was his belief that it did not have to go out to bid. Public Communications were closed at 8:10 p.m. CONSENT CALENDAR Motion: Approve CONSENT CALENDAR with the exception of Item# 4 & 6 Moved by Mayor Lozano, seconded by Mayor Pro Tern Bejarano. 1. WARRANTS & DEMANDS City Council received and filed the report. 2. MINUTES City Council approved the minutes of the March 5, 2008 meeting regular). 3. MONTHLY FINANCIAL REPORT City Council received and filed the report. The following item was pulled by Mayor Lozano 4. AUDIT SERVICES AWARD OF CONTRACT Mayor Lozano recommended that the City retain the services the of Vasquez & Company for audit services. Motion: A motion was made to retain the services of Vasquez & Company. Mayor Pro Tom Bejarano objected Moved by Mayor Lozano, seconded by Councilmember Pacheco. Vote: Motion carried 4-1. Ayes: Councilmember Marlen Garcia; Councilmember Monica Garcia; Councilmember Pacheco; Mayor Lozano Noes: Mayor Pro Tem Bejarano 5. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN FEES FOR POLICE RELATED SERVICES, EXTENDING THE CURRENT TOWING CONTRACT FOR A PERIOD OF FIVE YEARS, AND REVISING THOSE SAME FEES, AS SET FORTH IN RESOLUTION NO. 2005- 001 Continued from March 5, 2008) City Council 1) increased the current towing franchise agreement amount of $52 per vehicle stored to $111.55 per vehicle stored; 2) increased the current public administrative release fees of $113 per vehicle to $144.24 per vehicle; 3) approved the proposed implementation of a new) franchise agreement fee of 20% of all proceeds incurred by Royal Coaches as a result of police 30-day vehicle storages/impounds. This fee will reflect an additional 5% increase totaling 25%) commencing September 1, 2010. Furthermore, Council amended the current franchise agreement by providing for a five-year extension on the current agreement through September 30, 2014. The current agreement ends September 30, 2009. The recommendation is to extend the terms of the current agreement and include an amendment defining additional terms and conditions and waive further reading, read by title only and adopted Resolution No. 2008-016 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN FEES FOR POLICE RELATED SERVICES AND REVISING THOSE SAME FEES, AS SET FORTH IN RESOLUTION NO. 2005-001". The following item was pulled by Mayor Lozano: 6. RESOLUTION PROMOTING AND SUPPORTING BREASTFEEDING FOR CITY EMPLOYEES Motion: waive further reading, read by title only and, adopt Resolution No. 2008-015 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, SUPPORTING BREASTFEEDING AMONG CITY EMPLOYEES WITHIN THE WORKPLACE" with changes. Moved by Mayor Lozano, seconded by Councilmember Marlen Garcia. For clarification, Item #5 was approved with the other items on Consent Calendar. PUBLIC HEARINGS 7. Mayor Lozano opened the public hearing for those wishing to speak in favor there was no interest. He opened for those in opposition Thomas Carey, resident. Director Galvez commented on the proposed street construction. Seeing no further interest, the hearing was closed. Motion: waive further reading, read by title only and adopt Resolution No. 2008-019 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, ORDERING THE VACATION OF A PORTION OF CALMVIEW AVENUE BETWEEN NUBIA STREET AND OLIVE STREET V-1-2008) PURSUANT TO STREETS AND HIGHWAYS CODE 8300-8325 UPON FULFILLING ALL OF THE TERMS AND CONDITIONS HEREIN ESTABLISHED". Moved by Mayor Lozano, seconded by Councilmember Marlen Garcia. CITY COUNCIL/ CITY CLERK I CITY TREASURER / STAFF REQUESTS & COMMUNICATIONS Councilmember Marten Garcia requested Council consideration to send a letter of support for SB 1420 Padilla) relating to menu labeling. There were no objections. A draft letter would be submitted for Council approval at the next meeting. Councilmember Pacheco commented on the lack of service with the Dial-a-ride program and requested that staff submit a status report to the Council.
