Joined by the Council, Clerk & Treasurer, he presented certificates of achievement to the essay contest winners Dr. Kerr of BPACE provided the Council with essay books and a commemorative picture of the event and thanked Chief Hadsell for being their keynote speaker. The instructors were also presented with certificates of recognition Certificate presentation to Baldwin Park High School Cheer squad in recognition of being named National Champions Mayor Lozano, joined by the Council, Clerk & Treasurer presented the squad with certificates of recognition; Cheer Coordinator Egans provided background on the competition and the title they achieved. Mayor Lozano announced that the cheerleaders' pictures, as well as the adult school essay contest winners would be placed in the next issue of the NOW and their names on the marquee at Morgan Park Check presentation to the City of Baldwin Park from Walmart Store manager Marc, Walmart thanked the city for their support and presented the city with a $4,000 check PUBLIC COMMUNICATIONS Jorge Reyes, resident requested the support of the Council & community to eliminate liquor stores in the city for the benefit of the youth Cecelia Bernal, resident spoke on behalf of the Little League and in support of the proposed ordinance regarding fireworks stands being designated for the youth Susan Ramos of Assemblyman Ed Hernandez' office thanked the city for their collaboration with the foreclosure prevention workshop and invited the public to attend Margaret Salonisen, Chamber of Commerce President announced the Chamber's new location and encouraged the Council and public to support events John Duran, resident spoke in support of the proposed ordinance that would designate the fireworks booths to the youth Ken Woods, resident & business owner commented about closed session Page 2 of 8 BIB] 40819-U01 2009-U02 03-U02 18-U02 CC-U02 MIN-U02 LI1-U03 FO8420-U03 FO122580-U03 DO125153-U03 C4-U03 MINUTES1-U03 9/9/2009-U04 ROBIN-U04 2009 03 18 CC MINHÄ—@¸—ÔðXþagenda items Michael Duran, resident spoke in support of the proposed ordinance regarding the designation of fireworks booths for the youth Thomas Cary, resident commented about a closed session agenda item regarding litigation and other matters occurring in the city Greg Tuttle, business owner spoke about recent articles in the Tribune; demographics; proposed projects and other issues in the city Cruz Sembello, resident commented about the speakers who requested fireworks booths and the important impacts they have on the youth Ernesto Villegas, president of Baldwin Park Sister City Association, expressed his appreciation of the support of the Council and spoke about the scholarship and other efforts of the association for the benefit of the city. He also announced and invited the Council to an upcoming turnaround event Mariana Lake, resident spoke about the nomination of Recreation & Community Services Commissioner Irma Tarango as the 57th Assembly District's Woman of the Year Mark Sainz, resident requested that the moratorium on subdivision flaglots be lifted John Rios, resident spoke about pedestrian safety and overgrown vegetation and trash at specific locations and provided pictures for the Council to review Public Communications were closed at 8:00 p.m. Council member Bejarano commented about the rights of the public to express their opinions and of the mutual respect and ground rules that the Council and the public have. He spoke about the allegations that have been made that are not true. He also expressed his opinion that the private lives of public officials are open for public consumption and debate. He would not continue to engage on non-city related issues and commented about the reduction in crime rates and the city's financial state CONSENT CALENDAR Motion: Approve Consent Calendar with the exception of Item Nos. 5 & 9 Moved by Mayor Lozano, seconded by Council member Marlen Garcia. 1. WARRANTS AND DEMANDS City Council received and filed. 2. MINUTES City Council approved the minutes of the special and regular meetings of March 4, 2009. 4. CITY TREASURER'S REPORT DECEMBER 2008 & JANUARY 2009 City Council received and filed. The following item was pulled by Council member Pacheco for separate discussion: 5. PROPOSED EMPLOYMENT AGREEMENT WITH LORENA QUIJANO, DIRECTOR OF FINANCE Council member Pacheco, the Mayor & Council welcomed Ms. Quijano to Baldwin Park Motion: Approve the proposed Employment Agreement with Lorena Quijano, for services as the Director of Finance, and authorize its execution by the Mayor, upon successful completion of the background verification process. Moved by Council member Marlen Garcia, seconded by Mayor Lozano. 6. AWARD OF CONTRACT FOR MORGAN PARK PLAY AREA RESILIENT SURFACING INSTALLATION City Council 1) awarded a Construction Contract to Pacific Construction Company, Inc. in the amount of $83,700; 2) authorized the Mayor to execute the Agreement; and 3) authorized the Director of Public Works to execute any necessary change orders in an amount not to exceed ten percent 10%) of the original contract. 7. APPROVAL OF FACILITY USE AGREEMENT BASSETT LITTLE LEAGUE City Council approved the Facility Use Agreement with Bassett Little League and authorized the Mayor to execute the necessary documents. 8. AWARD A CONTRACT FOR THE CONSTRUCTION MANAGEMENT OF THE SYRACUSE AVENUE STORM DRAIN PROJECT City Council awarded a Consultant Services Contract to SA Associates in the amount of $58,000 and authorized the Mayor to execute the Agreement. Mayor Pro Tern Monica Garcia thanked staff for all of their efforts in creating this program that will provide many benefits to the residents and businesses in the community. She also announced upcoming job fair events Council member Pacheco spoke about this program and a workforce investment center; he shared that he had met with the Assemblymember to get this type of facility in the city. Mayor Pro Tern Monica Garcia stated that it was the ultimate goal of this program to incorporate a workforce office and welcomed the assistance of the Assemblyman Motion: Authorize Chief Executive Officer to 1) proceed with implementing the recommended programs for business development / promotion and for job seekers; 2) enter into an agreement with the Central San Gabriel Valley WorkSource to open a satellite office in Baldwin Park; 3) enter into an agreement with the San Gabriel Valley Small Business Development Center to open a satellite office in Baldwin Park; and 4) appropriate $5,000 for the business development summit and job fair from the existing budget, and no more than $25,000 on the proposed programs in 2009/2010. Moved by Mayor Pro Tern Monica Garcia, seconded by Council member Bejarano. SET MATTERS PUBLIC HEARINGS 10. JOINT PUBLIC HEARING TO CONSIDER ADOPTION OF FY 2009-2010 BUDGET Related Item #2 on Community Development Commission agenda and Item #2 on Housing Authority Agenda) CEO Singhal presented an overview of the city's fiscal state Mayor Lozano opened the public hearing for those wishing to speak in favor or opposition. Seeing no interest, the public hearing was closed. Mayor Lozano expressed his pride in the city and spoke about the obstacles that had been overcome Council member Bejarano thanked staff and encouraged them to continue to have the same enthusiasm and excitement for their jobs and noted that every single department had stepped up. He noted Code Enforcement Officer George Rodrigues, who asked for the tools to help him make the city a better place. Council member Pacheco commented about past budget and staffing issues; he requested that extra funding be allocated towards the hiring of public safety staff. She commended the Police Department for the favorable statistics related to traffic violations and the upcoming programs that would improve the community. Mayor Pro Tern Monica Garcia thanked the Chief Executive Officer, Executive Team and staff and spoke about the need for the city to be flexible in these difficult economic times. The city needed to be open to the opportunities that were presenting themselves Motion: Waive further reading, read by title only and adopt Resolution No. 2009-005 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING THE BUDGET OF THE CITY FOR THE FISCAL YEAR COMMENCING JULY 1, 2009 AND ENDING JUNE 30,2010" Moved by Mayor Lozano, seconded by Mayor Pro Tern Monica Garcia. REPORTS OF OFFICERS 11. IMPLEMENTATION OF CRIME-FREE MULTI HOUSING PROGRAM CEO Singhal spoke about staff and their ability to align talents with resources. Pointed out that Administrative Analyst Gutierrez used to work in the City Clerk's office and was now working on developing this new program. Mayor Lozano also recognized Sgt. Kirkman & Det. Lopez Administrative Analyst Gutierrez, joined with Sgt. Kevin Kirkman and Det. Armando Lopez presented the report Motion: Authorize the implementation of the city's newest crime prevention program, the Crime Free Multi Housing Program. Moved by Mayor Lozano, seconded by Council member Marlen Garcia. 12. APPROVAL OF REDESIGN FOR THE BALDWIN PARK NOW Recreation & Community Services Director Carrillo introduced Acting Program Supervisor Rudolph Galindo and Program Supervisor Monica Killen who presented the report. Program Supervisor Monica Killen further spoke about the proposed changes to the NOW In response to an inquiry from Mayor Pro Tern Monica Garcia it was reported that the paper was not recyclable. She encouraged that recyclable materials be used. In resposne to an inquiry from Council member Pacheco, Acting Program Supervisor Galindo stated that the publication will remain bi-monthly. He also responded to questions regarding the costs for postage and printing Mayor Lozano requested that the hub be incorporated into the design and Council member Marlen Garcia requested that the logo remain the same. Moved by Mayor Lozano, seconded by Council member Marlen Garcia. 13. ORDINANCE NO. 1324 AMENDING THE DEFINITION OF QUALIFYING ORGANIZATIONS ALLOWED TO APPLY FOR FIREWORKS PERMITS CEO Singhal presented the report and talked about the meetings, goals and objectives of the ad-hoc fireworks committee, comprised of Mayor Lozano and Council member Marlen Garcia Council member Pacheco requested that the definition include education, mentoring and counseling organizations and if all 14 permits are not given out, that the remaining be given to other organizations. Additionally, he requested that the lottery be conducted at a City Council meeting. He expressed concern that the definition was too narrow and might not give everyone an opportunity to receive a fireworks booth. City Attorney Pannone, through the Mayor, explained that the definition included youth and youth sports groups. It was stated that the group must be primarily formed to benefit the youth. Mayor Lozano spoke about the desire for these booths to go to the youth organizations. Council member Pacheco inquired about groups that offer youth scholarships. It was stated that under this proposed ordinance, any group that was not focused specifically on the youth would not be eligible to apply for a fireworks booth. Motion: waive further reading, read by title only and introduce for first reading Ordinance No. 1324 entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 93.01 OF THE BALDWIN PARK MUNICIPAL CODE BY AMENDING THE DEFINITION OF QUALIFYING ORGANIZATIONS." Moved by Council member Marlen Garcia, seconded by Mayor Lozano. Mayor Lozano thanked those who spoke in support of the ordinance and encouraged other community groups to continue promoting opportunities for the youth.
