Councilmember Pacheco joined the meeting at 7:45 p.m. ANNOUNCEMENTS NONE PROCLAMATIONS, COMMENDATIONS & PRESENTATIONS Certificate presentation to Cecelia Bernal, 2008 Woman of Achievement in the 57th Assembly District Mayor Lozano, joined by the City Council, Clerk and Treasurer presented a certificate to Cecelia Bernal in recognition of being named Woman of Distinction in the 57th Assembly District. Another BPHS student wrote a letter about his experience with smoking Councilwoman Marlen Garcia requested Council consideration of adopting a local policy to address the issue of youth access to tobacco in the City of Baldwin Park. Representative Mike gave a presentation on this topic and went over various statistics as they related to the City of Baldwin Park Administration of Oath of Office to Chief of Police Lili Hadsell Mayor Lozano administered the Oath of Office to Chief of Police Lili Hadsell. All Councilmembers, City Clerk and City Treasurer commented. Requested that flag be flown at half staff until noon Jay Tejano, resident in support of the proposed redevelopment project and Bisno Development Thomas Carey, resident spoke about the recent heat wave and the animals in the shelter, as well as state budget issues Maria Sandoval, resident spoke in support of proposed redevelopment in the city Victor Salarza, resident spoke in favor of proposed redevelopment Greg Tuttle, business owner addressed comments made by Mayor Lozano which he felt disregarded the importance of the business owners in the city. He further commented on redevelopment and developers Magda Torrellas, resident spoke about the importance of redevelopment in the city Cecelia Lee, Ramona Blvd buy-back store, spoke in opposition to the proposed redevelopment project, but in support of revitalization. Gail Zauss, former Baldwin Park resident spoke about Prop 98 as it relates to rent control and referenced the hand-out she presented to the Council Mr. Zepeda, resident spoke about the proposed redevelopment project Cruz Baca Simbela, resident commented on a recent explanation of Prop 98 as it was given by City Attorney Pannone related to relocation services Rosa Vasquez, resident thanked the Council and staff for their assistance in Page 3 of 9 BIB] 39636-U01 2008-U02 05-U02 21-U02 CC-U02 MIN-U02 LI1-U03 FO8420-U03 FO117552-U03 DO118419-U03 C4-U03 MINUTES1-U03 7/2/2008-U04 ROBIN-U04 2008 05 21 CC MINHÄ—@¸—‘  Í«getting her C & D reimbursement in full Juan Vargas, resident spoke about the increased cost for building fees and the C&D program. Andrew Morales Viramontes, resident spoke in support of the proposed redevelopment project and about the current propositions Terry Muse, resident congratulated Cecelia Bernal on her recognition and inquired about the Hampshire House" on Vineland. She also commented on past proposed redevelopment projects in Baldwin Park. Baldwin Park resident expressed concern about the proposed project, specifically for students who walk through the area of Bogart. Tony Mena, resident spoke in support of the proposed redevelopment project. James Treasure, resident spoke about Propositions 98 & 99 and stated his support of Proposition 98. Kimberly Lazcano, resident spoke in support of the proposed redevelopment project and new businesses coming into Baldwin Park Andrea, Baldwin Park High School student said that she and her friends go to other cities to shop. She spoke in support of the proposed redevelopment project. Thomas Sanchez, spoke in support of the proposed redevelopment project. Ray Alber, business owner commented that even though some of his business is conducted outside of the city, he bring money to the city. Also spoke about the offer that was made for his business/property. Olivia Baca-Davidson, resident spoke about redevelopment and projects in other areas of the city Mayor Lozano stated he would not retract previous comments that were made. He also commented about the proposed propositions. Councilmember Marlen Garcia thanked the youth for coming out and voicing their opinions. She also referenced an editorial in the San Gabriel Valley Tribune that stated the elected officials in the city of Baldwin Park have historically used eminent domain responsibly. Spoke about the project area and eminent domain. Mayor Pro Tern Bejarano commented about the information that was provided by Ms. Zauss. He also commented on being fiscally responsible for the city and that he supports the businesses that are in Baldwin Park. He spoke in support of the Woods' and Alber's businesses as he had had personal, positive experiences with them. CONSENT CALENDAR Motion: Approve CONSENT CALENDAR with the exception of Item #7) Moved by Mayor Lozano, seconded by Councilmember Marlen Garcia. 1. WARRANTS AND DEMANDS City Council received and filed. 2. PROPOSED RECOGNITIONS BY THE MAYOR AND CITY COUNCIL FOR THE PERIOD OF MAY 21, 2008 JUNE 3, 2008 City Council approved the preparation and presentation of the awards as outlined in the staff report. 3. MINUTES City Council approved the minutes of the May 7, 2008 meeting regular.) 4. CITY TREASURER'S REPORT MARCH 2008 City Council received and filed the report 5. CLAIM REJECTIONS City Council rejected the claims of Vicente Rodriguez and Kimberly Perez and directed staff to send the appropriate notices of rejection to claimants. 6. PROPOSED EMPLOYMENT AGREEMENT WITH CHIEF OF POLICE LILI HADSELL City Council approved the proposed Employment Agreement and authorized the Mayor to execute the Agreement. The following item was pulled by Mayor Pro Tern Bejarano for separate discussion: 7. RESOLUTION 2008-032 IN OPPOSITION TO THE PROPOSED TOLL LANES ON THE 1-10 AND 1-210 FREEWAYS City Council waived further reading, read by title only and adopted Resolution No. 2008-032 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS OPPOSITION TO THE CONVERSION OF EXISTING HIGH OCCUPANCY VEHICLE HOV) LANES TO HIGH OCCUPANCY TOLL HOT) LANES ON THE 1-10 FREEWAY." Mayor Pro Tern Bejarano requested that Council reconsider approving this item and suggested that they consider conditional" opposition. Mayor Lozano stated that he was opposed to the proposed HOT lanes and supported the resolution as it was presented. Councilmember Marlen Garcia understood Mayor Pro Tern Bejarano's concern but felt that the East San Gabriel Valley was overlooked when it came to funding for freeway improvements. She stated her support for the resolution as it was presented. Motion: Staff recommends City Council waive further reading, read by title only and adopt Resolution No. 2008-032 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DECLARING ITS OPPOSITION TO THE CONVERSION OF EXISTING HIGH OCCUPANCY VEHICLE HOV) LANES TO HIGH OCCUPANCY TOLL HOT) LANES ON THE 1-10 FREEWAY. Mayor Pro Tem Bejarano objected Moved by Mayor Lozano, seconded by Councilmember Pacheco. Vote: Motion carried 3-1. Ayes: Councilmember Marlen Garcia; Councilmember Pacheco; Mayor Lozano Noes: Mayor Pro Tem Bejarano Absent: Councilmember Monica Garcia 8. 2nd READING OF ORDINANCE NO. 1315 City Council waived further reading, read by title only and adopted on second reading Ordinance No. 1315 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 119.02 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO GARAGE/YARD SALES." 9. AMENDMENT TO CURRENT CONTRACT WITH CORRECTIONAL SYSTEMS, INC. TO INCLUDE A WORK FURLOUGH AND SELF-PAY PROGRAM City Council approved the amendment to the existing Agreement with CSI to institute a Work Furlough and Self-Pay jail program and authorized the Chief Executive Officer to execute the amendment. 10. RESOLUTION NO. 2008-028 AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO FILE APPLICATIONS FOR USED OIL RECYCLING BLOCK GRANT FUNDS City Council waived further reading, read by title only and adopted Resolution No. 2008-028 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO FILE AN APPLICATION AND SERVE AS SIGNATORY AUTHORITY FOR THE USED OIL BLOCK GRANT FUNDS FY 2008-2009, 2009-2010, AND 2010-2011." 11.
